END USER LICENSE AGREEMENT FOR THE RPG GAME "AS CHRONICAS DE MAR CÉU"
IMPORTANT - READ CAREFULLY:
THIS END USER LICENSE AGREEMENT ("EULA") IS A LEGAL AGREEMENT BETWEEN YOU AND THE COMPANY "MARCEL DIOGO QUADROS FERNANDES" ("MARCEL DIOGO QUADROS FERNANDES") FOR THE RPG GAME "AS CRONICAS DE MAR CÉU" ("AS CRONICAS DE MAR CÉU" ("AS CHRONICLES OF SEA SKY"). BY DOWNLOADING, INSTALLING OR ACCESSING OR USING THE GAME, YOU AGREE TO BE BOUND BY THIS EULA. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS OF THIS EULA, DO NOT USE THE GAME.
1. Game License. The Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install and use the Game on your personal computer for your personal, non-commercial use. You may not use the Game for commercial or profit purposes, or copy, modify, distribute, sell or transfer the Game to any other person or entity without the Company's express permission.
2. Intellectual Property. The Game and all copyrights, trademarks, patents and other intellectual property rights relating to the Game are the sole property of the Company and its licensors. You are not entitled to use any of the Companies' trademarks, logos or trade names without the Company's express written permission.
3. Use Restrictions. You agree to use the Game only for lawful purposes and not to violate any applicable law or regulation. You may not use the Game in any way that could cause harm to the Game, the Company or any third party. You also agree not to exploit, hack, modify or interfere with the Game or any server or network connected to the Game.
4. Customer Support. The Company may provide limited technical support for the Game at its sole discretion. The Company does not guarantee that technical support will be provided or that the technical support provided will solve your problems.
5. Limitation of Liability. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE GAME, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, LOSS OF DATA, LOSS OF BUSINESS OR OTHERWISE INTANGIBLE LOSSES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
6. Termination. This EULA will terminate immediately if you breach any of the terms of this EULA. The Company may terminate this EULA at any time, for any reason, upon written notice to you. Upon termination of this EULA, you must delete all copies of the Game in your possession.
7. Updates. The Company may provide updates to the Game from time to time. These updates may include bug fixes, performance improvements and new features. You agree to download and install such updates in order to continue to use the Game.
8. Governing Law. This EULA will be governed by the laws of the country where the Company is headquartered, excluding conflicts of laws. Any dispute arising out of this EULA will be submitted to the exclusive jurisdiction of the competent courts in that country.
9. Entire Agreement. This EULA represents the entire agreement between you and the Company regarding the Game and supersedes all prior or contemporaneous agreements between the parties. Any amendment or waiver of this EUA must be in writing and signed by both parties.
