End User License Agreement for First Responder VR by EmergiSim Pty Ltd.
This End User License Agreement (the “Agreement”) is between EmergiSim Pty Ltd, located at North Boambee Valley, Australia (“EmergiSim”, “us”, “we”, or “our”), and the end user of the First Responder VR software application (the “Software”) made available through Steam (the “Platform”).
By using the Software, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not use the Software.
License Grant. EmergiSim grants you a limited, non-exclusive, non-transferable, revocable license to use the Software solely for your personal non-commercial use in accordance with the terms of this Agreement. You may not sublicense, rent, lease, sell, or otherwise transfer the Software or any portion thereof, or allow others to use the Software or any portion thereof.
Ownership. The Software is owned by EmergiSim and is protected by copyright laws and international copyright treaties. You acknowledge that the Software and all related intellectual property rights are the sole and exclusive property of EmergiSim.
Restrictions. You may not modify, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software. You may not use the Software for any commercial purpose or for any illegal activity.
Termination. This Agreement is effective until terminated. You may terminate this Agreement at any time by destroying all copies of the Software in your possession. This Agreement will automatically terminate if you fail to comply with any term of this Agreement. Upon termination, you must destroy all copies of the Software in your possession.
Disclaimer of Warranties. EmergiSim provides the Software “as is” and without any warranty or condition, express, implied, or statutory. EmergiSim specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume all risk associated with the use of the Software.
Limitation of Liability. In no event shall EmergiSim be liable for any damages (including, without limitation, lost profits, business interruption, or lost information) rising out of ‘Authorized Users’ use of or inability to use the Software, even if EmergiSim has been advised of the possibility of such damages. In no event will EmergiSim be liable for loss of data or for indirect, special, incidental, consequential (including lost profit), or other damages based in contract, tort or otherwise. EmergiSim shall have no liability with respect to the content of the Software or any part thereof, including but not limited to errors or omissions contained therein, libel, infringements of rights of publicity, privacy, trademark rights, business interruption, personal injury, loss of privacy, moral rights or the disclosure of confidential information.
Miscellaneous. This Agreement represents the complete agreement concerning this license between the parties and supersedes all prior agreements and representations between them. This Agreement may be amended only by a writing executed by both parties. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable. The failure of EmergiSim to act with respect to a breach of this Agreement by you or others does not constitute a waiver and shall not limit EmergiSim’s rights with respect to such breach or any subsequent breaches.
