END USER LICENSE AGREEMENT (EULA) FOR TOWER OF PANDEMONIUM
IMPORTANT - READ CAREFULLY: This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Freddy Guerra ("Licensor") for the video game software entitled "Tower of Pandemonium" ("Software"). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software.
LICENSE GRANT. Licensor grants you a non-exclusive, non-transferable, limited license to use the Software for your personal, non-commercial use only. You may not use the Software for any other purpose without the prior written consent of Licensor.
INTELLECTUAL PROPERTY. The Software, including all characters, dialogues, quests, items, and concepts contained therein, is the intellectual property of Licensor and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All rights not expressly granted herein are reserved by Licensor.
RESTRICTIONS. You may not copy, modify, distribute, sell, transfer, rent, lease, or sublicense the Software or any portion thereof. You may not reverse engineer, decompile, or disassemble the Software, except to the extent that such activity is expressly permitted by applicable law. You may not remove or alter any copyright, trademark, or other proprietary notices from the Software or any portion thereof.
WARRANTY DISCLAIMER. The Software is provided "AS IS" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Licensor does not warrant that the Software will meet your requirements or that the operation of the Software will be uninterrupted or error-free.
LIMITATION OF LIABILITY. In no event shall Licensor be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Software, even if Licensor has been advised of the possibility of such damages.
TERMINATION. This EULA will terminate automatically if you fail to comply with any of the terms and conditions of this EULA. Upon termination, you must immediately cease all use of the Software and destroy all copies of the Software in your possession.
GOVERNING LAW. This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Licensor is located, without giving effect to any choice of law or conflict of law provisions.
ENTIRE AGREEMENT. This EULA constitutes the entire agreement between you and Licensor with respect to the Software and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Licensor.
ACKNOWLEDGMENT. By installing or using the Software, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
