End User License Agreement (hereinafter referred to as the "Personal Use License" or "Agreement")
Personal Use License Version: 1.0
Product subject of this contract: Saddle Up and Drive (hereinafter referred to as "Game")
Owner of the Game: Tengatsoft by Sergio Tengattini, Mapello (BG) – Italy (hereinafter referred to as "Tengatsoft")
End User: the person who purchases the license to use the Game (hereinafter referred to as "end user" or “user” or “you”)
Contract Parties:
A) Tengatsoft
B) End user
The end user declares to understand the language in which this contract was drawn up.
The end user declares to be of legal age and to be able to enter into legally binding contracts.
The end user declares to be aware that the use of the Game is intended exclusively for persons of legal age with the ability to understand and want and that the use by minors or persons with diminished responsibility is expressly prohibited by this contract.
The end user expressly agree that doesn’t allow the use of the Game to minors or persons with diminished responsibility.
Before purchasing the license for personal use and installing this Game, the end user must read and accept this agreement in its entirety.
This Game, by paying a sum of money, is licensed for personal use, subject to the terms of this agreement. The Game is not sold and remains in the exclusive property of Tengatsoft.
The installation, copying or use of this Game constitutes the full acceptance by the end user of this agreement. If you decline this agreement, you may not install, copy, or use the Game. In the event that the end user is not satisfied with the Game and one or more of its contents, the end user will have the only option to stop using it and proceed to uninstall it from their personal device.
Subject to applicable law, you agree to waive any claim for reimbursement if you are not satisfied with the Game in any way.
1) License of personal use
Tengatsoft grants you one (1) license for limited personal use of the Game. It is expressly forbidden to duplicate, copy, reproduce in any form the Game and all its contents, including images, videos, graphic resources of any kind, music, audio tracks, logos, trademarks, storyboards, software code, title, texts, dialogues.
This license does not grant any ownership rights to the end user.
2) No ownership rights
The end user acknowledges and agrees not to take possession of ownership of the Game, that ownership remains solely of Tengatsoft. By purchasing, the end user acquires only a license for personal use, as specified in point 1) of this agreement.
Tengatsoft does not recognize the transfer of the Game, the end user has no right to carry out any commercial or distribution operation, even free of charge, in relation to the Game such as, by way of example and not limited to, selling, licensing, bartering, exchanging, distributing, publishing the Game.
The end user acknowledges that the violation of points 1 and 2 of this contract constitutes economic damage to Tengatsoft and gives Tengatsoft the right to take legal action in order to obtain fair compensation. All rights reserved.
3) Terms of the Personal Use License
You agree to use the Game without violating any provision of this Personal Use License.
The end user is not authorized to:
a) Use the Game for commercial purposes, derive profits of any kind from the use of the Game without written permission from Tengatsoft.
b) Install the Game on multiple computer devices, this license for personal use is limited to installation on one (1) computer device only. A computer device is any tool designed to execute the code of the Game, such as, by way of example: computers, game consoles, portable devices, smartphones.
c) Sell, rent, distribute or transfer the Game.
d) Make changes of any kind to the Game, such as, but not limited to: decompilation, derivation of source code, decryption, removal or modification of protection systems, removal or modification of proprietary notices, removal or modification of logos and trademarks, injection of external code of any nature.
e) Export the Game software in any form.
f) Develop software that imitates the Game graphic content, audio content, storyboard, logos and trademarks.
g) Create or use any software that is able to interact, connect in any way, expand or reduce features, transfer to platforms other than those provided by Tengatsoft at the time of acceptance of this agreement, modify in any way the Game.
h) Use the contents of the Game, such as graphics assets, audio tracks, logos and trademarks to create material that is illegal, defamatory, obscene, libelous, violates copyright, violates the privacy rights of third parties.
In violation of one or more of the points listed above, the end user expressly agrees to assume full responsibility for any claims for damages by third parties.
In violation of one or more of the points listed above, the end user expressly agrees to indemnify Tengatsoft for any economic or image harm caused to Tengatsoft and / or third parties connected to Tengatsoft.
4) Limited liability
The end user expressly acknowledges and agrees that the use of the Game is at his own risk and discretion, therefore any damages resulting from the use, download and installation of the Game, such as, but not limited to, malfunction, deletion, error, loss of data, interruption, failures of any nature, is the full responsibility of the end user and exempts Tengatsoft from any claim for compensation.
The Game is provided "as is", there is no warranty by Tengatsoft regarding the possible presence of defects of any nature.
Tengatsoft does not guarantee that:
a) The Game will be deemed satisfactory to any extent by the end user
b) The Game is not in any way offensive or harms the sensitivity or religious sentiment of the end user
c) The Game does not contain themes or materials of any kind that may be detrimental to the sensitivity or morals of the end user
d) The Game will be free from errors, defects or software bugs of any nature
e) The Game will run satisfactorily on the end user's own device
f) The Game is compatible or interoperable with other software
The Game may be obsolete for the end user's device or may be obsolete in the future. Tengatsoft does not undertake to update the Game.
The end user acknowledges and agrees that he will have as his sole remedy to any dispute with Tengatsoft the interruption of the use of the Game and that in no case any liability of Tengatsoft will exceed the amount paid by the end user to Tengatsoft or to resellers authorized by Tengatsoft.
In no event shall Tengatsoft be liable for any damages resulting from the use of the Game to the end user or third parties.
You agree that the Game may be subject to sudden interruptions or unexpected malfunctions, and that they are to be considered as normal events that do not entitle you to any type of claim.
If applicable law does not allow the exclusion or limitation of liability provided for in this agreement, Tengatsoft's liability will be limited to the maximum extent permitted by law.
5) Indemnification in favor of Tengatsoft or third parties
You agree to defend, indemnify and hold Tengatsoft harmless from all liabilities, claims, losses, costs or expenses, including attorneys' fees arising out of your use of the Game, your breach of this agreement, your copyright infringement, and your disclosure of any content of the Game.
The end user warrants, to the extent of his possibilities, to protect the Licensed Gaming for personal use from theft, tampering and illicit use by third parties.
If negligent behavior causes harm to Tengatsoft or any third party, including minors who are expressly prohibited from using the Game, you agree to indemnify the injured party at your own expense, including any attorneys' fees.
6) International use
The Game may be accessible worldwide. Tengatsoft does not warrant in any way that the contents of the Game will be considered legal in the country in which the end user resides or uses the Game. The purchase, installation or use of the Game in countries where the contents of the Game are illegal is strictly prohibited.
The end user who carries out such actions in violation of the laws in force in his country, or in the country in which he resides, or in any case in the country in which he uses the Game, is personally responsible for them and indemnifies Tengatsoft from any liability.
You expressly represent under your civil and criminal liability that you may purchase, install and use the Game without violating any law of the country in which you reside or otherwise in the country in which you intend to use the Game.
You expressly declare under your civil and criminal liability that you are not located or reside in, and that you do not export the Game to countries embargoed by the United States of America or the European Union.
The end user agrees to indemnify Tengatsoft for any damage caused to it by an illegal use by the end user of the Game.

7) Termination of the contract
This agreement is effective as soon as you become licensed for your personal use of the Game and you fully accept it.
You may terminate this agreement by discontinuing your use of the Game and deleting all copies in your possession and all material related to the Game.
Your breach of any provision of this Agreement shall terminate this Agreement and you must stop the use of the Game and delete all copies owned by you and all materials related to the Game.
Tengatsoft may terminate this agreement at its discretion at any time and request that the end user delete the Game from its devices.
The clauses in points 2, 3, 4, 5, 6, 8 and 9 survive the termination of this contract.
8) Violations of the license of personal use
The end user acknowledges that the violation of any point of this contract may constitute an economic damage for Tengatsoft.
The end user agrees to indemnify Tengatsoft for any damage caused to the same as a result of the violation of this contract.
9) Legal disputes
You agree to waive any legal action against Tengatsoft for any dispute related to the Game.
Any complaints can be sent to the email address sgriusoft@gmail.com. These communications must be expressed in Italian or English language.
10) Collection of data by the Game
The end user declares to be informed that the Game may collect data relating to the device on which it is installed and that this data may be used or transmitted for the purpose of enabling the proper functioning of the Game or for statistic purposes.
11) Language and versions of the contract
This contract is written in Italian, the English version is a copy.
The end user understands and accepts that the English language version may contain translation errors and that the original legally valid and binding version is the one written in Italian.
The parties agree that all correspondence relating to this contract will be written in Italian or English.
This contract will be interpreted according to the laws in force in Italy, and the user consents to the exclusive jurisdiction of the Italian courts.
12) Miscellaneous provisions
This agreement cancels and replaces any previous agreements between Tengatsoft and the end user.
This agreement is subject to change by Tengatsoft without notice, the use of the Game is subject to the acceptance of the latest available version of this agreement.
To obtain the latest available version of the personal use license, write an email in Italian or English to sgriusoft@gmail.com.
The unenforceability of any clause or part of it of this contract in relation to the law in force is not a cause of nullity, in which case this clause will be replaced by another applicable clause that comes as close as possible to the intent of the original one.
Tengatsoft and the end user undertake to fulfill this contract, except in cases of force majeure or impossibility.
The end user declares to have read and understood this license of personal use and declares to accept it in full, without exception or omission.

7) Termination of the contract

The clauses in points 2, 3, 4, 5, 6, 8 and 9 survive the termination of this contract.
8) Violations of the license of personal use
The end user acknowledges that the violation of any point of this contract may constitute an economic damage for Tengatsoft.
The end user agrees to indemnify Tengatsoft for any damage caused to the same as a result of the violation of this contract.
9) Legal disputes
You agree to waive any legal action against Tengatsoft for any dispute related to the Game.
Any complaints can be sent to the email address sgriusoft@gmail.com. These communications must be expressed in Italian or English language.
10) Collection of data by the Game
