END USER LICENSE AGREEMENT (EULA)
PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING THE FuMetaverso SOFTWARE.
BY USING THE FuMetaverso SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT USE THE FuMetaverso SOFTWARE.
LICENSE GRANT. FuMetaverso grants you a non-exclusive, non-transferable, limited license to use the FuMetaverso software (the "Software") on any device that you own or control.
RESTRICTIONS. You may not: (i) copy or modify the Software; (ii) transfer, sublicense, lease, lend, rent or otherwise distribute the Software to any third party; (iii) reverse engineer, decompile, disassemble or attempt to derive the source code of the Software; (iv) use the Software in any manner that could damage, disable, overburden or impair any server, network, computer system or resource; (v) use the Software to violate any law or regulation, or to facilitate the violation of any law or regulation; (vi) remove or alter any copyright, trademark, or other proprietary notices on the Software; or (vii) use the Software for any commercial purpose without the prior written consent of FuMetaverso.
TERM AND TERMINATION. This Agreement will remain in effect until terminated by either party. You may terminate this Agreement at any time by ceasing to use the Software. FuMetaverso may terminate this Agreement at any time if you breach any of the terms and conditions of this Agreement. Upon termination, you must immediately cease using the Software and destroy all copies of the Software in your possession.
WARRANTY DISCLAIMER. THE SOFTWARE IS PROVIDED "AS IS" AND Fumetaverso DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Fumetaverso DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
LIMITATION OF LIABILITY. Fumetaverso SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF Fumetaverso HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
GOVERNING LAW. This Agreement will be governed by and construed in accordance with the laws of the State of California, without giving effect to its conflict of law provisions.
ENTIRE AGREEMENT. This Agreement constitutes the entire agreement between you and FuMetaverso with respect to the Software and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and FuMetaverso regarding the Software.
