END USER LICENSE AGREEMENT (EULA)
IMPORTANT – READ CAREFULLY: This End User License Agreement (“EULA”) is a legal agreement between you (either an individual or a single entity) and Wizard Kings (“Licensor”) for the use of Flowball (“Game”). By installing or using the Game, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install or use the Game.
LICENSE
Subject to the terms of this EULA, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to use the Game solely for your personal, non-commercial use on a single device. The license is granted to you, not sold, and Licensor retains ownership of all copies of the Game.
RESTRICTIONS
You may not copy, modify, distribute, sell, lease, rent, sublicense, or transfer the Game or any portion thereof. You may not reverse engineer, decompile, or disassemble the Game, except and only to the extent that such activity is expressly permitted by applicable law. You may not remove or obscure any proprietary notices, labels, or marks from the Game.
INTELLECTUAL PROPERTY
The Game, including all graphics, audio, and other content, is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Licensor retains all rights, title, and interest in and to the Game and all copies thereof, including all intellectual property rights.
WARRANTY DISCLAIMER
THE GAME IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LICENSOR DOES NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE GAME WILL BE UNINTERRUPTED OR ERROR-FREE.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE GAME, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TERMINATION
This EULA is effective until terminated. Licensor may terminate this EULA at any time if you fail to comply with any term of this EULA. Upon termination, you must immediately cease all use of the Game and destroy all copies of the Game.
GENERAL
This EULA constitutes the entire agreement between you and Licensor with respect to the use of the Game and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Licensor. This EULA shall be governed by and construed in accordance with the laws of [Your Country/State/Province], without giving effect to any principles of conflicts of law. If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
