Welcome to use the "雪境公园" software (hereinafter referred to as "this software") and services produced by the LASTWISH STUDIO (hereinafter referred to as "LASTWISH STUDIO"). Clause 1:Scope of the Agreement

1.2 Agreement Relationship and Conflict Clauses
Supplementary agreements related to this Agreement or website regulations, etc., are an integral part of this Agreement and constitute a whole with it. If there is any conflict between this Agreement and the above content, this Agreement shall prevail.
The content of this Agreement also includes various agreements, business rules, etc., related to this service that LASTWISH STUDIO may continuously release. Once these contents are formally published, they become an integral part of this Agreement, and you should also abide by them.
Clause 2:Account Registration
2.1 Before using this service, users need to register a "雪境公园" account. The "雪境公园" account should be registered with a mobile phone number binding. Users should use a mobile phone number that has not been bound to a "雪境公园" account and has not been banned by LASTWISH STUDIO according to this Agreement to register a "雪境公园" account. LASTWISH STUDIO can change the method of account registration and binding according to user needs or product requirements without prior notice to users.
2.2 The "雪境公园" is a location-based mobile social activity product. When registering, users should authorize LASTWISH STUDIO to disclose and use their geographical location information to successfully register a "雪境公园" account. Therefore, completing registration means that the user agrees to LASTWISH STUDIO extracting, disclosing, and using the user's geographical location information. If users need to stop disclosing their geographical location information to other users, they can set themselves to invisible mode.
2.3 Considering the binding registration method of the "雪境公园" account, you agree that LASTWISH STUDIO will use your provided mobile phone number and/or automatically extract your mobile phone number and mobile device identification code for registration during registration.
2.4 When users register and use this service, LASTWISH STUDIO needs to collect personal information that can identify the user's identity so that LASTWISH STUDIO can contact the user when necessary or provide a better user experience. The information collected by LASTWISH STUDIO includes but is not limited to the user's name, gender, age, date of birth, ID number, address, school situation, company situation, industry, hobbies, frequent places, personal description; LASTWISH STUDIO agrees that the use of these information will be limited by the third article on the protection of users' personal privacy information.
Clause 3:Service Content
3.1 The specific content of this service is provided by LASTWISH STUDIO according to the actual situation, including but not limited to authorizing users to conduct instant messaging, post updates, chat rooms, and other related services through their accounts. LASTWISH STUDIO can change the services it provides, and the content of the services provided by LASTWISH STUDIO may change at any time; users will receive notifications from LASTWISH STUDIO regarding service changes.
3.2 Forms of Service
(1) You need to download the "雪境公园" client software of LASTWISH STUDIO to use this service. For these software, LASTWISH STUDIO grants you a personal, non-transferable, and non-exclusive license. You may only use these software and services for the purpose of accessing or using this service.
(2) The client software of the "雪境公园" by LASTWISH STUDIO includes but is not limited to multiple application versions such as PC, iOS, Android, etc. Users must choose a software version that matches the installed terminal device.
3.3 Scope of the Service License
(1) LASTWISH STUDIO grants you a personal, non-transferable, and non-exclusive license to use this software. You may install, use, display, and run this software on a single terminal device for non-commercial purposes.
(2) You may copy one copy of this software for the purpose of using this software and services, only for backup purposes. The backup copy must contain all copyright information contained in the original software.
(3) All other rights not expressly authorized by this clause and other clauses of this Agreement are still reserved by LASTWISH STUDIO. You must obtain written permission from LASTWISH STUDIO when exercising these rights. LASTWISH STUDIO's failure to exercise any of the aforementioned rights does not constitute a waiver of those rights.
3.4 The services provided by LASTWISH STUDIO include free services and paid services. For paid services, LASTWISH STUDIO will give users clear prompts before use. Only when the user confirms that they agree to pay the fees according to the aforementioned payment method and completes the payment, can they use such paid services. The completion of the payment action is based on the confirmation notice of "Payment Completed" generated by the bank or third-party payment platform.
Clause 4:Acquisition of Software
4.1 You can obtain this software directly from LASTWISH STUDIO's website or from a third party authorized by LASTWISH STUDIO.
4.2 If you obtain this software or installation program with the same name as this software from a third party not authorized by LASTWISH STUDIO, LASTWISH STUDIO cannot guarantee that the software will work properly and will not be responsible for any losses caused to you.
Clause 5:Installation and Uninstallation of Software
5.1 LASTWISH STUDIO may develop different software versions for different terminal devices. You should choose to download and install the appropriate version according to the actual situation.
5.2 After downloading the installation program, you need to correctly install it according to the steps prompted by the program.
5.3 To provide better and safer services, LASTWISH STUDIO may recommend you to install other software during the installation of this software. You can choose to install or not install.
5.4 If you no longer need to use this software or need to install a new version, you can uninstall it yourself. If you are willing to help LASTWISH STUDIO improve product services, please inform the reason for uninstallation.
Clause 6:Software Update
6.1 To improve user experience and perfect service content, LASTWISH STUDIO will continuously strive to develop new services and provide you with software updates from time to time (these updates may take the form of software replacement, modification, function enhancement, version upgrade, etc.).
6.2 To ensure the security and functional consistency of this software and services, LASTWISH STUDIO has the right to update the software or change or limit some functions of the software without special notice to you.
6.3 After the new version of this software is released, the old version of the software may not be usable. LASTWISH STUDIO does not guarantee the continued availability and corresponding customer service of the old version of the software. Please check and download the latest version at any time.
Clause 7:Protection of User Personal Privacy Information
7.1 In the process of registering an account or using this service, users may need to fill in or submit some necessary information, such as identity information required to be filled in according to laws, regulations, and normative documents (hereinafter referred to as "laws and regulations"). If the information submitted by the user is incomplete or does not comply with the provisions of laws and regulations, the user may not be able to use this service or may be restricted in the process of using this service.
7.2 Personal privacy information refers to information related to user personal identity or personal privacy, such as user's real name, ID number, mobile phone number, mobile device identification code, IP address, user chat records. Non-personal privacy information refers to basic record information that clearly and objectively reflects the user's operational status and usage habits on LASTWISH STUDIO's server side, other common information outside the scope of personal privacy information, and other private information that the user agrees to disclose.
7.3. Protection of Personal Information
Protecting users' personal information is a fundamental principle of LASTWISH STUDIO. We will take reasonable measures to protect the personal information of our users. Except as required by laws and regulations, LASTWISH STUDIO will not disclose or reveal users' personal information to third parties without their permission. LASTWISH STUDIO uses professional encryption for the storage and transmission of relevant information to ensure the security of users' personal information.
7.4. Information Requirements in Service Use
During the registration or use of our service, you may be required to provide certain necessary information. For example, to register an account or identify the user's identity, your mobile phone number is required; the "Nearby People" feature requires your consent to use your geographic location; the phonebook matching feature requires your authorization to access your phonebook. If national laws, regulations, or policies have special requirements, you must provide real identity information. Incomplete information may prevent you from using our service or restrict your usage.
7.5. Information Modification
Generally, you can browse and modify the information you have submitted at any time. However, for security and identification reasons (such as number appeal service), you may not be able to modify the initial registration information and other verification information provided at the time of registration.
7.6. Information Security Measures
LASTWISH STUDIO will use various security technologies and procedures to establish a comprehensive management system to protect your personal information from unauthorized access, use, or disclosure.
7.7. Non-Disclosure Without Consent
Without your consent, LASTWISH STUDIO will not disclose your personal information to any company, organization, or individual outside of LASTWISH STUDIO, except as otherwise provided by laws and regulations.
7.8. Protection of Minors' Information

Clause 8:Content Standards
The content referred to in this section includes any content created, uploaded, copied, published, or disseminated by users during the use of this service. This includes, but is not limited to, account avatars, names, user descriptions, registration information, authentication materials, as well as texts, voices, images, videos, graphics, sent/replied or auto-replied messages, and related link pages, along with other content generated using the account or this service.
Users must not use the "Hospital Movie Viewing!" account or this service to create, upload, copy, publish, or disseminate content prohibited by law, regulations, and policies, such as:
Content that opposes the basic principles established by the constitution;
Content that endangers national security, discloses state secrets, subverts state power, or undermines national unity;
Content that damages the honor and interests of the state;
Content that incites ethnic hatred or discrimination, or undermines ethnic unity;
Content that destroys national religious policies, promotes cults, and feudal superstitions;
Content that spreads rumors, disrupts social order, or undermines social stability;
Content that spreads obscenity, pornography, gambling, violence, murder, terror, or incites crime;
Content that insults or defames others, infringing on their legal rights;
Content that does not comply with the "seven bottom lines" requirements, including the baseline of laws and regulations, socialist system, national interests, citizens' lawful rights, public social order, moral norms, and information authenticity;
Information containing other content prohibited by laws and administrative regulations.
Users must not use the "Hospital Movie Viewing!" account or this service to create, upload, copy, publish, or disseminate content that interferes with the normal operation of "Hospital Movie Viewing!" and infringes on the legal rights of other users or third parties, such as:
Content that contains any sexual or sexually suggestive elements;
Content that includes abuse, intimidation, or threats;
Content that contains harassment, spam advertising, malicious information, or misleading information;
Content that involves others' privacy, personal information, or data;
Content that infringes on others' rights to reputation, portrait rights, intellectual property, trade secrets, etc.;
Content that contains other information that interferes with the normal operation of the service and infringes on the legal rights of other users or third parties.
Clause 9: Terms of Use
Any content transmitted or posted by users in this service does not reflect or represent, and should not be considered as reflecting or representing the views, positions, or policies of the LASTWISH STUDIO, and LASTWISH STUDIO assumes no responsibility for such content.
Users shall not engage in the following activities using the "雪境公园" account or this service:
(1) Submit or publish false information, or use someone else's avatar or information, impersonating or using someone else's identity;
(2) Force or induce other users to follow, click on links, or share information;
(3) Fabricate facts, conceal the truth to mislead or deceive others;
(4) Use technical means to create fake accounts in bulk;
(5) Engage in any illegal activities using the "雪境公园" account or this service;
(6) Develop, publish methods, tools related to the above behaviors or operate and disseminate such methods or tools, whether for commercial purposes or not;
(7) Other acts that violate laws and regulations, infringe on the legitimate rights of other users, interfere with the normal operation of "雪境公园" or are not explicitly authorized by the LASTWISH STUDIO.
Users are responsible for the authenticity, legality, harmlessness, accuracy, and effectiveness of the information transmitted using the "雪境公园" account or this service. Any legal liability related to the information spread by users is the user's responsibility, unrelated to the LASTWISH STUDIO. In case of harm to the LASTWISH STUDIO or third parties, the user shall compensate according to the law.
The services provided by the LASTWISH STUDIO may include advertisements, and users agree to display advertisements from the LASTWISH STUDIO and third-party suppliers, partners during the use of the service. Except as expressly provided by laws and regulations, users are responsible for transactions based on such advertisement information. The LASTWISH STUDIO is not liable for any losses or damages incurred by users due to transactions or content provided by such advertisers.
You fully understand and agree that you are responsible for all actions taken under your registered account, including any content you post and any consequences that may arise. You must independently judge the content in this service and bear all risks arising from the use of the content, including the risk of relying on the correctness, completeness, or practicality of the content. The LASTWISH STUDIO cannot and will not be responsible for any losses or damages caused by the aforementioned risks.
Clause 10:Breach Handling
(1) If the LASTWISH STUDIO discovers or receives reports or complaints from others about users violating the terms of this agreement, the LASTWISH STUDIO has the right to delete or block relevant content at any time without notice and may, depending on the severity of the violation, impose penalties on the violating account, including but not limited to warnings, restrictions, or prohibitions on using some or all functions, account suspension, or cancellation, and publicly announce the results.
(2) You understand and agree that the LASTWISH STUDIO has the right to reasonably judge and penalize behaviors that violate relevant laws, regulations, or the provisions of this agreement. For any illegal user, the LASTWISH STUDIO may take appropriate legal action and report relevant information to the competent authorities according to laws and regulations, and the user shall bear all legal liabilities arising therefrom independently.
(3) You understand and agree that if you violate this agreement or the relevant service terms, causing any third party to claim, request, or suffer losses, you shall be solely responsible. If the LASTWISH STUDIO suffers losses as a result, you shall also compensate.
Clause 11: Account Management
The ownership of the "雪境公园" account belongs to the LASTWISH STUDIO. After the user completes the application and registration procedures, they obtain the right to use the "雪境公园" account. This right belongs only to the initial applicant and is prohibited from being gifted, borrowed, rented, transferred, or sold. The LASTWISH STUDIO, for operational needs, has the right to recover the user's "雪境公园" account.
Users can change or delete personal information, registration information, and transmitted content on the "雪境公园" account. However, it should be noted that deleting relevant information will also delete the text and images stored by the user in the system. Users bear this risk.
Users are responsible for properly safeguarding the security of registered account information and account passwords. Users may be held responsible for the consequences of inadequate protection, leading to account theft or password loss. Users need to bear legal responsibility for the actions under the registered account and password. Users agree to immediately notify the LASTWISH STUDIO when they suspect that others are using their account or password.
Users must comply with the terms of this agreement and use this service correctly and appropriately. If a user violates any terms of this agreement, the LASTWISH STUDIO has the right to interrupt or terminate the provision of services for the violating user's "雪境公园" account after notifying the user. At the same time, the LASTWISH STUDIO reserves the right to revoke the "雪境公园" account or username at any time.
If a user does not log in to the "雪境公园" account for one year after registration, the LASTWISH STUDIO may, after notifying the user, revoke the account to prevent resource wastage. The user is responsible for any adverse consequences arising from this.
Clause 12: Intellectual Property Statement
The LASTWISH STUDIO is the intellectual property rights holder of this software. All copyrights, trademark rights, patent rights, trade secrets, and other intellectual property rights of this software, as well as all information content related to this software (including but not limited to text, images, audio, video, graphics, interface design, layout framework, relevant data, or electronic documents, etc.), are protected by the laws and regulations of the People's Republic of China and the relevant international treaties. The LASTWISH STUDIO enjoys the aforementioned intellectual property rights, excluding the rights that the relevant right holders should enjoy according to the law.
Without the prior written consent of the LASTWISH STUDIO or the relevant right holder, you may not, for any commercial or non-commercial purposes, implement, use, transfer the aforementioned intellectual property rights.
Clause 13: Force Majeure and Other Disclaimers
Users understand and confirm that during the use of this service, there may be risks such as force majeure that could lead to the interruption of this service. Force majeure refers to objective events that cannot be foreseen, overcome, and avoided, and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, pandemics, and storms, as well as social events such as war, riots, and government actions. In the event of the above situations, the LASTWISH STUDIO will make efforts to cooperate with relevant units for timely repairs, but the LASTWISH STUDIO and cooperative units are not responsible for any losses incurred to users or third parties within the scope permitted by law.
Similar to most Internet services, this service may be affected by various security issues such as user reasons, network service quality, and social environment, etc., and may be subject to various security risks, such as others using user data to cause real-life harassment; downloading and installing other software or visiting other websites that contain "Trojan horses" and other viruses, threatening the security of user computer information and data, and affecting the normal use of this service. Users should enhance their awareness of information security and user data protection, pay attention to strengthening password protection to prevent losses and harassment.
Users understand and confirm that there are risks of service interruption or failure to meet user requirements due to factors such as force majeure, computer viruses, hacker attacks, system instability, user location, user shutdown, and other technical, Internet network, communication line reasons, etc., during the use of this service. Therefore, the LASTWISH STUDIO is not liable for any losses incurred by users or third parties.
Users understand and confirm that there may be misleading, deceptive, threatening, defamatory, offensive, or illegal information from any other person during the use of this service, or anonymous or pseudonymous information that infringes on the rights of others, and accompanying behaviors. The LASTWISH STUDIO is not responsible for any losses incurred as a result.
Users understand and confirm that the LASTWISH STUDIO needs to regularly or irregularly inspect or maintain the "雪境公园" platform or related equipment. In the event of service interruption within a reasonable time due to such situations, the LASTWISH STUDIO is not responsible, but the LASTWISH STUDIO shall provide prior notice.
The LASTWISH STUDIO, according to laws and regulations and the provisions of this agreement, has the right to handle illegal or violating content. This right does not constitute an obligation or commitment of the LASTWISH STUDIO, and the LASTWISH STUDIO cannot guarantee the timely discovery or handling of illegal or violating behavior.
Users understand and confirm that the LASTWISH STUDIO is not responsible for any quality defects of the following products or services provided to users:
(1) Services provided free of charge by the LASTWISH STUDIO to users;
(2) Any products or services given to users by the LASTWISH STUDIO.
Under any circumstances, the LASTWISH STUDIO is not liable for any indirect, consequential, punitive, incidental, special, or punitive damages, including profit losses suffered by users due to their use of "雪境公园" or this service (even if the LASTWISH STUDIO has been advised of the possibility of such losses). The LASTWISH STUDIO solemnly reminds users to pay attention to the terms of this agreement that exempt the LASTWISH STUDIO from liability and limit user rights. Users are advised to read carefully and consider the risks. Minors should read this agreement under the accompaniment of their legal guardians.
The effectiveness, interpretation, and resolution of disputes of this agreement apply to the laws of the People's Republic of China. If there is any dispute or controversy between the user and the LASTWISH STUDIO, they should first negotiate and resolve it amicably. If negotiations fail, the user agrees to submit the dispute or controversy to the people's court with jurisdiction over the LASTWISH STUDIO's domicile.
If any term of this agreement is invalid or unenforceable for any reason, the remaining terms remain valid and enforceable.

(2) The client software of the "雪境公园" by LASTWISH STUDIO includes but is not limited to multiple application versions such as PC, iOS, Android, etc. Users must choose a software version that matches the installed terminal device.
3.3 Scope of the Service License
(1) LASTWISH STUDIO grants you a personal, non-transferable, and non-exclusive license to use this software. You may install, use, display, and run this software on a single terminal device for non-commercial purposes.
(2) You may copy one copy of this software for the purpose of using this software and services, only for backup purposes. The backup copy must contain all copyright information contained in the original software.
(3) All other rights not expressly authorized by this clause and other clauses of this Agreement are still reserved by LASTWISH STUDIO. You must obtain written permission from LASTWISH STUDIO when exercising these rights. LASTWISH STUDIO's failure to exercise any of the aforementioned rights does not constitute a waiver of those rights.
3.4 The services provided by LASTWISH STUDIO include free services and paid services. For paid services, LASTWISH STUDIO will give users clear prompts before use. Only when the user confirms that they agree to pay the fees according to the aforementioned payment method and completes the payment, can they use such paid services. The completion of the payment action is based on the confirmation notice of "Payment Completed" generated by the bank or third-party payment platform.
Clause 4:Acquisition of Software
4.1 You can obtain this software directly from LASTWISH STUDIO's website or from a third party authorized by LASTWISH STUDIO.
4.2 If you obtain this software or installation program with the same name as this software from a third party not authorized by LASTWISH STUDIO, LASTWISH STUDIO cannot guarantee that the software will work properly and will not be responsible for any losses caused to you.
Clause 5:Installation and Uninstallation of Software
5.1 LASTWISH STUDIO may develop different software versions for different terminal devices. You should choose to download and install the appropriate version according to the actual situation.
5.2 After downloading the installation program, you need to correctly install it according to the steps prompted by the program.
5.3 To provide better and safer services, LASTWISH STUDIO may recommend you to install other software during the installation of this software. You can choose to install or not install.
5.4 If you no longer need to use this software or need to install a new version, you can uninstall it yourself. If you are willing to help LASTWISH STUDIO improve product services, please inform the reason for uninstallation.
Clause 6:Software Update
6.1 To improve user experience and perfect service content, LASTWISH STUDIO will continuously strive to develop new services and provide you with software updates from time to time (these updates may take the form of software replacement, modification, function enhancement, version upgrade, etc.).
6.2 To ensure the security and functional consistency of this software and services, LASTWISH STUDIO has the right to update the software or change or limit some functions of the software without special notice to you.
6.3 After the new version of this software is released, the old version of the software may not be usable. LASTWISH STUDIO does not guarantee the continued availability and corresponding customer service of the old version of the software. Please check and download the latest version at any time.
Clause 7:Protection of User Personal Privacy Information
7.1 In the process of registering an account or using this service, users may need to fill in or submit some necessary information, such as identity information required to be filled in according to laws, regulations, and normative documents (hereinafter referred to as "laws and regulations"). If the information submitted by the user is incomplete or does not comply with the provisions of laws and regulations, the user may not be able to use this service or may be restricted in the process of using this service.
7.2 Personal privacy information refers to information related to user personal identity or personal privacy, such as user's real name, ID number, mobile phone number, mobile device identification code, IP address, user chat records. Non-personal privacy information refers to basic record information that clearly and objectively reflects the user's operational status and usage habits on LASTWISH STUDIO's server side, other common information outside the scope of personal privacy information, and other private information that the user agrees to disclose.

LASTWISH STUDIO will use various security technologies and procedures to establish a comprehensive management system to protect your personal information from unauthorized access, use, or disclosure.
7.7. Non-Disclosure Without Consent
Without your consent, LASTWISH STUDIO will not disclose your personal information to any company, organization, or individual outside of LASTWISH STUDIO, except as otherwise provided by laws and regulations.
7.8. Protection of Minors' Information
LASTWISH STUDIO attaches great importance to the protection of minors' personal information. If you are a minor under 18 years old, you must obtain written consent from your parents or legal guardians before using LASTWISH STUDIO's services.
7.9. Collection and Use of Non-Personal Information
To improve LASTWISH STUDIO's technology and services and to provide a better service experience to users, LASTWISH STUDIO may collect and use or provide to third parties non-personal privacy information of users.
Clause 8:Content Standards
The content referred to in this section includes any content created, uploaded, copied, published, or disseminated by users during the use of this service. This includes, but is not limited to, account avatars, names, user descriptions, registration information, authentication materials, as well as texts, voices, images, videos, graphics, sent/replied or auto-replied messages, and related link pages, along with other content generated using the account or this service.
Users must not use the "Hospital Movie Viewing!" account or this service to create, upload, copy, publish, or disseminate content prohibited by law, regulations, and policies, such as:
Content that opposes the basic principles established by the constitution;
Content that endangers national security, discloses state secrets, subverts state power, or undermines national unity;
Content that damages the honor and interests of the state;
Content that incites ethnic hatred or discrimination, or undermines ethnic unity;
Content that destroys national religious policies, promotes cults, and feudal superstitions;
Content that spreads rumors, disrupts social order, or undermines social stability;
Content that spreads obscenity, pornography, gambling, violence, murder, terror, or incites crime;
Content that insults or defames others, infringing on their legal rights;
Content that does not comply with the "seven bottom lines" requirements, including the baseline of laws and regulations, socialist system, national interests, citizens' lawful rights, public social order, moral norms, and information authenticity;
Information containing other content prohibited by laws and administrative regulations.
Users must not use the "Hospital Movie Viewing!" account or this service to create, upload, copy, publish, or disseminate content that interferes with the normal operation of "Hospital Movie Viewing!" and infringes on the legal rights of other users or third parties, such as:
Content that contains any sexual or sexually suggestive elements;
Content that includes abuse, intimidation, or threats;
Content that contains harassment, spam advertising, malicious information, or misleading information;
Content that involves others' privacy, personal information, or data;
Content that infringes on others' rights to reputation, portrait rights, intellectual property, trade secrets, etc.;
Content that contains other information that interferes with the normal operation of the service and infringes on the legal rights of other users or third parties.
Clause 9: Terms of Use
Any content transmitted or posted by users in this service does not reflect or represent, and should not be considered as reflecting or representing the views, positions, or policies of the LASTWISH STUDIO, and LASTWISH STUDIO assumes no responsibility for such content.
Users shall not engage in the following activities using the "雪境公园" account or this service:
(1) Submit or publish false information, or use someone else's avatar or information, impersonating or using someone else's identity;
(2) Force or induce other users to follow, click on links, or share information;
(3) Fabricate facts, conceal the truth to mislead or deceive others;
(4) Use technical means to create fake accounts in bulk;
(5) Engage in any illegal activities using the "雪境公园" account or this service;
(6) Develop, publish methods, tools related to the above behaviors or operate and disseminate such methods or tools, whether for commercial purposes or not;
(7) Other acts that violate laws and regulations, infringe on the legitimate rights of other users, interfere with the normal operation of "雪境公园" or are not explicitly authorized by the LASTWISH STUDIO.
Users are responsible for the authenticity, legality, harmlessness, accuracy, and effectiveness of the information transmitted using the "雪境公园" account or this service. Any legal liability related to the information spread by users is the user's responsibility, unrelated to the LASTWISH STUDIO. In case of harm to the LASTWISH STUDIO or third parties, the user shall compensate according to the law.
The services provided by the LASTWISH STUDIO may include advertisements, and users agree to display advertisements from the LASTWISH STUDIO and third-party suppliers, partners during the use of the service. Except as expressly provided by laws and regulations, users are responsible for transactions based on such advertisement information. The LASTWISH STUDIO is not liable for any losses or damages incurred by users due to transactions or content provided by such advertisers.
You fully understand and agree that you are responsible for all actions taken under your registered account, including any content you post and any consequences that may arise. You must independently judge the content in this service and bear all risks arising from the use of the content, including the risk of relying on the correctness, completeness, or practicality of the content. The LASTWISH STUDIO cannot and will not be responsible for any losses or damages caused by the aforementioned risks.
Clause 10:Breach Handling
(1) If the LASTWISH STUDIO discovers or receives reports or complaints from others about users violating the terms of this agreement, the LASTWISH STUDIO has the right to delete or block relevant content at any time without notice and may, depending on the severity of the violation, impose penalties on the violating account, including but not limited to warnings, restrictions, or prohibitions on using some or all functions, account suspension, or cancellation, and publicly announce the results.
(2) You understand and agree that the LASTWISH STUDIO has the right to reasonably judge and penalize behaviors that violate relevant laws, regulations, or the provisions of this agreement. For any illegal user, the LASTWISH STUDIO may take appropriate legal action and report relevant information to the competent authorities according to laws and regulations, and the user shall bear all legal liabilities arising therefrom independently.
(3) You understand and agree that if you violate this agreement or the relevant service terms, causing any third party to claim, request, or suffer losses, you shall be solely responsible. If the LASTWISH STUDIO suffers losses as a result, you shall also compensate.
Clause 11: Account Management
The ownership of the "雪境公园" account belongs to the LASTWISH STUDIO. After the user completes the application and registration procedures, they obtain the right to use the "雪境公园" account. This right belongs only to the initial applicant and is prohibited from being gifted, borrowed, rented, transferred, or sold. The LASTWISH STUDIO, for operational needs, has the right to recover the user's "雪境公园" account.
Users can change or delete personal information, registration information, and transmitted content on the "雪境公园" account. However, it should be noted that deleting relevant information will also delete the text and images stored by the user in the system. Users bear this risk.
Users are responsible for properly safeguarding the security of registered account information and account passwords. Users may be held responsible for the consequences of inadequate protection, leading to account theft or password loss. Users need to bear legal responsibility for the actions under the registered account and password. Users agree to immediately notify the LASTWISH STUDIO when they suspect that others are using their account or password.
Users must comply with the terms of this agreement and use this service correctly and appropriately. If a user violates any terms of this agreement, the LASTWISH STUDIO has the right to interrupt or terminate the provision of services for the violating user's "雪境公园" account after notifying the user. At the same time, the LASTWISH STUDIO reserves the right to revoke the "雪境公园" account or username at any time.
If a user does not log in to the "雪境公园" account for one year after registration, the LASTWISH STUDIO may, after notifying the user, revoke the account to prevent resource wastage. The user is responsible for any adverse consequences arising from this.
Clause 12: Intellectual Property Statement
The LASTWISH STUDIO is the intellectual property rights holder of this software. All copyrights, trademark rights, patent rights, trade secrets, and other intellectual property rights of this software, as well as all information content related to this software (including but not limited to text, images, audio, video, graphics, interface design, layout framework, relevant data, or electronic documents, etc.), are protected by the laws and regulations of the People's Republic of China and the relevant international treaties. The LASTWISH STUDIO enjoys the aforementioned intellectual property rights, excluding the rights that the relevant right holders should enjoy according to the law.
Without the prior written consent of the LASTWISH STUDIO or the relevant right holder, you may not, for any commercial or non-commercial purposes, implement, use, transfer the aforementioned intellectual property rights.
Clause 13: Force Majeure and Other Disclaimers
Users understand and confirm that during the use of this service, there may be risks such as force majeure that could lead to the interruption of this service. Force majeure refers to objective events that cannot be foreseen, overcome, and avoided, and have a significant impact on one or both parties, including but not limited to natural disasters such as floods, earthquakes, pandemics, and storms, as well as social events such as war, riots, and government actions. In the event of the above situations, the LASTWISH STUDIO will make efforts to cooperate with relevant units for timely repairs, but the LASTWISH STUDIO and cooperative units are not responsible for any losses incurred to users or third parties within the scope permitted by law.
Similar to most Internet services, this service may be affected by various security issues such as user reasons, network service quality, and social environment, etc., and may be subject to various security risks, such as others using user data to cause real-life harassment; downloading and installing other software or visiting other websites that contain "Trojan horses" and other viruses, threatening the security of user computer information and data, and affecting the normal use of this service. Users should enhance their awareness of information security and user data protection, pay attention to strengthening password protection to prevent losses and harassment.
Users understand and confirm that there are risks of service interruption or failure to meet user requirements due to factors such as force majeure, computer viruses, hacker attacks, system instability, user location, user shutdown, and other technical, Internet network, communication line reasons, etc., during the use of this service. Therefore, the LASTWISH STUDIO is not liable for any losses incurred by users or third parties.
Users understand and confirm that there may be misleading, deceptive, threatening, defamatory, offensive, or illegal information from any other person during the use of this service, or anonymous or pseudonymous information that infringes on the rights of others, and accompanying behaviors. The LASTWISH STUDIO is not responsible for any losses incurred as a result.
Users understand and confirm that the LASTWISH STUDIO needs to regularly or irregularly inspect or maintain the "雪境公园" platform or related equipment. In the event of service interruption within a reasonable time due to such situations, the LASTWISH STUDIO is not responsible, but the LASTWISH STUDIO shall provide prior notice.
The LASTWISH STUDIO, according to laws and regulations and the provisions of this agreement, has the right to handle illegal or violating content. This right does not constitute an obligation or commitment of the LASTWISH STUDIO, and the LASTWISH STUDIO cannot guarantee the timely discovery or handling of illegal or violating behavior.
Users understand and confirm that the LASTWISH STUDIO is not responsible for any quality defects of the following products or services provided to users:
(1) Services provided free of charge by the LASTWISH STUDIO to users;
(2) Any products or services given to users by the LASTWISH STUDIO.
Under any circumstances, the LASTWISH STUDIO is not liable for any indirect, consequential, punitive, incidental, special, or punitive damages, including profit losses suffered by users due to their use of "雪境公园" or this service (even if the LASTWISH STUDIO has been advised of the possibility of such losses). Despite possible conflicting provisions in this agreement, the LASTWISH STUDIO's total liability to users, regardless of the reason or method of action, shall not exceed the fees paid by users to the LASTWISH STUDIO for using the services provided by the LASTWISH STUDIO.
Clause 14: Changes, Interruptions, and Termination of Services
Due to the special nature of online services, users agree that the LASTWISH STUDIO has the right to change, interrupt, or terminate part or all of the services (including fee-based services) at any time. The LASTWISH STUDIO shall notify users before changing, interrupting, or terminating services and provide equivalent alternative services to affected users.
In the event of any of the following circumstances, the LASTWISH STUDIO has the right to change, interrupt, or terminate the free or paid services provided to users without any liability to the user or any third party:
(1) Users are required by law to submit true information, and the user provides false information or fails to provide reasonable proof that it is inconsistent with the information provided during registration;
(2) Users violate relevant laws, regulations, or the provisions of this agreement;
(3) According to legal requirements or requests from competent authorities;
(4) For security reasons or other necessary circumstances.
Clause 15: Miscellaneous
The LASTWISH STUDIO solemnly reminds users to pay attention to the terms of this agreement that exempt the LASTWISH STUDIO from liability and limit user rights. Users are advised to read carefully and consider the risks. Minors should read this agreement under the accompaniment of their legal guardians.
The effectiveness, interpretation, and resolution of disputes of this agreement apply to the laws of the People's Republic of China. If there is any dispute or controversy between the user and the LASTWISH STUDIO, they should first negotiate and resolve it amicably. If negotiations fail, the user agrees to submit the dispute or controversy to the people's court with jurisdiction over the LASTWISH STUDIO's domicile.
If any term of this agreement is invalid or unenforceable for any reason, the remaining terms remain valid and enforceable.
