END USER LICENSE AGREEMENT (EULA) FOR HOLY SHIP VIDEO GAME
This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or a single entity) and Crabbyfish Games LLC ("Crabbyfish Games") for the use of Holy Ship video game ("Game"). By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this Agreement.
LICENSE GRANT. Crabbyfish Games grants you a non-exclusive, non-transferable, limited license to use the Game for personal and non-commercial purposes only.
INTELLECTUAL PROPERTY. The Game is owned by Crabbyfish Games and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All title, ownership rights, and intellectual property rights in the Game and any accompanying materials are owned by Crabbyfish Games. You acknowledge that you have no right, title or interest in the Game or any associated intellectual property rights.
RESTRICTIONS. You may not modify, reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Game. You may not distribute, rent, lease, lend, sell, or sublicense the Game or any part of it. You may not use the Game for any commercial purpose without the prior written consent of Crabbyfish Games.
WARRANTY DISCLAIMER. THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CRABBYFISH GAMES DOES NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.
LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRABBYFISH GAMES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GAME, EVEN IF CRABBYFISH GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TERMINATION. Crabbyfish Games may terminate this Agreement immediately upon notice to you if you breach any term of this Agreement. Upon termination, you must immediately cease all use of the Game and destroy all copies of the Game in your possession.
GOVERNING LAW. This Agreement shall be governed by and construed in accordance with the laws of the state of Michigan, without giving effect to its conflict of laws provisions.
ENTIRE AGREEMENT. This Agreement constitutes the entire agreement between you and Crabbyfish Games with respect to the Game and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Crabbyfish Games.
