END USER LICENSE AGREEMENT
IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY. BY INSTALLING, COPYING, OR OTHERWISE USING THE GAME "ABORIGINAL" ("THE GAME"), YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL, COPY, OR USE THE GAME.
This End User License Agreement ("EULA") is a legal agreement between you ("End User" or "you") and Monastic Hill Studios Private Limited ("Monastic Hill Studios" or "we") for the use of the game Aboriginal, including any associated media, documentation, updates, and any accompanying printed materials (collectively referred to as "the Game").
1. LICENSE GRANT
Subject to your compliance with the terms and conditions of this EULA, Monastic Hill Studios hereby grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Game on your personal computer, gaming console, or other authorized devices solely for your personal, non-commercial use.
2. AGE RESTRICTIONS
The Game contains mature content, including violence and nudity. By accepting this EULA, you represent and warrant that you are at least 18 years of age or have obtained parental consent if you are under 18. Monastic Hill Studios reserves the right to verify your age and take appropriate action if false information is provided.
3. INTELLECTUAL PROPERTY
The Game, including all intellectual property rights associated with it, is and shall remain the exclusive property of Monastic Hill Studios and its licensors. All rights not expressly granted herein are reserved by Monastic Hill Studios. You acknowledge that you have no ownership or other proprietary rights in the Game.
4. USE RESTRICTIONS
4.1 You shall not:
a. Copy, distribute, sell, sublicense, lease, lend, rent, modify, adapt, translate, or create derivative works of the Game, in whole or in part, without the prior written consent of Monastic Hill Studios.
b. Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Game or any underlying software, except to the extent expressly permitted by applicable law.
c. Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices contained in or on the Game.
d. Use cheats, hacks, or any other unauthorized software or methods to gain unfair advantages in the Game.
e. Use the Game for any illegal or unauthorized purpose or engage in any activity that violates applicable laws or regulations.
4.2 You agree to use the Game in accordance with all applicable laws and regulations. You are solely responsible for your actions while using the Game and for any consequences that arise from those actions.
5. PRIVACY
Monastic Hill Studios may collect, use, and disclose personal information as described in its Privacy Policy, which is incorporated by reference into this EULA. By using the Game, you consent to the collection, use, and disclosure of your personal information in accordance with the Privacy Policy.
6. LIMITED WARRANTY AND DISCLAIMER
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. MONASTIC HILL STUDIOS DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MONASTIC HILL STUDIOS DOES NOT WARRANT THAT THE GAME WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH YOUR SYSTEM.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MONASTIC HILL STUDIOS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL
, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE GAME, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR USE, EVEN IF MONASTIC HILL STUDIOS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL MONASTIC HILL STUDIOS' TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU FOR THE GAME.
8. TERMINATION
This EULA is effective until terminated. Monastic Hill Studios may terminate this EULA immediately and without notice if you fail to comply with any provision of this EULA. Upon termination, you shall cease all use of the Game and destroy all copies of the Game in your possession or control.
9. GOVERNING LAW AND JURISDICTION
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction where Monastic Hill Studios is located, without regard to conflicts of law principles. Any legal action or proceeding arising out of or relating to this EULA shall be brought exclusively in the competent courts of that jurisdiction.
10. MISCELLANEOUS
This EULA constitutes the entire agreement between you and Monastic Hill Studios regarding the Game and supersedes all prior or contemporaneous understandings. If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Monastic Hill Studios' failure to enforce any right or provision under this EULA shall not constitute a waiver of such right or provision.
By installing, copying, or using the Game, you acknowledge that you have read, understood, and agreed to be bound by this EULA.
