END USER LICENSE AGREEMENT
IMPORTANT - READ CAREFULLY: This End User License Agreement ("Agreement") is a legal agreement between you (either an individual or an entity) and Tusk.ink ("Licensor") for the use of the software product, including any associated media, printed materials, and "online" or electronic documentation (the "Product"). By installing, copying, or otherwise using the Product, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the Product.
Grant of License. Subject to the terms and conditions of this Agreement, Licensor hereby grants to you a non-exclusive, non-transferable license to use the Product solely for your own personal, non-commercial use. This license does not give you any ownership of the Product, and you may not distribute, copy, modify, or create derivative works based on the Product.
Ownership. The Product is owned by Licensor and its licensors, and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All rights, title, and interest in and to the Product, including all intellectual property rights, are and will remain the property of Licensor and its licensors.
Restrictions. You may not rent, lease, loan, sell, sublicense, or distribute the Product, or any part thereof. You may not copy or modify the Product, or create derivative works based on the Product. You may not reverse engineer, decompile, or disassemble the Product, or attempt to do so.
Termination. This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice from Licensor if you fail to comply with any of the terms and conditions of this Agreement. Upon termination, you must immediately cease all use of the Product and destroy all copies of the Product in your possession.
Disclaimer of Warranties. The Product is provided "as is" without warranty of any kind, either express or implied, including without limitation any warranty of merchantability or fitness for a particular purpose. Licensor does not warrant that the Product will meet your requirements or that the operation of the Product will be uninterrupted or error-free.
Limitation of Liability. Licensor will not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the Product, even if Licensor has been advised of the possibility of such damages.
Governing Law. This Agreement will be governed by and construed in accordance with the laws of the country of South Africa, without giving effect to any principles of conflicts of law.
Entire Agreement. This Agreement constitutes the entire agreement between you and Licensor with respect to the use of the Product and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Licensor.
Waiver. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder.
Severability. If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.
BY INSTALLING, COPYING, OR OTHERWISE USING THE PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
