IMPORTANT - READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Pink Sakura Studios (hereinafter referred to as the "Developer") for the game "On The Wind's Breath" (the "Game"). By installing, copying, or otherwise using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install, copy, or use the Game.
1. Grant of License
Subject to the terms and conditions of this EULA, the Developer grants you a non-exclusive, non-transferable, revocable license to install and use the Game solely for your personal, non-commercial entertainment purposes on a compatible device.
2. Ownership
The Game is licensed, not sold, to you. The Developer retains all right, title, and interest in and to the Game, including all intellectual property rights therein. This EULA does not grant you any ownership rights or title to the Game.
3. Permitted Use
You may install and use the Game on one or more compatible devices that you own or control. You may not distribute or make the Game available over a network where it could be used by multiple devices at the same time. You may not rent, lease, lend, sell, sublicense, or otherwise transfer or distribute the Game or any rights granted under this EULA.
4. Restrictions
You may not reverse engineer, decompile, disassemble, or modify the Game in any way. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices in or on the Game.
5. Updates and Modifications
The Developer may, from time to time, provide updates, patches, or modifications to the Game. You agree to install and use such updates and modifications, which may be provided automatically or require your explicit consent, to continue using the Game.
6. Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice from the Developer if you fail to comply with any term(s) of this EULA. Upon termination, you must immediately cease all use of the Game and destroy all copies in your possession or control.
7. Limited Warranty
The Game is provided "as is" without any warranty of any kind. To the maximum extent permitted by applicable law, the Developer disclaims all warranties, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Developer be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of the use or inability to use the Game, even if the Developer has been advised of the possibility of such damages.
9. Governing Law
This EULA shall be governed by and construed in accordance with the laws of Poland. Any dispute arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts in Poland.
10. Entire Agreement
This EULA constitutes the entire agreement between you and the Developer concerning the subject matter hereof and supersedes all prior or contemporaneous representations, discussions, proposals, whether oral or written.
By installing, copying, or using the Game, you acknowledge that you have read, understood, and agree to be bound by the terms of this EULA.
