END-USER LICENSE AGREEMENT
IMPORTANT - READ CAREFULLY BEFORE DOWNLOADING OR USING CURFEW
This End-User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and OJH.Games ("OJH.Games," "we," or "us") for the use of CURFEW, a video game software product ("CURFEW" or "Software"). By downloading, installing, accessing, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not download, install, access or use the Software.
LICENSE GRANT
OJH.Games grants you a non-exclusive, non-transferable, limited, and revocable license to download, install, access, and use the Software on a personal computer owned or controlled by you for personal and non-commercial purposes only. This license does not grant you any right to copy, distribute, modify, translate, or create derivative works of the Software, except to the extent that such restriction is prohibited by applicable law.
INTELLECTUAL PROPERTY
The Software and any related documentation, logos, trademarks, and other materials are owned by OJH.Games or its licensors and are protected by copyright laws and other intellectual property laws. You acknowledge that all rights, title, and interest in and to the Software and any related materials are owned by OJH.Games or its licensors, and you agree not to challenge OJH.Games' ownership or rights.
RESTRICTIONS
You may not use the Software for any illegal or unauthorized purpose, nor may you, in the use of the Software, violate any laws in your jurisdiction (including but not limited to copyright laws). You may not modify, adapt, translate, reverse engineer, decompile, or disassemble the Software, except to the extent that such restriction is prohibited by applicable law. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices from the Software or any related materials.
TERM AND TERMINATION
This Agreement is effective upon your acceptance and will remain in effect until terminated. You may terminate this Agreement by discontinuing use of the Software and deleting it from your computer. OJH.Games may terminate this Agreement at any time without notice if you breach any of the terms of this Agreement. Upon termination, you must immediately cease all use of the Software and destroy all copies of the Software in your possession.
WARRANTY DISCLAIMER
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. OJH.GAMES DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OJH.GAMES OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SOFTWARE, EVEN IF OJH.GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless OJH.Games and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, actions, suits, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Software, any breach of this Agreement, or any violation of applicable law.
