End User License Agreement (EULA)
Effective Date: Immediately (effective upon signing the agreement / the first time the user downloads the game)
Scope of Application: This Agreement applies to the legal agreement between you (the User) and HONG KONG NIRVANA LIMITED (Hong Kong Nirvana Limited, hereinafter referred to as "we" or "the Developer") regarding your downloading, installing, using, and playing of this game (hereinafter referred to as "the Game") on the Steam platform. Our company is registered in the Hong Kong Special Administrative Region.
Please read and understand this Agreement in full before using the Game. By downloading, installing, running, or playing the Game, or clicking the "Agree" button, you indicate that you have fully read, understood, and agreed to all terms of this Agreement. If you do not agree to any part of this Agreement, please do not use the Game.
1. Definitions
1.Game: Refers to the electronic game software developed by us and released on the Steam platform, including but not limited to client programs, art, music, sound effects, text, UI, code, documents, and all related content.
2.User/You: Refers to a natural person who obtains a license to use the Game through legal channels and uses the Game on the Steam platform.
3.Steam Platform: Refers to the Steam digital distribution platform and related services operated by Valve Corporation.
4.User-Generated Content (UGC): Refers to all content created, uploaded, and published by users in the Game, including but not limited to screenshots, videos, custom levels, mods, text, voice, etc.
5.AI-Generated Content: Refers to art, text, sound effects, scenes, and other content pre-generated or real-time generated using generative artificial intelligence technology in the Game.
2. Grant of License
We grant you a non-exclusive, non-transferable, non-sublicensable, revocable, and limited personal license:
•You may download, install, and run the Game on devices permitted by the Steam platform, solely for personal, non-commercial entertainment purposes.
•This license does not constitute a transfer of any intellectual property rights in the Game, andall rights not explicitly granted are reserved by us.
3. User Obligations and Usage Restrictions
You represent and warrant that:
1.You will comply with this Agreement, the Steam Platform User Agreement, and all applicable laws and regulations (including but not limited to the relevant laws of the Hong Kong Special Administrative Region and the laws of the region where you are located).
2.You will not engage in the following behaviors:
￮Reverse engineering, decompiling, cracking, modifying, or disassembling the Game's code or resources.
￮Copying, distributing, renting, selling, or sublicensing the Game or any part thereof.
￮Using the Game to engage in illegal, infringing, harassing, defamatory, gambling, fraudulent, or other improper activities.
￮Using plug-ins, cheating tools, scripts, modifiers, or other third-party tools to damage the fairness of the Game.
￮Live streaming, recording, or screen recording the Game for commercial profit without permission (non-commercial sharing must indicate the Game source and Developer information).
￮Infringing upon the intellectual property rights, portrait rights, privacy rights, and other legitimate rights and interests of the Game and third parties.
3.If you use AI-Generated Content to create UGC, you must ensure that it is compliant and non-infringing, and comply with the relevant terms of this Agreement.
4. Intellectual Property Rights
1.All intellectual property rights (including copyrights, trademarks, patents, trade secrets, etc.) in the Game are owned by us and/or our licensors, and are protected by global intellectual property laws (including the intellectual property laws of the Hong Kong Special Administrative Region).
2.You only obtain the right to use the Game and do not own any ownership rights to the Game.
3.You retain the intellectual property rights to the UGC you create in the Game, but you grant us aglobal, non-exclusive, free, perpetual, and sublicensable license to use it for Game operation, promotion, marketing, modification, distribution, and display.
4.The intellectual property rights to the AI-Generated Content in the Game are owned by us, and its use has completed compliance review and copyright confirmation.
5. Statement on AI-Generated Content
This Game contains pre-generated AI content (art, text), with the following details:
•Tools Used: Midjourney, GPT
•Purpose: Used to assist in creating Game art, plot text, and UI materials.
•Compliance: All AI-Generated Content has undergone manual review, modification, and copyright confirmation to ensure that it does not infringe upon the rights and interests of third parties and complies with Steam content specifications and applicable laws (including the relevant laws of the Hong Kong Special Administrative Region).
•No real-time generated AI content
6. Accounts and Data
1.You must use a legitimate Steam account to log in to the Game and comply with the relevant rules of the Steam account.
2.You are responsible for the security of your account, and any losses caused by account theft or sharing shall be borne by you.
3.We will collect and use your personal data in compliance with the applicable privacy policy (see [Privacy Policy Link]; if there is no separate privacy policy, this sentence may be deleted or replaced with "see relevant terms of this Agreement"), and in accordance with the relevant laws and regulations on personal data protection in the Hong Kong Special Administrative Region.
4.Game data (characters, progress, virtual items, etc.) is part of the Game service, and we have the right to adjust, maintain, or delete it according to operational needs, which does not constitute an infringement of your property rights.
7. Disclaimer
1.The Game is provided "as is" without any warranty of error-free, uninterrupted, or bug-free operation.
2.We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Game, including but not limited to data loss, device damage, loss of profits, etc. (except as required by mandatory laws and regulations, including the mandatory laws and regulations of the Hong Kong Special Administrative Region).
3.You understand and agree that online games may be suspended or terminated due to server maintenance, network failures, policy changes, or other reasons.
8. Termination of Agreement
1.You may terminate this Agreement at any time by uninstalling the Game and deleting all copies.
2.If you violate this Agreement, we have the right to terminate the license immediately and reserve the right to pursue legal liability (including but not limited to pursuing relevant liabilities as stipulated by the laws of the Hong Kong Special Administrative Region).
3.Upon termination of the Agreement, you must immediately stop using the Game and destroy all copies of the Game.
9. Dispute Resolution
1.This Agreement shall be governed by thelaws of the Hong Kong Special Administrative Region (may be modified if agreed by both parties).
2.Any dispute arising from this Agreement shall first be resolved through negotiation between the two parties; if negotiation fails, it shall be submitted to the competent court of the Hong Kong Special Administrative Region for litigation.
10. Miscellaneous
1.We have the right to modify this Agreement at any time, and the modified version will be announced on the Steam store page or in the Game. Your continued use of the Game shall be deemed acceptance of the modified Agreement.
2.This Agreement constitutes the entire agreement between you and us regarding the use of the Game, replacing all previous oral or written agreements.
3.If any term of this Agreement is deemed invalid or unenforceable, it shall not affect the validity of the other terms.
