GALACTIC EMPIRE SOFTWARE LICENSE TERMS
THESE LICENSE TERMS CONSTITUTE AN AGREEMENT BETWEEN THE AUTHOR OF GALACTIC EMPIRE - DOMINIK KIELANICZ "KIELAN XD" - AND THE USER.
BY USING THE SOFTWARE, YOU ACCEPT THESE TERMS. IF YOU DO NOT AGREE, YOU MAY NOT DOWNLOAD, INSTALL OR USE GALACTIC EMPIRE.
INSTALLATION AND USE RIGHTS. If you comply with this agreement, you may install and use one copy of the software on one device for each license you acquire. You may install multiple copies of the software on one device as long as you have a license for each copy.
This license is for personal use only (and therefore may not be given, "sold", loaned, gifted, assigned, sublicensed or otherwise transferred to another person) and does not confer any ownership rights to Galactic Empire.
INJURY ALERT.
Galactic Empire may contain flashing lights and images that may trigger seizures. If you or anyone in your household suffers from epilepsy, consult your doctor before playing Galactic Empire. If you experience dizziness, blurred vision, eye or muscle spasms, loss of consciousness, disorientation, any involuntary movements or convulsions while playing, discontinue use immediately and consult a physician.
PATCHES, UPDATES AND CHANGES
I may (but am not obligated to) patch, update, or change Galactic Empire from time to time (for example, to add or remove features, fix software bugs, or balance the game). This will result in mandatory and/or automatic updates, and older, unpatched versions may become unusable over time. I need these rights to keep Galactic Empire running smoothly and I reserve the right to do so without notice or liability to you.
6 PROPERTY AND INTELLECTUAL PROPERTY RIGHTS
6.1 The Galactic Empire Game, including its visuals, characters, storyline, graphics, animations, designs, items, music and sound effects, dialogue, graphics, computer code, user interface, look and feel, game mechanics, gameplay, sound, video , text, layout, databases, data and all other content as well as all intellectual property rights and other legal and exploitation rights related to them are either the property of the game author - Kielan xD, or I license them from third parties. All rights to Galactic Empire are reserved except as otherwise provided in this Agreement. Galactic Empire and related intellectual property rights are protected by copyright.
"Intellectual Property Rights" means all copyrights, trademarks, service marks, trade dress, brand names, logos, goodwill, trade names, trade names or domain names, design rights, character rights, publicity rights, databases, patents, rights to inventions, know-how, trade secrets and confidential information, rights to computer software (including source code and object code), moral rights, copyrights, advertising rights, performance rights, synchronization rights, mechanical rights, publishing, rental, lending and transmission rights and other intellectual property rights and exploitation rights of a similar or equivalent nature that may exist now or in the future in any part of the world, in all cases, whether registered or subject to registration , including all granted applications and all applications for registration, division, continuation, reissue, renewal, renewal cancellation, reinstatement and revocation regarding any of them.
GALACTIC EMPIRE RULES OF USE
There are a few other rules that must be followed if you want to play Galactic Empire. Please read the following rules and Fan Content Guidelines as failure to comply with them will be considered a "material breach" of this Agreement, which may lead to suspension and/or termination of access to Galactic Empire. In particularly serious cases, I reserve the right to block future access to Galactic Empire and my other games and services.
Here are the rules:
a) Use Galactic Empire for personal enjoyment only and not for commercial purposes, unless expressly permitted in my Fan Content Guidelines.
b) You must comply with all applicable laws and regulations when using Galactic Empire.
c) Do not attempt to copy, rent, buy, sell, loan, share, lease, sublicense, transfer, distribute, publish or publicly display Galactic Empire or any of your rights hereunder in any manner not expressly permitted under this Agreement. Do not steal or misappropriate game keys/codes.
d) Technical Abuse. Do not modify, merge, distribute, translate, attempt to derive the source code or use the Galactic Empire source code, decompile or disassemble it.
e) Hacking and cheating. Do not create, use, share and/or redistribute codes. By cheating I mean things like exploits, automation software, robots, bots, hacks, spiders, spyware, scripts, trainers, extraction tools or any other software that interacts with or affects Galactic Empire in any way (including any unauthorized third party programs that collect information about Galactic Empire by reading memory areas used by Galactic Empire to store information).
f) Data Mining. Do not intercept, mine or otherwise collect sensitive data or information from Galactic Empire.
g) Content that violates the law. Do not do anything in relation to Galactic Empire that infringes any copyright, trademark, patent, trade secret, privacy, publicity or other right.
h) Malicious code. Do not upload any files that contain malicious code, including viruses, spyware, Trojan horses, worms, time bombs, intentionally corrupted data, any other files that contain malicious code or that could damage or interfere with Galactic Empire in any way.
i) Geographical Restrictions. Please respect any applicable geographic or regional, language or location restrictions, requirements or rules for Galactic Empire.
j) Do not do, say or use the Galactic Empire game in any way that is or may be considered racist, harassing, xenophobic, sexist, discriminatory, abusive, defamatory or otherwise offensive or illegal.
WHAT TYPE OF FAN CONTENT CAN A PLAYER CREATE?
From my point of view, you can create whatever fan content you want, within reason and following the rules. Here are some examples:
• recording game videos, streaming on YouTube and Twitch;
• drawing great fan art of characters from my games and posting them on social media;
• creating props and cosplays;
• sharing screenshots with the world, making them wallpapers and even posters to hang above the bed;
• creating social networks, fan pages and discussion groups dedicated to my games;

IMPORTANT RULES FOR FAN-GENERATED CONTENT
1. No commercial use. You have no right to sell Galactic Empire artwork unless authorized by me.
2. Your content should be clearly marked as "unofficial"
3. Fan content should function independently - it cannot be incorporated into games and products of other companies.
4. I have nothing against monetization of videos and streams through affiliate programs run by such websites. However, the mere access to them cannot be paid
5. I do not agree not to use content from Galactic Empire in videos/streams that are not related to this game in any way. If you would like to use it in some way, please write to kielanxd@gmail.com
6. MUSIC - I personally composed all the music for Galactic Empire and I own all copyrights and property rights to it. I only agree to use it to provide background music for the aforementioned game videos. Any other use of it will be treated as copyright infringement. I do not consent to any remixes.
7. Mods - i.e. software that modifies Galactic Empire or works together with it, e.g. changing the appearance of the interface or adding new elements to the game - can be created by you, as long as they do not violate the license agreement for the game. If you want to use the content of Galactic Empire in a mod for another game or service, or make a separate product out of the mod, first ask at kielanxd@gmail.com
8. By creating any modifications to Galactic Empire, you automatically waive all property rights and they are assigned to me, the author of the game Dominik Kielanowicz "Kielan xD". I can decide to include it in the official version of the game via an update / DLC / add-on for Galactic Empire and/or modify it as I wish. At the same time, you declare that you will not have any claims related to the mentioned modification. By creating modifications to the game, you also give me the inalienable rights to publicly display and exploit it in any way.
FEEDBACK AND FAILURE REPORTS
If you want to share your experience, please contact the author of the game: kielanxd@gmail.com. Please note that I may choose not to use or accept players' suggestions, I cannot accept any responsibility for them, and if I somehow incorporate a suggestion or something similar into or around the game, I am under no obligation to refund or compensate you (financially or otherwise).
If something goes wrong with Galactic Empire, I may ask you to send me a crash log report and/or a screenshot of the game to improve the game code for future use. These reports are optional.
RESPONSIBILITY
This section does not apply to you if you reside in the European Union or countries whose laws specifically prohibit the following limitations of liability, but it does apply to you if you reside elsewhere, including the United States of America.
You use Galactic Empire at your own risk. Unless otherwise stated in this Agreement, the game developer and its affiliates, partners and licensors disclaim any implied or express warranties or representations regarding Galactic Empire. Galactic Empire is provided to you "as is" and "as available" without warranties or representations of any kind, express or implied, and we will not be liable for any loss, damage or damage of any kind arising from your use of or inability to use Galactic Empire. To the fullest extent permitted by applicable law, you disclaim all warranties, express or implied, that may apply to Galactic Empire, including: implied warranties of title, non-infringement, merchantability, satisfactory quality, fitness for a particular purpose, any warranties of that may arise from the course of the transaction or the manner of execution or use of the trade, freedom from viruses, bugs or defects, and/or any warranties as to the accuracy, legality, reliability or quality of any content or information contained in Galactic Empire. We do not warrant that Galactic Empire will run uninterrupted or error-free, that glitches will be fixed, or that the game will be free of viruses or other harmful components.
Limitation of Our Liability. To the maximum extent permitted by applicable law, the game developer and its affiliates, partners and licensors shall not be liable to you for any loss of profits, fees or expenses, loss of data or any damage or loss of information or any loss of opportunity business or any special, indirect punitive, exemplary or consequential loss or damage or disruption of any kind, in any event, whether based on breach of contract, tort (including negligence, breach of statutory duty, breach of contract, breach of warranty or strict liability), misrepresentation, restitution or otherwise, whether or not the party concerned has been advised of the possibility of such damage.
Our conditions of liability in the maximum extent permitted by the applicable law, under no circumstances should the author's total responsibility of the game and his associates, partners and licensors in connection with Galactic Empire or this agreement will not exceed the amount that has actually paid us (if they are) in connection with THE BASIC MATTER OF ANY CLAIM. THE ABOVE IS YOUR SOLE AND EXCLUSIVE REMEDY UNDER THIS AGREEMENT
You agree to indemnify and hold harmless the game developer, its affiliates, licensors and partners from all damages, liabilities, claims and expenses, including legal fees, in connection with: (a) any alleged or actual breach of this Agreement by you; (b) use of Galactic Empire by you or anyone acting on your behalf; and (c) infringement of the Intellectual Property Rights of the game developer, its affiliates, licensors and partners. If claims are made against us, you will fully cooperate with us and we reserve the right to assume and defend them. You will not settle such claims in whole or in part without our prior written consent.
Satisfaction. You agree that any loss, damage or harm you incur is not irreparable and other remedies will be appropriate so that you have no right to injunctive relief or other equitable relief against the game developer, its affiliates, licensors and partners.
California residents. If you live in California, you can contact the author of the game via email: kielanxd@gmail.com. California residents expressly agree to waive Art. 1542, which states: "The general discharge does not extend to claims the existence of which the creditor did not know or did not suspect in his favor at the time of the discharge, and which, if known to him, must have materially affected his settlement with the debtor. "
I may suspend or terminate your access to Galactic Empire and this Agreement if you materially breach this Agreement, including a breach that is serious and/or likely to cause actual harm to Galactic Empire, Galactic Empire users, the game developer and its affiliates, licensors and partners. I will try to contact you as much as possible to explain why I did this and what (if anything) you can do about it. If I suspend or cancel your access to Galactic Empire and this Agreement in accordance with this section, I will have no obligation to you.
Stopping the Galactic Empire. It seems very unlikely, but if I have to stop providing access to Galactic Empire (in whole or in part - e.g. on a specific platform) permanently and not because of any violation by you, I will try to provide you with at least ninety ( 90) days in advance by posting a note on my website. In that case, I will have no future obligations to you.
GOVERNMENT LAW
You and I, the author of the game, agree that your use of the Galactic Empire game and this Agreement and all matters arising therefrom shall be governed by and construed in accordance with Polish law, and any disputes relating thereto shall be subject exclusively to the jurisdiction of the courts having jurisdiction over Poland . In any legal claim arising from this Agreement, the winning party will be entitled to reimbursement of legal costs and fees.
You and I both agree to use reasonable and good faith efforts to informally resolve any disputes between us. I usually suggest that this dispute resolution period be thirty (30) days, unless there are exceptional circumstances.
OTHER LEGAL MATTERS
Separation. If any part of this Agreement is found to be unenforceable, no other part of it will be affected.
No third parties. This Agreement governs our relationship with you (and vice versa). It does not create any rights for anyone else unless expressly stated otherwise in this Agreement.
Transfer. I may assign, subcontract or transfer this Agreement to a third party if necessary to operate the Galactic Empire game, as part of any reorganization or merger or for other business reasons. I will notify you if that happens.
Delay. No failure or delay by us or you to exercise any right or remedy provided in this Agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or limit the continued exercise of that or any other right or remedy, unless expressly stated otherwise in this Agreement. No single or partial exercise of such right or remedy by us or you shall exclude or limit the continued exercise of that or any other right or remedy.
CHANGES TO THIS AGREEMENT
I may change this Agreement as I deem necessary (e.g. for legal reasons or to reflect changes to the Galactic Empire game). In such a case, I will make the revised Agreement available online and use reasonable efforts to notify you (e.g. by sending an in-game notification).
When I amend the Agreement, it will become legally binding on you thirty (30) days after it is posted online. During this period, feel free to contact me at kielanxd@gmail.com if you have specific questions about the changes. If you do not agree to these changes (whether or not you email us), then unfortunately I have to ask you to stop using Galactic Empire.

Transfer. I may assign, subcontract or transfer this Agreement to a third party if necessary to operate the Galactic Empire game, as part of any reorganization or merger or for other business reasons. I will notify you if that happens.
Delay. No failure or delay by us or you to exercise any right or remedy provided in this Agreement or by law shall constitute a waiver of that or any other right or remedy, nor shall it preclude or limit the continued exercise of that or any other right or remedy, unless expressly stated otherwise in this Agreement. No single or partial exercise of such right or remedy by us or you shall exclude or limit the continued exercise of that or any other right or remedy.
CHANGES TO THIS AGREEMENT
I may change this Agreement as I deem necessary (e.g. for legal reasons or to reflect changes to the Galactic Empire game). In such a case, I will make the revised Agreement available online and use reasonable efforts to notify you (e.g. by sending an in-game notification).
When I amend the Agreement, it will become legally binding on you thirty (30) days after it is posted online. During this period, feel free to contact me at kielanxd@gmail.com if you have specific questions about the changes. If you do not agree to these changes (whether or not you email us), then unfortunately I have to ask you to stop using Galactic Empire.
