End User License Agreement ("EULA")
Soul of Butterflies: Incubation
PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE USING THE SOUL OF BUTTERFLIES: INCUBATION ("APPLICATION"). BY USING THE APPLICATION, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS EULA, DO NOT INSTALL OR USE THE APPLICATION.
This EULA is a legal agreement between you ("End User") and Project Starry Inc., a corporation incorporated under the laws of Taiwan ("Licensor"), with a registered address at No. 82, Meishu North 5th St, Gushan District, Taiwan, governing your use of the Soul of Butterflies: Incubation Application.
License Grant
Subject to the terms and conditions of this EULA, Licensor hereby grants End User a non-exclusive, non-transferable, revocable, limited license to download, install, and use the Application on a single device solely for personal, non-commercial purposes.
Intellectual Property Rights
All title, ownership, and intellectual property rights in and to the Application, including but not limited to copyrights, patents, trademarks, and trade secrets, are owned by Licensor or its affiliates. The Application is protected by the copyright laws of Taiwan, international copyright treaties, and other intellectual property laws and treaties. All rights not expressly granted herein are reserved by Licensor.
Restrictions
End User shall not:
Sell, transmit, host or otherwise commercially exploit the Application;
Copy or use the Application for any other purposes except for personal, non-commercial purposes;
Modify, decrypt, reverse compile or reverse engineer the Application;
Create content (text, upload images) through or on the Application.
Updates
Licensor may, from time to time, update the Application with new features, bug fixes, and other improvements as needed. End User's continued use of the Application following the release of any updates constitutes acceptance of such updates and any changes to this EULA.
Feedback
If End User provides Licensor with any feedback or suggestions for the Application, Licensor shall have the right to use such feedback or suggestions without compensation or credit to the End User.

Term and Termination
This EULA is effective upon End User's acceptance of the terms and conditions herein and shall continue in effect until terminated. End User may terminate this EULA at any time by uninstalling and permanently destroying all copies of the Application in its possession or control. Licensor may terminate this EULA immediately if End User breaches any term or condition of this EULA. Upon termination of this EULA for any reason, End User shall immediately uninstall and permanently destroy all copies of the Application in its possession or control.
Disclaimer of Warranties
THE APPLICATION IS PROVIDED "AS IS" AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. LICENSOR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE APPLICATION WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR VIRUS-FREE, OR THAT DEFECTS WILL BE CORRECTED.
Limitation of Liability
IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE APPLICATION, INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, LOSS OF PROFITS, OR INTERRUPTION OF BUSINESS, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL LIABILITY UNDER THIS EULA SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY END USER FOR THE APPLICATION.
Governing Law and Jurisdiction
This EULA shall be governed by and construed in accordance with the laws of Taiwan, without regard to its conflict of laws principles. Any legal action or proceeding arising under this EULA will be brought exclusively in the courts of Taiwan, and the parties hereby consent to personal jurisdiction and venue therein.
