END-USER LICENSE AGREEMENT

The following document includes the end-user license terms ("EULA") for installing and using Ricave ("Software", "Game"). You acknowledge that you have read and accepted this EULA in its entirety before playing Ricave.

By purchasing Ricave on Steam or any other platform, you buy a license to install and play Ricave. The Software is owned by Rogueatic Games.

1 Definitions
1.1 “Game” means the video game titled Ricave, including all patches, updates and downloadable content (“DLC”).
1.2 “Steam” means the Valve platform governed by the Steam Subscriber Agreement (“SSA”).
1.3 “You” / “Player” means the individual who lawfully obtained a License to the Game.
1.4 “License” means the limited right granted in Section 2.
1.5 “Mod” means a user-generated add-on, asset, plug-in or other work that interoperates with the Game.
1.6 “Updates” means any bug fix, modification or new version of the Game made available by Rogueatic Games.

2 License Grant
Subject to your ongoing compliance with this EULA and the SSA, Rogueatic Games grants you a personal, non-exclusive, non-transferable License to download, install and play the Game for your private entertainment on computers you own or control. Additional Valve rules may apply.

3 Ownership
The Game is protected by copyright and other intellectual-property laws. Rogueatic Games and its licensors retain all rights not expressly granted.

4 Permitted & Prohibited Uses
4.1 You may:
(a) make personal backup copies;
(b) stream or record gameplay;
(c) create Mods in accordance with Section 5.

4.2 You may not (except where mandatory law allows):
(a) resell, sublicense, rent, publicly distribute or lend the Game or License;
(b) circumvent technical protection measures;
(c) reverse engineer or decompile the Game beyond Article 6 of Directive 2009/24/EC (or local equivalent) and only after requesting the needed information from us;
(d) distribute standalone soundtrack files, textures or other substantial parts of the Game’s original assets;
(e) use the Game in any way that violates applicable law or the rights of others.

5 Mods
5.1 Permitted Mods must:
• be clearly marked as unofficial and community-created;
• avoid including substantial portions of original Game assets (limited references needed for functionality are allowed);
• avoid infringing third-party rights, illegal content or harassment.

5.2 License to Rogueatic Games – By publishing a Mod you grant Rogueatic Games a non-exclusive, worldwide, royalty-free, perpetual license to host, reproduce, adapt, publicly perform, display and otherwise commercially exploit the Mod (e.g., bundling in future releases or showcasing in marketing). Nothing herein limits any statutory moral right to be identified as the author where such right cannot be waived.

5.3 Steam Workshop – Mods uploaded to Steam Workshop are also subject to the SSA and Steam Workshop terms.

6 Feedback
If you provide ideas or suggestions, you grant Rogueatic Games a non-exclusive, perpetual, royalty-free license to use them for any purpose without obligation to credit or compensate you.

7 Disclaimers
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DO NOT GUARANTEE THAT IT WILL RUN ERROR-FREE OR UNINTERRUPTED. THIS SECTION DOES NOT LIMIT ANY STATUTORY CONSUMER RIGHTS, INCLUDING THOSE UNDER DIRECTIVE (EU) 2019/770 AND THE POLISH CONSUMER RIGHTS ACT.

8 Limitation of Liability
8.1 Nothing in this EULA excludes liability for death, personal injury, intent, gross negligence, fraud or any other liability that cannot be limited by law.
8.2 Rogueatic Games’ aggregate liability arising out of or relating to the Game shall not exceed the greater of (a) the amount you paid for the Game, or (b) fifty (50) Euro.

9 Termination
9.1 You may terminate this EULA at any time by uninstalling the Game.
9.2 We may terminate it immediately if you materially breach it. Upon termination you must uninstall the Game; provisions that by nature survive remain in effect.

10 Governing Law & Jurisdiction
10.1 This EULA is governed by the laws of Poland, without regard to conflict-of-law rules.
10.2 If you are a consumer resident in the EEA, you may bring proceedings in your place of residence; Rogueatic Games may bring proceedings in your country of residence or Poland.
10.3 The EU online dispute-resolution platform is available at https://ec.europa.eu/consumers/odr.

11 Steam Subscriber Agreement Precedence
If any provision of this EULA conflicts with the Steam Subscriber Agreement, the SSA prevails to the extent of the conflict.

12 Severability
If any part of this EULA is held invalid or unenforceable, the remainder remains in force, and the invalid provision will be interpreted to fulfil its intended purpose to the maximum extent permitted.

13 Entire Agreement
This EULA, the SSA and, where applicable, the Steam Workshop terms constitute the complete agreement between you and Rogueatic Games concerning the Game and supersede all prior agreements.
