This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Virtual Grape, the creator and publisher of "Dream Job: Delivery Simulator" (the "Game"). By installing or using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
LICENSE
Virtual Grape hereby grants you a non-exclusive, non-transferable, limited license to use the Game for personal, non-commercial use only on one computer or mobile device at a time.
INTELLECTUAL PROPERTY
The Game and all intellectual property rights therein, including but not limited to copyrights, trademarks, trade secrets, and patents, are the property of Virtual Grape and its licensors. You acknowledge that you have no ownership or intellectual property rights in the Game or any of its components.
RESTRICTIONS
You may not:
(a) copy, reproduce, distribute, or transfer the Game, in whole or in part, to any other person or entity;
(b) modify, adapt, translate, reverse engineer, decompile, or disassemble the Game, except to the extent that such activity is expressly permitted by applicable law;
(c) remove any proprietary notices, labels, or marks from the Game;
(d) use the Game for any commercial purpose or for any public display (commercial or non-commercial);
(e) transfer, rent, lease, lend, or sublicense the Game to any third party.
TERMINATION
This EULA is effective until terminated. Your license to use the Game will terminate automatically if you fail to comply with any of the terms and conditions of this EULA. Upon termination, you must immediately cease all use of the Game and destroy all copies of the Game in your possession.
WARRANTY DISCLAIMER
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. VIRTUAL GRAPE DOES NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE.
LIMITATION OF LIABILITY
VIRTUAL GRAPE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE GAME, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA, EVEN IF VIRTUAL GRAPE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of the State of California, without giving effect to its conflicts of laws principles.
ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and Virtual Grape and supersedes all prior or contemporaneous negotiations, discussions, or agreements, whether written or oral, between the parties regarding the subject matter herein.
SEVERABILITY
If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
ACKNOWLEDGMENT
By installing or using the Game, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
