End User License Agreement (EULA)
This End User License Agreement ("Agreement") is a legal agreement between you and Fabelar, the developer and owner of the virtual reality application "Discovering San Giusto: chapter 1 The unveiling" (the "Application"). By installing or using the Application, you agree to be bound by the terms of this Agreement.
License Grant
Subject to the terms and conditions of this Agreement, Fabelar grants you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal and non-commercial purposes. You may not sell, distribute, or otherwise transfer the Application to any third party.
Ownership
The Application is owned by Fabelar and is protected by copyright laws and international treaties. Fabelar retains all rights, title, and interest in and to the Application, including all intellectual property rights.
Restrictions
You may not:
Modify, adapt, translate, reverse engineer, decompile, or disassemble the Application, or create derivative works based on the Application;
Use the Application for any commercial purpose, including but not limited to selling, distributing, or otherwise transferring the Application to any third party;
Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the Application;
Use the Application in any way that violates any applicable laws, regulations, or third-party rights.
Warranty Disclaimer
The Application is provided "as is" without any warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Fabelar does not warrant that the Application will meet your requirements or that the operation of the Application will be uninterrupted or error-free.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Fabelar be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use the Application, even if Fabelar has been advised of the possibility of such damages.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Italy, without giving effect to any choice of law or conflict of law provisions. Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of Italy.
Separate Sales to Public Entities and Commercial Activities
The sale of the Application to public entities and commercial activities must be made separately and calculated based on the client and the number of stations on which to load the virtual experience.
Termination
Fabelar may terminate this Agreement at any time without notice if you breach any of the terms and conditions of this Agreement. Upon termination, you must immediately stop using the Application and destroy all copies of the Application in your possession.
Entire Agreement
This Agreement constitutes the entire agreement between you and Fabelar with respect to the Application and supersedes all prior or contemporaneous understandings or agreements, whether written or oral, regarding the Application.
By clicking "I Agree" or by installing or using the Application, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions. If you do not agree to the terms of this Agreement, do not install or use the Application.
