SOFTWARE LICENSE AGREEMENT FOR THE DARK ANGEL GAME DEVELOPED BY LUIZ JUNIOR
IMPORTANT - READ CAREFULLY BEFORE INSTALLING THE GAME
THE GAME IS LICENSED TO THE CONTRACTING PARTY ("YOU") IN ACCORDANCE WITH THE TERMS DEFINED BELOW AND CONSTITUTE A PERFECT AND FINISHED AGREEMENT BETWEEN YOU AND LUIZ JUNIOR. BY INSTALLING OR USING THE GAME, YOU AGREE THAT BY USING THE GAME, YOU WILL BE LEGALLY ACCEPT THE TERMS OF THIS AGREEMENT WITH LUIZ JUNIOR IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU ARE NOT AUTHORIZED TO USE THE GAME AND MUST NOT INSTALL THE GAME. TO INSTALL THE GAME YOU MUST REGISTER FOR A STEAM® ACCOUNT
IF YOU AGREE TO THE TERMS you may install the Game.
IF YOU DO NOT AGREE WITH THE TERMS you will not be able to install the Game.
LIMITED USE LICENSE. Luiz Junior grants you the non-exclusive right and license to install and use one copy of the Game for your personal use only.
LICENSE RESTRICTIONS:
YOU AGREE TO USE THE GAME IN ACCORDANCE WITH THIS LICENSE AND YOU SHALL NOT:
* Copy the Game, except as provided and permitted in this license and the Steam® Subscriber Agreement.
* Make copies of the Game or any part thereof, except if you make a copy of the Game for backup or archival purposes or make copies of materials accompanying the Game solely for security and non-commercial reference purposes. For the avoidance of doubt, copies of the Game may be made as permitted by the Steam® Subscriber Agreement.
* Sell, rent, lease, license, distribute, upload or transfer or otherwise make the Game available to any other person. If necessary, Luiz Junior may offer a separate license agreement for the website, in order to allow you to use the Game for commercial purposes; check the contact information below.
* Reverse engineer, derivative of the source code, modify, decompile, disassemble or create derivative works of the Game, in part or in its entirety.
* Remove, disable or violate any proprietary notices or labels on or contained in the Game.
* Export or re-export the Game or any copy or adaptation that violates any applicable laws or regulations.
* Create data or executable programs that simulate Game data or functionality.
* LUIZ JUNIOR allow to use the images file for any people (Ex: images of characters).
Furthermore, you agree to observe the safety information, maintenance instructions and other relevant notices contained in the manual that are included with the Game.
GAME UPDATES AND FIXES. Luiz Junior will be able to provide updates and corrections and other modifications to the Game that must be installed so that the user can continue to use the Game correctly. You hereby grant the right to install and apply these patches, updates and modifications. All provisions of this Agreement that refer to the "Game" shall be included in such corrections, updates and modifications.
The risk of using the Game is only you. The game is free of codes that could harm your computer, network or other devices.
LIMITS FOR DAMAGES. You agree that LUIZ JUNIOR is free of INCIDENTAL, OR CONSEQUENTIAL DAMAGES WHICH HAVE BEEN CAUSED BY THE POSSESSION, USE, OR MALFUNCTION OF THE GAME, INCLUDING DAMAGE TO PROPERTY AND REPUTATION, LOST PROFITS, LOST OR CORRUPTED DATA OR FILES, CONSOLE FAILURE, COMPUTER OR HANDHELD DEVICE, FAILURE, ERRORS, NO BUSINESS OR OTHER LOST INFORMATION RESULTING FROM THE POSSESSION, FAILURE OR MALFUNCTIONING OF THE COMPUTER AND, TO THE EXTENT PERMITTED BY LAW, DAMAGES FOR PERSONAL INJURY, EVEN IF LUIZ JUNIOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LUIZ JUNIOR'S LIABILITY SHALL NOT EXCEED THE CURRENT PRICE PAID FOR THE LICENSE TO USE THE GAME.
The license will remain in effect for as long as you use, operate or run the Game. This Agreement will automatically terminate if you fail to comply with its terms and conditions. In that case, you must uninstall the Game and all of its components.
DISCLAIMER GUARANTEE. You agree to indemnify, defend and hold harmless Luiz Junior, partners, affiliates, contractors, officers, directors, employees and agents for any claims, damages, losses and expenses (including reasonable attorneys' fees) resulting directly or indirectly from your acts or omission to act by using the Game in accordance with the terms of this Agreement.
OTHERS. This Agreement is a perfect and complete agreement between the parties regarding this license and supersedes all other prior agreements and representations between them. It can only be modified in writing and with the signature of both parties. If any provision of this Agreement is found to be unenforceable for any reason, that provision will be amended just enough to make it enforceable and will not affect the remaining provisions of this Agreement. This Agreement will be governed by and construed in accordance with the laws of Brazil and you agree to elect the exclusive jurisdiction of the courts of Brazil.
