1. Introduction
This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Boltz Entertainment ("we", "us", "our") for the Write Warz software product, including any associated media, printed materials, and online or electronic documentation (collectively, "Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
2. License Grant
We hereby grant you a personal, non-exclusive, non-transferable, limited license to install and use the Software on a single device solely for your personal and non-commercial use, subject to the terms and conditions of this EULA.
3. Intellectual Property Rights
3.1 Software Ownership
The Software and any copies you are authorized to make are the intellectual property of and are owned by Boltz Entertainment. The structure, organization, and code of the Software are valuable trade secrets and confidential information of Boltz Entertainment.
3.2 User-Generated Content
Any stories, sentences, or content created by you within the public game modes of the Software ("User-Generated Content") may be used by Boltz Entertainment for promotional purposes only. Individual sentences contributed by you within the User-Generated Content are considered your intellectual property, and you retain the right to use, modify, and publish such sentences for your purposes, including but not limited to publishing.
3.3 Original Characters
All original characters, narratives, and content created and provided by Boltz Entertainment as part of the Software ("Original Characters") remain the exclusive property of Boltz Entertainment. You are not granted any rights to use the Original Characters for any publishing or commercial purposes outside of the Software.
4. Restrictions
You may not reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Software. You may not rent, lease, lend, sell, redistribute, or sublicense the Software. You may not remove or alter any copyright, trademark, or other proprietary notices on any portion of the Software.
5. No Unlawful Use
You may not use the Software for any purpose that is unlawful or prohibited by this EULA or any applicable laws.
6. Consent to Use Data
You agree that Boltz Entertainment may collect and use technical data and related information, including but not limited to technical information about your device, system, and Software usage, that is gathered periodically to facilitate the provision of Software updates, product support, and other services to you related to the Software. Boltz Entertainment may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you.
7. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from Boltz Entertainment if you fail to comply with any term(s) of this EULA.
8. No Warranty
The Software is provided "AS IS", without warranty of any kind. Boltz Entertainment does not warrant that the Software will meet your requirements or that operation of the Software will be uninterrupted or error-free.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Boltz Entertainment be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of the use of or inability to use the Software.
10. Miscellaneous
This EULA constitutes the entire agreement between you and Boltz Entertainment relating to the Software and supersedes all prior or contemporaneous oral or written communications, proposals, and representations with respect to the Software or any other subject matter covered by this EULA.
11. Governing Law
This EULA shall be governed by the laws of the jurisdiction where Boltz Entertainment is located, without reference to its conflicts of law principles.
By installing, copying, or otherwise using the Software, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
