End-User License Agreement (EULA) for 9th Land MVP Testing
This End-User License Agreement (EULA) is a legal agreement between you and 9th Land LLC for the MVP version of 9th Land, which includes computer software and may include associated media, printed materials, and online or electronic documentation (the "Software Product").
By installing, copying, or otherwise using the Software Product, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Software Product.
1. Grant of License. This EULA grants you the following rights: Installation and Use. You may install and use one copy of the Software Product on a single computer for your personal, non-commercial use solely as set forth in this EULA. You may not share, distribute, rent, lease, sublicense, or otherwise make the Software Product available to any third party.
2. Description of Rights and Limitations. Limitations. You may not reverse engineer, decompile, disassemble, modify, create derivative works of, or otherwise attempt to derive the source code of the Software Product. You may not remove any proprietary notices or labels on the Software Product. You may not copy or reproduce any part of the Software Product except as expressly permitted by this EULA.
3. Termination. Without prejudice to any other rights, 9th Land LLC may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the Software Product and all of its component parts.
4. Ownership. The Software Product is protected by copyright laws and international treaty provisions. The Software Product is licensed, not sold. You acknowledge that no title to the intellectual property in the Software Product is transferred to you. You further acknowledge that title and full ownership rights to the Software Product will remain the exclusive property of 9th Land LLC and you will not acquire any rights to the Software Product except as expressly set forth in this EULA.
5. Disclaimer of Warranty. The Software Product is provided "AS IS" without warranty of any kind. To the maximum extent permitted by applicable law, 9th Land LLC disclaims all warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose and any warranty against infringement, with regard to the Software Product.
6. Limitation of Liability. To the maximum extent permitted by applicable law, in no event shall 9th Land LLC be liable for any special, incidental, indirect, or consequential damages whatsoever (including without limitation damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the Software Product or the provision of or failure to provide support services, even if 9th Land LLC has been advised of the possibility of such damages.
7. User Feedback and Monitoring. By participating in the alpha testing campaign, you agree to provide 9th Land LLC with feedback on your experience with the Software Product, including but not limited to bug reports, suggestions, comments, opinions, and criticisms (the "Feedback"). You grant 9th Land LLC a perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, distribute, and incorporate the Feedback into any future versions of the Software Product or other products or services.
You also agree that 9th Land LLC may monitor your activity while using the Software Product for quality assurance purposes and to improve its performance and functionality. You consent to 9th Land LLC collecting and processing your personal data such as your name, email address, IP address, device information, gameplay statistics, preferences and settings in accordance with its privacy policy.
8. Governing Law. The laws of the United States of America govern this EULA. Any dispute arising out of or in connection with this EULA shall be submitted to the exclusive jurisdiction of the courts of the United States of America.
9. Entire Agreement. This EULA constitutes the entire agreement between you and 9th Land LLC with respect to the Software Product and supersedes all prior or contemporaneous understandings or agreements written or oral regarding such subject matter.
