End User License Agreement
In order to protect Rune Seeker (our "Game") and the members of our community, we need these end user license terms to set out some rules for downloading and using our Game. This license is a legal agreement between you and us (Monster Studios Inc. or “Monster Studios”) and describes the terms and conditions for using the Game.
If you download, use or play our Game, you are agreeing to stick to the rules of these end user license agreement ("EULA") terms. If you don't want to or can't agree to these rules, then you must not download, use or play our Game. This EULA incorporates the Terms of Use for the https://runeseeker.com/ website, and our Privacy Policy. By agreeing to this EULA you also agree to all of the terms of the foregoing documents, so please read through them carefully.
IMPORTANT NOTICE
Rune Seeker is only available to those aged 13 and above. If you are below the age of 13, you must not use Rune Seeker.
You must read through this EULA in its entirety before installing and/or using the Rune Seeker.
The one major rule is that you must not distribute anything we've made unless we specifically agree to it. By "distribute anything we've made" what we mean is:
- give copies of our Game to anyone else;
- make commercial use of anything we've made;
- try to make money from anything we've made; or
- let other people get access to anything we've made in a way that is unfair or unreasonable;
unless we specifically agree to it. And so that we are crystal clear, "the Game" or "what we have made" includes, but is not limited to, the client or the server software for our Game and includes Rune Seeker on all platforms. It also includes updates, patches, downloadable content, add-ons, or modified versions of a Game, part of those things, or anything else we've made.
Otherwise we are quite relaxed about what you do - in fact we really encourage you to do cool stuff - but just don't do those things that we say you can't.
LICENSE
Subject to these terms, Monster Studios gives you a non-exclusive, worldwide, non-transferrable, and revocable license to access, download, install, and run the Rune Seeker on your computer, mobile phone, or game console which it was designed to run on. This license does not grant you any intellectual property rights or ownership rights to the Rune Seeker.
Monster Studios does not endorse the installation and use of Rune Seeker within virtual environments or emulators and you do so at your own risk.
UPDATES AND UPGRADES
Monster Studios will make updates and upgrades to the Rune Seeker from time to time, whether by an update within the Rune Seeker or by a software download (patch). It is your duty to download and apply the updates and/or upgrades to your installation of the Rune Seeker on your device. Monster Studios is not obliged to provide continuous updates or upgrades and you understand that the functionality of Rune Seeker may be interrupted, disrupted or impaired due to the non-application or application of such updates or upgrades.
If you apply any unauthorized patches to your installation of Rune Seeker, you do so at your own risk.
INTELLECTUAL PROPERTY RIGHTS
Monster Studios owns all intellectual property rights in the Rune Seeker Software and the Rune Seeker Assets. You are not permitted to hack, reverse engineer or disassemble Rune Seeker Software without the express written permission of Monster Studios. You agree not to install and use any third party software which manipulates the normal functioning of Rune Seeker.
You agree not to import any assets or software into the Rune Seeker environment which violate the intellectual property rights of any third parties.
You may not redistribute any software, libraries, or assets of third parties which have been licensed to Monster Studios and which are distributed as part of the Rune Seeker Software e.g. through downloads.
Monster Studios reserves the right to work with individual creators to issue customized versions of Rune Seeker (e.g. for a custom game loader client), which would be subject to this EULA.

CONTENT
If you make any content available on or through our Game, you agree to give us permission to use, copy, modify, adapt, distribute, and publicly display that content. This permission is irrevocable, and you also agree to let us permit other people to use, copy, modify, adapt, distribute, and publicly display your content. You are not giving up your ownership rights in your content, you are just giving us and other users permission to use it. For example, we may need to copy, reformat, and distribute content that you post on our website so others can read it. If you don't want to give us these permissions, do not make content available on or through our Game. Please think carefully before you make any content available, because it may be made public and might even be used by other people in a way you don't like.
If you are going to make something available on or through our Game, it must not be offensive to people or illegal, it must be honest, and it must be your own creation. Some examples of the types of things you must not make available using our Game include: posts that include racist or homophobic language; posts that are bullying or trolling; posts that are offensive or that damage our or another person's reputation; posts that include porn or someone else's creation or image; or posts that impersonate a moderator or try to trick or exploit people.
Any content you make available on our Game must also be your creation or you must have permission or the legal right to do it. You must not and you agree that you will not make any content available, using the Game that infringes the rights of others.
We reserve the right to take down any content at our discretion.
Please watch out if you are talking to people in our Game. It is hard for either you or us to know for sure that what people say is true, or even if people are really who they say they are. You should think twice about giving out information about yourself.
IN-GAME PURCHASES
Rune Seeker Software is made available for free to users. Monster Studios offers items for users of the Rune Seeker, as in-game purchases. The sale and purchase of in-game items may be paid for by credit card, debit card.
The prices of certain non-transferable items will be set by Monster Studios. On the other hand, items that can be traded on Rune Seeker's Marketplace will have prices determined by the dynamic nature of the market. It is important to highlight that users have complete discretion and hold full responsibility for their in-game purchases.
BUYING AND SELLING OF IN-GAME ITEMS
In Rune Seeker, users have the option to participate in buying or selling in-game items on the Marketplace. It's important to note that Monster Studios, the game's developer, will not assume responsibility for any purchases made in secondary markets outside of the official Rune Seeker Marketplace.
The pricing of items within the Marketplace is subject to market dynamics, and users have the freedom to decide whether to engage in buying or selling transactions. As a user, you are solely responsible for your own decisions and actions related to buying and selling items on the Marketplace.
Monster Studios retains the right to suspend or halt the sales of in-game items or services on the Marketplace at their sole discretion.
Payment processing for in-game item purchases may be conducted through a payment processor designated by Monster Studios. It's important to understand that Monster Studios may apply processing fees and/or administration fees for facilitating the sale of your items or services.
Furthermore, it is your sole responsibility to comply with any applicable income tax regulations and bear the responsibility for reporting and paying any income tax on the revenue you earn from in-game purchases within Rune Seeker.
COMPLAINTS
Monster Studios takes complaints from users of its Rune Seeker seriously. If a complaint is raised against you by other users, Monster Studios reserves the right to suspend or block your account or otherwise suspend your account privileges until the complaint has been investigated.
Monster Studios reserves the right to freeze, suspend, or block your Avalanche-based account if it contains an NFT which has been the subject matter of a complaint of suspicious dealing e.g. stolen NFT.
UNITY ENGINE
Rune Seeker Software is built on the Unity Engine game engine created by Unity Software Inc., By using Rune Seeker Software, you hereby agree that you will not hold Unity Software Inc. nor Monster Studios responsible for any shortcomings, faults, losses, representations, warranties, conditions and liabilities related to Rune Seeker Software. Rune Seeker Software is alpha software and is prone to error or failure, and Monster box makes no warranty as to the quality and fitness of Rune Seeker Software for any purpose.
AML/KYC
You agree to comply with any AML/KYC procedures set up by Monster Studios to comply with legal regulations and government policies. In other words, you may be required to submit evidence of your identity, and allow the app to capture an image or a video of you using a camera attached to your device.
THIRD PARTY DATA PROCESSORS
Monster Studios works with third-party services that integrate into the Rune Seeker Software to offer a unified and immersive gaming experience. As part of this integration, data related to your activities, including data submitted for KYC/AML compliance, may be shared with the relevant service providers. By choosing to use the Rune Seeker Software, you provide your explicit consent for such data to be transmitted to these service providers in connection with your usage of the Rune Seeker Software. Please be aware that these service providers may operate outside your jurisdiction.
Additionally, it is important to understand that your IP address will be logged, shared, and made accessible to third-party software service providers for the purpose of enabling specific functionalities within the Rune Seeker Software. Your IP address will be logged on Rune Seeker servers and subsequently transmitted to these third parties. By continuing to use the Rune Seeker Software after receiving this notice, you are deemed to have provided your consent for the processing of your IP address for the purpose of using the Rune Seeker Software.
TERMINATION OF LICENSE
Monster Studios maintains the right to terminate your account if you breach any provisions outlined in this EULA or the associated terms and conditions.
Your license to use the Rune Seeker Software will cease automatically upon uninstalling the Rune Seeker Software from your device. However, in the event of a termination of this EULA, you acknowledge and agree that all other provisions, except for the license to use the Rune Seeker Software, will remain in effect. This includes provisions related to the intellectual property rights held by Monster Studios and its business affiliates in relation to the Rune Seeker Software, the Rune Seeker platform, in-game purchases, and customizations.
INDEMNITY
You agree to indemnify, defend, and protect Monster Studios, including its officers, directors, employees, members, shareholders, and affiliates, from any claims, liabilities, costs, damages, or expenses that may arise from your use of the Rune Seeker Software. To the fullest extent permitted by applicable law, you acknowledge that the maximum compensation you may seek from Monster Studios is limited to the amount you have paid to Monster Studios.
DISCLAIMERS
You acknowledge and agree that you are solely responsible for your actions while using the Rune Seeker Software. You understand that Monster Studios does not have real-time monitoring and control over all users, and it is your duty to report to Monster Studios's representatives any user behavior or content within the Rune Seeker Software that you deem illegal, unethical, or unacceptable.
The Rune Seeker Software is provided to you on an "as-is" basis, without any warranties or guarantees regarding your safety or the suitability of the Rune Seeker Software for any particular purpose. You comprehend that the Rune Seeker Software is in its alpha stage and may encounter crashes or may not fully meet certain requirements.
DISPUTE RESOLUTION
If you encounter any problems with the Rune Seeker Software or Monster Studios, or if any issues arise from this EULA, you agree to seek assistance exclusively through Monster Studios's official support channels. You further agree to provide Monster Studios with comprehensive documentation and detailed information regarding the issue, as well as your full cooperation in resolving it.
In the event that the matter cannot be resolved through negotiation or discussions, you agree to submit the dispute to binding arbitration in accordance with Delaware law. Whenever feasible, online arbitration will be utilized. It is important to note that you are responsible for your own legal fees and expenses, as well as the costs associated with engaging the arbitrator.
NON-WAIVER
Failure or neglect by Monster Studios, at any time, to enforce any of the provisions of this EULA, shall not in any manner be construed to be a waiver of Monster Studios’s rights in that regard and in terms of this EULA.
SEVERABILITY
If any provision of this EULA is deemed prohibited or unenforceable in a particular jurisdiction, that provision will be ineffective only within that jurisdiction, without affecting the validity or enforceability of the remaining provisions of this EULA. Furthermore, any such prohibition or unenforceability in one jurisdiction will not invalidate or render unenforceable that provision in any other jurisdiction.
MISCELLANEOUS
Monster Studios reserves the right to update, amend, or redact this EULA from time to time, whether in part or in entirety. It is your responsibility to access the latest version of this EULA and Monster Studios is not obliged to send you a copy of this EULA.
