END USER LICENSE AGREEMENT FOR "STONE TRIBES"
IMPORTANT - READ CAREFULLY: This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and IndieIslandStudio for the software product "Stone Tribes" which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("SOFTWARE PRODUCT"). By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the SOFTWARE PRODUCT.
LICENSE GRANT
IndieIslandStudio grants you a non-exclusive, non-transferable license to use the SOFTWARE PRODUCT solely for your personal, non-commercial use in accordance with the terms of this EULA.
OWNERSHIP
The SOFTWARE PRODUCT is owned and copyrighted by IndieIslandStudio and its licensors and is protected by copyright laws and international treaty provisions. You acknowledge that no title to the intellectual property in the SOFTWARE PRODUCT is transferred to you. You further acknowledge that title and full ownership rights to the SOFTWARE PRODUCT will remain the exclusive property of IndieIslandStudio and its licensors, and you will not acquire any rights to the SOFTWARE PRODUCT except as expressly set forth in this EULA.
RESTRICTIONS
You may not distribute, sell, rent, lease, sublicense, or otherwise transfer the SOFTWARE PRODUCT, or any portions thereof, to any third party without the prior written consent of IndieIslandStudio. You may not modify, reverse engineer, decompile, disassemble, or create derivative works based on the SOFTWARE PRODUCT, or any portions thereof. You may not remove or obscure any copyright, trademark or other proprietary notices from the SOFTWARE PRODUCT or any portions thereof.
WARRANTY DISCLAIMER
THE SOFTWARE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IndieIslandStudio DOES NOT WARRANT THAT THE SOFTWARE PRODUCT WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE PRODUCT WILL BE UNINTERRUPTED OR ERROR-FREE. SOME STATES AND JURISDICTIONS DO NOT ALLOW EXCLUSIONS OF AN IMPLIED WARRANTY, SO THIS DISCLAIMER MAY NOT APPLY TO YOU.
LIMITATION OF LIABILITY
IN NO EVENT SHALL IndieIslandStudio BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE PRODUCT, EVEN IF IndieIslandStudio HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, IndieIslandStudio'S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS EULA SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SOFTWARE PRODUCT. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
TERMINATION
Without prejudice to any other rights, IndieIslandStudio may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.
GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of the state of Michigan without regard to its conflict of laws provisions

All content included in the RPG video game "Stone Tribes," including but not limited to graphics, design, characters, storylines, and game mechanics, is the exclusive property of Indie Island Studios and is protected by applicable intellectual property laws. Any unauthorized reproduction, distribution, or modification of the game content is strictly prohibited.
