Thank you for participating in the Intruder Alert™ closed playtest. Intruder Alert™ is brought to you by Lambda Complex Inc. (Lambda Complex), a company incorporated in B.C., Canada.

Our game is still under construction and, in order to participate in the closed playtest, you must read and agree to the terms of the EULA. By installing and/or playing the game, you agree that you have read and agree to the following terms:

1. License. We grant you a limited, revocable, non-sublicensable, non-transferable and non-exclusive license to: (a) install the game using a single account on Steam; and (b) play the game for closed playtesting purposes. You agree that we retain ownership of all rights in the game and you cannot sell, transfer or commercially exploit the game.

2. Access. Pursuant to Steam’s Subscriber Agreement, you hereby agree that you are over the age of 13.

3. Code of Conduct. You have read and agree to follow the Code of Conduct. You agree that the license may be revoked by us at any time for breaching the Code of Conduct, and Lambda Complex has sole discretion to undo any revocations. The Code of Conduct may be amended at any time by Lambda Complex and such amendments are effective when the Code of Conduct is changed.

4. Feedback. During the closed playtest, you may be provided with an opportunity to provide comments, suggestions and impressions of the game and/or supply feedback and bug reports in-game or on our Discord server or any other forum or website. You agree that any feedback you provide is the property of Lambda Complex, for example any ideas to improve the game. No compensation is provided for participating in the closed playtest.

5. Disclaimer. While we’ve worked really hard on delivering a polished closed playtest version, there’s still a risk in using any pre-release software. You agree that:

a. you may lose any unsaved or saved progress in the game or any other saved game data during the closed playtest;

b. there may be updates and/or changes to the game during the closed playtest;

c. participation in the closed playtest does not grant you access to the full version of the game;

d. the game is a work in progress and may contain bugs that cause loss of data or damage to your computer, operating system or other software, which we are not responsible (liable) for; and

e. you should back-up your data prior to installing the game.

6. Term. This agreement begins when you install the game and continues until the game is commercially available for purchase. We may terminate your access to the game at any time, without notice or compensation to you.

7. Privacy Policy. Installation and participation in the closed playtest are governed by our Privacy Policy detailing how we or our third-party service providers collect, use and disclose personal and anonymous data about you. Our Privacy Policy is available at https://lambdacomplex.com/privacy. By participating in the closed playtest, you agree to the Privacy Policy and you represent and warrant that your installation and playing of the game complies with applicable privacy laws and are permitted to share the personal data you choose to share with us. If at any time you disagree with the Privacy Policy, you shall immediately uninstall and stop playing the game and you may contact us at privacy@lambdacomplex.com for further information.

8. Relief. If you breach this agreement, you agree that we will suffer irreparable harm and there may be no adequate remedy. Accordingly, we have the right to use all available remedies under law, including but not limited to equitable and injunctive relief. You shall not oppose any such remedy sought by us on the basis that damages would be a satisfactory or sufficient remedy.

9. Governing Law. This agreement is deemed to have been made and performed in and shall be construed pursuant to the laws of British Columbia and Canada, excluding application of conflict of laws principles. The parties agree to submit to the exclusive jurisdiction of the appropriate provincial and federal courts in Vancouver, British Columbia.

10. Updates. We may update this EULA at any time as we feel is needed for the closed playtest. Any updates to the EULA shall be effective immediately upon notice to you of such update.

11. Notice. All notices under this agreement shall be in writing and deemed given when delivered to you through the game or through any of our third parties.
