End-User License Agreement (EULA) for PC Steam Game - GT Manager
Please read this End-User License Agreement ("Agreement") carefully before installing, accessing, or using the PC Steam Game "GT Manager" ("Game") developed by THE TINY DIGITAL FACTORY, located at 59 Rue Denuzière, 69002 LYON, France. This Agreement sets forth the terms and conditions under which you, the end user ("User"), may use the Game.
1. License Grant:
Subject to the terms and conditions of this Agreement, THE TINY DIGITAL FACTORY hereby grants the User a non-exclusive, non-transferable, revocable license to install and use the Game on a personal computer solely for personal, non-commercial purposes.
2. Ownership:
The Game "GT Manager" is licensed, not sold, to the User. THE TINY DIGITAL FACTORY retains all rights, title, and interest in and to the Game, including all intellectual property rights. This Agreement does not grant the User any rights to trademarks, copyrights, or any other proprietary rights of THE TINY DIGITAL FACTORY.
3. Restrictions on Use:
The User agrees not to:
a) Copy, distribute, or reproduce the Game in any form, except as expressly permitted;
b) Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Game;
c) Remove, alter, or obscure any copyright, trademark, or proprietary notices on the Game;
d) Use the Game for any commercial purpose without the prior written consent of THE TINY DIGITAL FACTORY;
e) Use the Game in any manner that violates applicable laws or regulations;
f) Share or transfer User's access credentials or allow unauthorized access to the Game.
4. Updates and Modifications:
THE TINY DIGITAL FACTORY may, at its sole discretion, provide updates, patches, or modifications to the Game. Such updates may be required for continued use of the Game. The User agrees to install any updates or modifications provided by THE TINY DIGITAL FACTORY.
5. Termination:
This Agreement is effective until terminated. THE TINY DIGITAL FACTORY may terminate this Agreement at any time without notice if the User breaches any provisions of this Agreement. Upon termination, the User must immediately cease all use of the Game and delete any copies of the Game in the User's possession.
6. Limitation of Liability:
To the extent permitted by applicable law, in no event shall THE TINY DIGITAL FACTORY be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the Game, even if advised of the possibility of such damages.
7. Indemnification:
The User agrees to indemnify, defend, and hold harmless THE TINY DIGITAL FACTORY, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses arising out of or in connection with the User's use of the Game or any violation of this Agreement.
8. Governing Law and Jurisdiction:
This Agreement shall be governed by and construed in accordance with the laws of France. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of Lyon, France.
9. Entire Agreement:
This Agreement constitutes the entire agreement between the User and THE TINY DIGITAL FACTORY regarding the Game "GT Manager" and supersedes all prior or contemporaneous agreements, representations, or understandings, whether oral or written.
10. Privacy Policy
