END USER LICENSE AGREEMENT (EULA) FOR BORDERWATCH: DARK ARMADA
PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE USING BORDERWATCH: DARK ARMADA ("THE SOFTWARE"). BY USING THE SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL OR USE THE SOFTWARE.
LICENSE
Subject to this EULA, we grant you a non-exclusive, non-transferable, limited license to use the Software for your personal, non-commercial use.
RESTRICTIONS
You agree that you will not, under any circumstances, do any of the following:
a. Sell, sublicense, distribute or make any other commercial use of the Software or any of its components.
b. Reverse engineer, decompile, disassemble, or create any derivative works from the Software.
c. Remove, alter or obscure any copyright, trademark or other proprietary notices from the Software or any of its components.
d. Use any cheat, hack or exploit in relation to the Software or its use.
e. Use the Software in any manner that violates any applicable laws or regulations.
TERM AND TERMINATION
This EULA will remain in effect until terminated by you or us. We may terminate this EULA immediately, without notice to you, if you breach any of the terms of this EULA. Upon termination of this EULA, you must immediately cease using the Software and destroy all copies of the Software in your possession.
DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
LIMITATION OF LIABILITY
WE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, ARISING OUT OF YOUR USE OF THE SOFTWARE.
INDEMNIFICATION
You agree to indemnify, defend, and hold us harmless from and against any and all claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys' fees, arising from or related to your use of the Software, your breach of this EULA or any other applicable terms.
GOVERNING LAW
This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which we are located, without giving effect to any choice of law or conflict of law provision.
ENTIRE AGREEMENT
This EULA constitutes the entire agreement between you and us regarding the use of the Software and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and us.
MODIFICATIONS
We reserve the right to modify this EULA at any time, without notice to you. Your continued use of the Software following any modifications to this EULA constitutes your acceptance of such modifications.
