Kingdom Come: Deliverance 2 Modding Tools End User License Agreement
These are the (legally binding) rules for accessing and using the Kingdom Come: Deliverance 2 Modding Tools and any related downloadable content (hereinafter referred to as the “Modding Tools”) for the game Kingdom Come: Deliverance 2 (“Game”).
This End User License Agreement, as amended from time to time (hereinafter referred to as “Modding Tools EULA”), set forth the terms and govern your use of the Modding Tools offered by PLAION GmbH, Embracer Platz 1, 6604 Höfen, Austria (hereinafter referred to as “PLAION”).
Additionally to this Modding Tools EULA, the general Kingdom Come: Deliverance 2 EULA https://legal.kingdomcomerpg.com/eula and the Privacy Policy https://legal.kingdomcomerpg.com/privacy applies. In case of a conflict between any terms of the Kingdom Come: Deliverance 2 EULA and the terms of this Modding Tools EULA, the terms of this Modding Tools EULA shall prevail.
We offer the ability to users to use the Modding Tools to create, modify, design, upload, embellish, or otherwise alter objects or other elements for the use in the Game only. (“User Generated Content” or “UGC”).
PLAION grants to you a non-exclusive, non-commercial worldwide, non-transferable, terminable, revocable, non-sublicensable right and license to use Modding Tools (for example, a mask modkit) in order for you to create UGC, subject to the terms of this Modding Tools EULA and any further terms notified to you from time to time. This license is for your personal and non-commercial use as an individual only. Companies are not entitled to use the Modding Tools. You shall not use the Modding Tools for any purpose other than developing UGC for the Game.
Any use by you of the Modding Tools not expressly permitted hereunder is expressly prohibited and any such unauthorized use shall constitute a material breach of this Modding Tools EULA by you. You shall not copy or reproduce, translate, reverse engineer, derive source code from, modify, disassemble, decompile display or distribute any part of the Modding Tools in any medium, or create derivative works based on or related to the Modding Tools.
You shall not in any circumstances commercialize the results from the Modding Tools and shall not develop, manufacture, market, promote, sell, license, publish and/or exploit the Modding Tools. You may not charge a fee, nor solicit donations, contributions or any other voluntary or involuntary form of payment, for access to UGC.
The Modding Tools are based on the game engine CRYENGINE, CRYENGINE and all its related copyrights, trademarks, and all other conceivable intellectual property rights are owned by Crytek GmbH, An der Welle 3, 60322 Frankfurt am Main, Germany (“Crytek” or “Licensor”), and are protected by German and international copyright law and other applicable law. You shall have no ownership or intellectual property rights in or to the CRYENGINE, including, without limitation, all copyrights related thereto. Crytek shall be third-party beneficiary under this Modding Tools EULA and shall have the express right to enforce its provisions and to enjoy the benefits of its protections
The Modding Tools are provided "as is" and without warranty of any kind, express, statutory, implied, or otherwise, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement. PLAION and/or its Licensor does not warrant that the Modding Tools or the operation thereof will be free of error or that the Modding Tools will meet special requirements of you. No oral or written information or advice given to you by PLAION or its Licensor and/or any of their employee, representative or distributor will create a warranty for the Modding Tools and you may not rely on any such information or advice.
As the license granted to you under this Modding Tools EULA is a free-of-charge-license, PLAION's, its affiliated companies and or its Licensor´s liability is excluded and limited to the largest extent legally possible.
TO THE EXTENT PERMISSABLE UNDER APPLICABLE LAW, IN NO EVENT SHALL PLAION AND/OR ITS LICENSOR BE LIABLE FOR ANY DAMAGES, BE THEY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF PLAION AND/OR ITS LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING ALLOCATION OF RISK IS REFLECTED IN THE AMOUNT OF THE COMPENSATION (NONE) CONTEMPLATED UNDER THIS MODDING TOOLS EULA.
By submitting UGC, you grant to PLAION, its affiliates and partners, and their successors in business and assignees, employees, licensees, agents, representatives a worldwide, assignable and sublicensable, non-exclusive, royalty-free license to reproduce, distribute, perform, modify, edit, display, adapt, create derivative works from, and market and promote UGC, for any commercial or non-commercial purposes, and in any medium. You also grant each user of the Game a non-exclusive license to access your UGC as permitted through the functionality of the Game and under this Modding Tools EULA. If this Modding Tools EULA is terminated, PLAION may continue to use your UGC as set out in this section in certain circumstances (for example, where your UGC has no utility outside the Game, it has been aggregated with other UGC or the Game, or if it was jointly created with another user).
Although our Game and its content can be used to provide you with access to UGC, neither this Modding Tools EULA nor your use of any UGC override the UGC owners’ requirements and restrictions.
By making UGC available through our Game, you represent that: (i) you have the right to create and/or provide and/or post any such content, or its use by us as contemplated in this Modding Tools EULA, does not violate this Modding Tools EULA, applicable law or third party rights (including, without limitation, intellectual rights and personal rights); (ii) the UGC is not defamatory, libelous, false, obscene or offensive; and (iii) the UGC is consistent with all age ratings for the Game. You agree and acknowledge that PLAION cannot control each UGC, nor can PLAION verify the accuracy, correctness or authenticity of the UGC provided. PLAION or its Licensor do not assume any responsibility for any UGC or responsibility for any loss of or damage to any to any UGC made available by you or any third party in connection with the Game. PLAION does not actively monitor, nor is PLAION or its Licensor in any way responsible for, the content of any UGC.
THE CONTENT OF THE UGC DOES NOT REFLECT THE VIEWS OF PLAION, OR ITS AFFILIATES OR SUBSIDIARIES, ANYONE ASSOCIATED WITH PLAION, ITS LICENSORS OR LICENSEES. PLAION RESERVE THE RIGHT TO REVIEW AND REMOVE ANY UGC AT ANY TIME, WITHOUT NOTICE, FOR ANY REASON AND IN ITS SOLE DISCRETION. SUBJECT TO SECTION 11 – 13 OF THE KINGDOM COME: DELIVERANCE 2 EULA, PLAION OR ITS LICENSOR SPECIFICALLY DISCLAIMS ANY LIABILITY WITH REGARD TO UGC.
Some UGC may have elements of content that some may regard as excessively violent, vulgar, distasteful, explicit, sexually provocative, lewd, crude, hateful, taunting, harassing, threatening, and otherwise of questionable taste. If you object to or are sensitive to such content, and do not want to be exposed to it, please do not proceed.

The term of this Modding Tools EULA and the license granted herein begin on the date on which you first download, install, load or otherwise use the Modding Tools and shall expire, without notice to you or any other notice, when the Modding Tools or the Game is removed from the market. PLAION may revoke or terminate the license granted hereunder at any time, for any reason or no reason, in its sole discretion. Notwithstanding anything to the contrary herein this Modding Tools EULA and the license granted to you herein shall immediately terminate, without the requirement of any notice from PLAION to you, upon your failure to comply with or breach of any term or provision of this Modding Tools EULA.
Upon the termination or expiration of this Modding Tools EULA, any and all rights of you hereunder shall terminate without prejudice to any rights or claims PLAION or its Licensor may have, You shall have no right to use the Modding Tools and/or UGC, You shall immediately destroy all copies of the Modding Tools and/or UGC in your possession, custody or control, and all rights granted hereunder shall revert, without notice, to and be vested in PLAION.
Termination or expiration of this Modding Tools EULA shall not create any liability against PLAION or its Licensor and shall not relieve you from any liability which arises prior to termination or expiration.
You hereby agree to indemnify, defend, and hold harmless PLAION, its Licensor and/or their successors, assigns, officers, directors, employees, agents, representatives and licensees (but not including you) from and against all damages, claims, losses, causes of action and lawsuits arising from and/or relating to a breach of this Modding Tools EULA by you and/or your distribution or other use or non-use of the Modding Tools and/or your UGC.
IN ALL CASES, YOU ARE SOLELY RESPONSIBLE FOR CREATING AND/OR MAKING USE OF UGC.
