Collapsed Galaxy 2 End User License Agreement (EULA)
1. General Provisions
1.1 Please review this End User License Agreement ("Agreement") before installing the game software (Collapsed Galaxy 2) provided by Starshift Studio ("Starshift"). The purpose of this Agreement is to explain the terms and conditions of the game software license granted by Starshift (as defined below) and the conditions for using the game software services.
1.2 By installing the game software, the user is deemed to have understood and agreed to the terms and conditions of this Agreement and the conditions for using the game software. If you do not agree to the conditions specified in this Agreement, please stop the installation process immediately and refrain from accessing or using Starshift's game software or services. Continued use of the software after installation constitutes ongoing acceptance of these terms.
1.3 Starshift's software usage policies, such as the Terms of Service, Privacy Policy, and Player Ban Policy, related to game software services are also applicable when using Starshift's software.
2. Limited License Use
2.1 "Game software" means the software included in the game provided by Starshift, all related media, all software related to the online mode of the game, all printed materials, manuals, online or electronic documentation, and all copies of such software and materials.
2.2 The game software grants the user a non-exclusive, non-transferable, and limited right and license to install and use one copy of the game software on one computer hard drive for personal use only (hereinafter referred to as "License"). The user may not run the game software on more than one computer simultaneously without obtaining separate additional licenses.
2.3 Any rights not expressly granted by this license are retained by the license provider if they are related to Starshift. The user is granted a non-exclusive license to the game software. This license does not grant the user ownership of the game software. It should not be interpreted as the sale or transfer of any intellectual property rights or any other rights related to the game software.
3. Ownership
3.1 The game software is protected by copyright law, international copyright treaties, Chinese customary law, trademark law, and other laws. In addition, all copyrights related to the game software (derivative works, videos, music, images, graphics, operating methods, prints, animations, etc.) are the property and asset of Starshift or the license provider.
4. Restrictions
4.1 Users may not copy, re-license, distribute, advertise, rent, or misuse the game software without the written consent of Starshift, nor may they create or sell derivative works or derivatives based on the game software.
4.2 Users may not reverse engineer, reverse assemble, replicate, modify, disassemble, extract source code, or decompile the game software.
4.3 Users may not remove or modify the ownership, copyright, or trademark of the game software or related prints.
4.4 Users are prohibited from transmitting game software to other locations online or offline without the permission of Starshift.
4.5 Users may not create backups or copies of game software for purposes of backup or record keeping, except for creating a single backup or copy for non-commercial backup and reference purposes with the accompanying materials provided with the game software.
4.6 Users may not remove or bypass any security programs or security systems of the game software.
5. Game Software Updates and Patches
5.1 Starshift may provide updates, patches, and other modifications that users need to install or install to play the game properly. Starshift may remotely update the game software that the user is using to deploy or provide such updates, patches, and other modifications, and the user agrees to such deployment or application.
6. Photosensitive Seizure Warning
6.1 A very small number of people may experience photosensitive epileptic seizures when exposed to certain visual images, including flashing lights or patterns that may appear in games. Even people who have no history of seizures or epilepsy may have an undiagnosed condition that can cause these "photosensitive epileptic seizures" while playing games. These seizures may have a variety of symptoms, including lightheadedness, altered vision, eye or face twitching, jerking or shaking of arms or legs, disorientation, confusion, or momentary loss of awareness. Seizures may also cause loss of consciousness or convulsions that can lead to injury from falling down or striking nearby objects. Immediately stop playing and consult a doctor if you experience any of these symptoms.
7. Warranty Limitations and Disclaimers
7.1 The game software and related services are provided "as is." You understand and agree that Starshift assumes no responsibility for any problems arising from your use of the game software and related services, unless caused intentionally or by gross negligence on the part of Starshift. Starshift makes no warranties, express or implied, including, without limitation, warranties of non-infringement, merchantability, or fitness for a particular purpose. Starshift does not warrant that the game software and related services will be uninterrupted or error-free, nor does it warrant that any defects will be corrected, or that the game software or the server that makes it available are free of viruses or other harmful components.
7.2 To the extent permitted by applicable law, Starshift disclaims all warranties, express or implied. This includes, but is not limited to, implied warranties of merchantability and fitness for a particular purpose, and any implied warranties arising from course of dealing or usage of trade.
Except as expressly stated herein, Starshift makes no representations or warranties of any kind, either express or implied, as to the accuracy, reliability, completeness, or contents of any information, text, graphics, links, or other items contained in the game software or related services.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. As a result, some of the above limitations may not apply to you. Please check your local laws for any restrictions or limitations regarding the exclusion of implied warranties.
8. Limitation of Liability
8.1 The user shall be solely responsible for any accidental, consequential, special, or punitive damages, or any form of damages (including personal injury, property or data damage, business interruption, information loss, privacy exposure, device malfunction or error, non-performance, and negligence) arising from the use, non-use, or ownership of the game software, and neither Starshift nor the licensor shall be liable for such damages, regardless of whether Starshift was aware of the possibility of such damages or not.
8.2 Starshift's liability for damages related to the game software shall not exceed the amount actually paid for the game software purchase, provided that Starshift has no intentional or gross negligence. The above applies even if any remedial measure does not achieve its essential purpose.
9. Term and Termination
9.1 This End User License Agreement shall remain in effect as long as the user uses the game software. However, it may be automatically terminated without notice to the user if the user violates the terms of this Agreement or game software service-related policies, such as Starshift's Terms of Service, Privacy Policy, and Player Ban Policy, or destroys or deletes the game software.
10. Injunctive Relief
10.1 If any condition of this Agreement is not specifically enforced, the user agrees that Starshift has the right to take necessary actions without evidence of claims, guarantees, collateral, or damages that cannot be restored, as Starshift may suffer significant losses. This includes other legal remedies permitted by the relevant law, but is not limited to them.
11. Indemnity
11.1 Unless Starshift is intentionally or grossly negligent, the user agrees to indemnify Starshift and the licensor, officers, directors, employees, and agents for any direct or indirect claims, damages, costs, and related expenses (including reasonable legal expenses) arising from the user's use of the game software.
12. Dispute Resolution
12.1 This End User License Agreement shall remain in effect as long as the user uses the game software. However, it may be automatically terminated without notice to the user if the user violates the terms of this Agreement or game software service-related policies, such as Starshift's Terms of Service, Privacy Policy, and Player Ban Policy, or destroys or deletes the game software.
13. Contract Modification
13.1 Starshift may modify the terms of this Agreement at any time and will notify such changes through the Steam service. If the user does not agree to the modified terms of the Agreement, the user may not continue to use the game software service.
14. Miscellaneous
14.1 If there are any provisions in this End User License Agreement that are invalid or unenforceable, such provisions shall be separated from this Agreement, and the remaining provisions shall remain valid and unaffected.
