GENERAL
1. This end user license agreement is a legal agreement between you, the end-user (referred to as "You") and dragons1ayer studios (referred to here as "We" or "Us"). By installing and using this Game, you are agreeing to be bound by this agreement. If you are not of legal age in the country you reside in, a parent or guardian must consent to this agreement.
2. We grant a limited, non-exclusive, non-transferable, revocable license to You to install and run a single seat of the Game through a game service. This license is provide for Your individual, non-commercial entertainment purposes only.
3. You agree you only have a license to play the Game and do not have any property interest in any aspect of the Game, including but not limited to any strategy, characters, profile, progress, or account or profile information.
4. You agree we may update the Game from time to time and consent that We may require you to download and install these updates to continue playing the Game.
TECHNICAL REQUIREMENTS
5. You acknowledge it is Your responsibility to confirm and determine if the device You intend to use the Game on meets the technical requirements. It is your responsibility to comply with any technical requirements, including internet service, required by any Game service to play or continue playing the Game.
6. We may change the technical requirements needed to play the Game at any time. You agree if that happens you are solely responsible for acquiring any updated or different equipment or services necessary to comply with the new technical requirements.
LIMITATIONS OF LICENSE
7. You agree You will not:
a) Violate any law or regulation of your country of residence in connection of your use of the Game or the game service;
b) reverse-engineer, derive source code, decompile or otherwise attempt to discover the source code, operability, or programming of the Game by any means;
c) create derivative works of the Game;
d) commercially exploit the Game;
e) use the game service or the Game to harass any game service user or other user of the Game;
WARRANTIES
8. We warrant that reasonable care has been taken to provide this Game to you. We disclaim any implied warranty of merchantability or fitness for any particular purpose. To the fullest extent of the law possible, We disclaim any further warranty.
9. Your exclusive remedy for any implied or explicit warranty will be for the errors to be corrected or refund of the purchase price.
MAINTENANCE AND SUPPORT AND GAME UPDATES
10. We are not obligated to provide any maintenance or technical support or other support to you for the Game.
11. If We provide support at our sole discretion, You understand we do not need to continue to provide the same support or different support.
12. From time to time We may change any aspect of the game, including but not limited to game balance, available game elements, availability of achievements, scores, progress, and content and how you access and interact with the Game.
BETA
13. If You have opted to play a 'beta' or 'early access' version of this game, You understand the game is a work in progress and is provided "as is" without any guarantee of functionality whatsoever. We will not be responsible for the Game not working properly or causing You issues.
14. Your access to a beta or early access version of the game will be time limited.
USER INFORMATION
15. You agree We may collect, store, publish, and share user information, including statistics, in-game choices, scores, settings and equipment used, progress, selectable content including hero names and account names. This may include aggregating your data with other users or identifying your information individually.
16. You agree We may use this information to improve, support, and administer the Game.
CHANGES TO THIS LICENSE AND TERMINATION
17. The license will continues so long as you continue to use or operate the Game. We may terminate the license on any time by notifying You, including by discontinuing the Game or de-listing it from a game service.
18. Your license will also terminate without notice and automatically if You should fail to adhere to any term of this license.
19. Upon license termination you shall stop all use of the Game and destroy all copies in your possession.
20. From time to time We may update the terms of this agreement at our sole discretion. You will have a chance to review and accept any changes during updates to the Game. These new terms will replace this agreement and supersede it.
21. By accepting the new terms and continuing to use the Game, you irrevocably accept the new agreement. If you do not accept the new terms your license to the Game is terminated.
MISCELLANOUS
22. You agree this is the entire agreement between You and Us.
23. If any clause of this agreement is found to be unenforceable, the rest shall continue to have effect.
24. This license will be governed by the laws of Saskatchewan, Canada. You agree the exclusive venue for all litigation arising out of this agreement will be Saskatchewan, Canada.
