zastosowanie z oprogramowaniem.
c. Zachowasz zgodność z określonąi w ramach procedury do momentu, gdy nagle i całkowicie wyłączysz korzystanie z gry, ponieważ spowoduje to, że jej elementy ze swojej maszyny , itp.).
d. Będziesz korzystać z gry tylko na jednej maszynie komputera, przy użyciu prawidłowej regulacji systemów operacyjnych, z myślą o których zaprojektowano grę („sprzętu”).

AZUMI GAMES udziela ci niewyłącznego, nieprzenośnego, odwoływalnego i wyłącznego prawa oraz licencji na jednej kopii gry, wyłącznie na własny użytek przy użytkowaniu sprzętu. Komercyjne wykorzystanie gry jest zabronione. Aby grać i/lub mieć dostęp do interfejsu sieciowej obsługującej z grą, musisz w legalny sposób korzystać z gry od AZUMI GAMES oraz dostarczać sprzęt i/lub grać firmy jej części sieciowej, wieloosobowej lub zawartości do pobrania (czego nie zapewniamy). Na to, że ponosisz odpowiedzialność za uiszczenie opłat i wspierasz opłaty za dostęp do Internetu oraz inne koszty ponoszone w celu uzyskania dostępu do części wieloosobowej, sieciowej lub zawartość do pobrania (jeśli ma zastosowanie). Ania zastosowania umowy, ani korzystania z gry nie dostawcy ci prawa do żadnej innej publikacji tej gry, jej rozszerzeń, kontynuacji lub wspólnego i dostarczania produktów. · Reverse engineer, source code, decompile, disassemble or create derivative works from the game or any online part thereof, whether in whole or in part.
Remove, disable or omit any proprietary notices or designations contained on or in the game or any online portion thereof.
· Export or re-export the game or its copies or adaptations in violation of any applicable French export restrictions or other laws and regulations.
4. PRECAUTIONS/SAFETY PRECAUTIONS.
You may be required to take certain precautions to fully enjoy the game's features, including, without limitation, requiring you to register your game with a serial number, requiring a permanent internet connection, and/or agreeing to security/rights management features. Refusing to agree to the precautions may prevent you from enjoying the game in part or in full.
5. ONLINE BEHAVIOR.
5.1 AZUMI GAMES does not review the content of user-generated content in online chats and assumes no responsibility for user-generated content in connection with the game. Nor is it responsible for any refusal to remove content or any delay in removing it. However, we reserve the right to remove or require a third party service provider to remove content that is unacceptable to us for any reason. This decision is solely up to us and is final. If AZUMI GAMES finds content created by you unacceptable, AZUMI GAMES may, at its discretion (either itself or through a request to a third party service provider): (i) remove the content; (ii) give a warning; (iii) restrict your access when you break the rules, or (iv) suspend or terminate your use of the game without warning. In addition, AZUMI GAMES may, at its sole discretion, terminate this Agreement or any part thereof immediately and without warning if your online conduct violates its terms or infringes any third party intellectual property rights, or if we are unable to verify or authenticate any you information. If we cancel this agreement in such circumstances, you will lose access to all online features of the game.
5.2 You agree to be personally responsible for how you use the game, and for all communications and activity in relation to the game, including content you provide, and that you will indemnify AZUMI GAMES, their licensors and each of their respective parents , affiliated companies and subsidiaries and the employees, officers and directors of each of them from any liability for any inconvenience or damage related to your behavior in connection with the game.
5.3 AZUMI GAMES retains the right to suspend your access to the game without notice if you breach this license agreement. A breach will occur if you or others using your online account do any of the following:
Posting, uploading, promoting or distributing content that violates any law or provision.
· Harass, threaten, embarrass or take any other unwelcome action against other users.
· Uploading or facilitating the distribution of content that is harmful, prejudicial, racially or ethnically offensive, vulgar, pornographic, defamatory, invasive of someone's rights, invasive of someone's privacy or publicity rights, or otherwise objectionable to a reasonable person. Hate speech is not tolerated.
· Violation of any of the rules that AZUMI GAMES informs from time to time.
· Promoting or encouraging any illegal activity
any activity, including hacking.
· Sharing personal information - your own or other users'.
· Impersonating any other person or company, including AZUMI GAMES employees, forum hosts, guides, hosts or agents, or implying your affiliation with another person or company.
· Obstructing or preventing the game or the normal flow of the game or dialogues, using strong language, harassment, excessive shouting (CAPS), "spamming", or any other inappropriate method to disturb other users.
· Cheating or exploiting unauthorized vulnerabilities in connection with the game.
· Exploiting any bugs or manufacturing defects to gain unauthorized access to the game or gain an unfair advantage over other players.
Buying, selling, auctioning or otherwise transferring any virtual items or goods of any nature outside of the game.
Violate any applicable laws (including but not limited to copyright and trademark laws), agreements and rules when using the game. This includes the use of third-party technology and content, the policies of interactive service providers, and applicable federal, state, local, and foreign laws. Ignorance of the law does not exempt from responsibility.
· Taking any action that prevents others from enjoying the game according to its rules, or any action that increases material cost or difficulty for AZUMI GAMES or the third party providing the service in a way that is appropriate for all users.
· Deliberately disconnecting from the network during an online game or allowing another player to win all the time to help them improve their rankings and increase their win count.
6. USER-GENERATED CONTENT
In return for your use of the game, and to the extent that your contribution to the game by using it creates any copyright, you hereby grant to AZUMI GAMES an exclusive, perpetual, irrevocable, free, fully transferable and sublicensable and worldwide the right to use your contributions in any way and for any purpose related to the game and related goods and services, including the right to reproduce, copy, adapt, modify, perform, create derivative works from, publicly perform, publish, broadcast, transmit or otherwise distribute, exploit, use and make available to the public in any manner and through any media both existing and to be created in the future without the need to inform you or compensate you for the entire duration of copyright protection under applicable law and international treaties. To the extent permitted by applicable law, you waive all moral rights of authorship, publication, credit and association in connection with the use and enjoyment of your works by AZUMI GAMES or other players in connection with the game and related goods and services, in accordance with with applicable law. The license grant to AZUMI GAMES and the waiver of all moral rights in the work will survive the cancellation or revocation of this EULA.
7. LIMITATION OF DAMAGES.
7.1 Azumi Games, its company, branches, suppliers or agents are excluded from liability for all special, accidental, indirect, sample, penalty, or being a consequence of other activities resulting from possession, use or inability to use the game or inability to provide support for support EVEN IF THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. 7.2 AZUMI GAMES AND ITS LICENSORS MAKE NO PROMISES OR WARRANTIES THAT THE GAME WILL FUNCTION. YOU ACKNOWLEDGE AND AGREE THAT AZUMI GAMES AND ITS LICENSORS ARE NOT RESPONSIBLE FOR (1) ANY VIRUSES OR OTHER HARMFUL FEATURES AFFECTING YOUR ACCESS OR USE OF THE GAME, (2) ANY INCOMPATIBILITIES BETWEEN GAMES AND OTHERS (3) ANY DELAYS OR FAILURES THAT MAY OCCUR IN STARTING
ENROLLING, CARRYING OUT, OR COMPLETING ANY TRANSMISSIONS OR TRANSACTIONS RELATED TO THE GAME IN ACCURATE AND QUICK MANNER. THE GAME AND ALL OTHER SERVICES ARE PROVIDED "AS IS". EXCEPT AS SET FORTH IN THIS AGREEMENT AND IN THE LIMITED WARRANTY INCLUDED WITH THE GAME, AZUMI GAMES AND ITS LICENSORS AND SUPPLIERS MAKE NO WARRANTIES OR CONDITIONS, WHETHER EXPRESS, IMPLIED OR LEGAL, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF TITLE, FOR A SPECIFIC PURPOSE. AZUMI GAMES does not ensure the continuous, error-free, secure and virus-free operation of any online and multiplayer portion of the game or downloadable content, or the continuous operation or availability of any of its servers.
7.3 AZUMI GAMES shall not be liable for any delay or failure to operate due to any factors beyond our control. In addition, AZUMI GAMES cannot promise or ensure that you will have access to online and multiplayer portions of the game or downloadable content at all times. You may not be able to access them at certain times.
8. CANCELLATION/SUSPENSION OF POINTS. Notwithstanding any other rights of AZUMI GAMES, if you fail to comply with the terms of this agreement, including but not limited to the conduct listed in section 5.3 of this user license, AZUMI GAMES reserves the right to immediately suspend or terminate this EULA or reduce the amount of credited points without prior notice. You do not own the rights to the points awarded in the game.
If AZUMI GAMES cancels this EULA or suspends your access to the game as set out above: (i) you will lose access to the game upon cancellation and/or during the suspension period and/or (ii) you will forfeit all all money and/or credits credited to your account . If the game is cancelled, you must destroy all copies of the game and its component parts.
9. PRIVACY. AZUMI GAMES respects your right to privacy and attaches great importance to the protection of your data. Any personal information you provide to AZUMI GAMES over the network or any AZUMI GAMES controlled website will be governed by the privacy policy available at http://www.bandainamcogames.eu. In addition to this privacy policy, if you use any online services, such as online gaming or downloading or uploading content, AZUMI GAMES and its affiliated companies may also collect, use, store, transmit and make publicly available game statistics (including scores, rankings and achievements ) or identify content you create and share with other players.
10. ORDER. Since failure to enforce the terms of this agreement would cause irreparable damage to AZUMI GAMES, you agree that AZUMI GAMES and/or its licensors will be entitled (without warranties, other indemnities or evidence of damages) to collect appropriate amounts for breach of this agreement in addition to any damages that may be be entitled to AZUMI GAMES in accordance with applicable law.
11. DISCLAIMER. You agree to indemnify and defend AZUMI GAMES, its licensors and each of their partners, affiliates, contractors, officers, directors, employees and agents in the event of any damages, losses and costs related directly or indirectly to your actions or lack of activity related to the use of the game in accordance with the terms of this agreement.
12. APPLICABLE LAW AND JURISDICTION. This agreement must be interpreted in accordance with the laws of France. Any disputes arising out of this agreement which, despite best efforts, cannot be resolved by settlement, shall be resolved in accordance with the provisions of the Lyon Commercial Court.
13. OTHER PROVISIONS. If any section of this agreement is deemed invalid or unenforceable, it will be deleted and the remaining sections will continue to apply. AZUMI GAMES' failure to act with respect to breaches by you or others does not deprive it of its right to act in the event of subsequent or similar breaches. You may not assign or transfer this agreement or your rights herein, and any attempt to do so will be null and void. This Agreement represents the full understanding and agreement between AZUMI GAMES and you regarding its subject matter.
14. LINK TO OTHER TERMS OF USE. This agreement applies to all online services, content, games and products and may be incorporated into additional terms of use specific to that game. In the event of a conflict between the content of the contract and the content of these terms and conditions, the terms of the contract will prevail (unless the terms of the terms clearly state otherwise).

Hate speech is not tolerated.
· Violation of any of the rules that AZUMI GAMES informs from time to time.
· Promoting or encouraging any illegal activity
any activity, including hacking.
· Sharing personal information - your own or other users'.
· Impersonating any other person or company, including AZUMI GAMES employees, forum hosts, guides, hosts or agents, or implying your affiliation with another person or company.
· Obstructing or preventing the game or the normal flow of the game or dialogues, using strong language, harassment, excessive shouting (CAPS), "spamming", or any other inappropriate method to disturb other users.
· Cheating or exploiting unauthorized vulnerabilities in connection with the game.
· Exploiting any bugs or manufacturing defects to gain unauthorized access to the game or gain an unfair advantage over other players.
Buying, selling, auctioning or otherwise transferring any virtual items or goods of any nature outside of the game.
Violate any applicable laws (including but not limited to copyright and trademark laws), agreements and rules when using the game. This includes the use of third-party technology and content, the policies of interactive service providers, and applicable federal, state, local, and foreign laws. Ignorance of the law does not exempt from responsibility.
· Taking any action that prevents others from enjoying the game according to its rules, or any action that increases material cost or difficulty for AZUMI GAMES or the third party providing the service in a way that is appropriate for all users.
· Deliberately disconnecting from the network during an online game or allowing another player to win all the time to help them improve their rankings and increase their win count.
6. USER-GENERATED CONTENT
In return for your use of the game, and to the extent that your contribution to the game by using it creates any copyright, you hereby grant to AZUMI GAMES an exclusive, perpetual, irrevocable, free, fully transferable and sublicensable and worldwide the right to use your contributions in any way and for any purpose related to the game and related goods and services, including the right to reproduce, copy, adapt, modify, perform, create derivative works from, publicly perform, publish, broadcast, transmit or otherwise distribute, exploit, use and make available to the public in any manner and through any media both existing and to be created in the future without the need to inform you or compensate you for the entire duration of copyright protection under applicable law and international treaties. To the extent permitted by applicable law, you waive all moral rights of authorship, publication, credit and association in connection with the use and enjoyment of your works by AZUMI GAMES or other players in connection with the game and related goods and services, in accordance with with applicable law. The license grant to AZUMI GAMES and the waiver of all moral rights in the work will survive the cancellation or revocation of this EULA.
7. LIMITATION OF DAMAGES.
7.1 Azumi Games, its company, branches, suppliers or agents are excluded from liability for all special, accidental, indirect, sample, penalty, or being a consequence of other activities resulting from possession, use or inability to use the game or inability to provide support for support EVEN IF THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. THIS LIMITATION WILL APPLY REGARDLESS OF THE THEORY OF LIABILITY, WHETHER IT IS RELATED TO FRAUD, IMPOSEATION, BREACH OF CONTRACT, NEGLIGENCE, PERSONAL INJURY, PRODUCT DEFECTIVE, INFRINGEMENT OF INTELLECTUAL PROPERTY, OR OTHERWISE. IN ANY CASE, THE LIABILITY OF AZUMI GAMES AND ITS LICENSORS UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE GAME.
7.2 AZUMI GAMES AND ITS LICENSORS MAKE NO PROMISES OR WARRANTIES THAT THE GAME WILL FUNCTION. YOU ACKNOWLEDGE AND AGREE THAT AZUMI GAMES AND ITS LICENSORS ARE NOT RESPONSIBLE FOR (1) ANY VIRUSES OR OTHER HARMFUL FEATURES AFFECTING YOUR ACCESS OR USE OF THE GAME, (2) ANY INCOMPATIBILITIES BETWEEN GAMES AND OTHERS (3) ANY DELAYS OR FAILURES THAT MAY OCCUR IN STARTING
ENROLLING, CARRYING OUT, OR COMPLETING ANY TRANSMISSIONS OR TRANSACTIONS RELATED TO THE GAME IN ACCURATE AND QUICK MANNER. THE GAME AND ALL OTHER SERVICES ARE PROVIDED "AS IS". EXCEPT AS SET FORTH IN THIS AGREEMENT AND IN THE LIMITED WARRANTY INCLUDED WITH THE GAME, AZUMI GAMES AND ITS LICENSORS AND SUPPLIERS MAKE NO WARRANTIES OR CONDITIONS, WHETHER EXPRESS, IMPLIED OR LEGAL, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF TITLE, FOR A SPECIFIC PURPOSE. AZUMI GAMES does not ensure the continuous, error-free, secure and virus-free operation of any online and multiplayer portion of the game or downloadable content, or the continuous operation or availability of any of its servers.
7.3 AZUMI GAMES shall not be liable for any delay or failure to operate due to any factors beyond our control. In addition, AZUMI GAMES cannot promise or ensure that you will have access to online and multiplayer portions of the game or downloadable content at all times. You may not be able to access them at certain times.
8. CANCELLATION/SUSPENSION OF POINTS. Notwithstanding any other rights of AZUMI GAMES, if you fail to comply with the terms of this agreement, including but not limited to the conduct listed in section 5.3 of this user license, AZUMI GAMES reserves the right to immediately suspend or terminate this EULA or reduce the amount of credited points without prior notice. You do not own the rights to the points awarded in the game.
If AZUMI GAMES cancels this EULA or suspends your access to the game as set out above: (i) you will lose access to the game upon cancellation and/or during the suspension period and/or (ii) you will forfeit all all money and/or credits credited to your account . If the game is cancelled, you must destroy all copies of the game and its component parts.
9. PRIVACY. AZUMI GAMES respects your right to privacy and attaches great importance to the protection of your data. Any personal information you provide to AZUMI GAMES over the network or any AZUMI GAMES controlled website will be governed by the privacy policy available at http://www.bandainamcogames.eu. In addition to this privacy policy, if you use any online services, such as online gaming or downloading or uploading content, AZUMI GAMES and its affiliated companies may also collect, use, store, transmit and make publicly available game statistics (including scores, rankings and achievements ) or identify content you create and share with other players.
10. ORDER. Since failure to enforce the terms of this agreement would cause irreparable damage to AZUMI GAMES, you agree that AZUMI GAMES and/or its licensors will be entitled (without warranties, other indemnities or evidence of damages) to collect appropriate amounts for breach of this agreement in addition to any damages that may be be entitled to AZUMI GAMES in accordance with applicable law.
11. DISCLAIMER. You agree to indemnify and defend AZUMI GAMES, its licensors and each of their partners, affiliates, contractors, officers, directors, employees and agents in the event of any damages, losses and costs related directly or indirectly to your actions or lack of activity related to the use of the game in accordance with the terms of this agreement.
12. APPLICABLE LAW AND JURISDICTION. This agreement must be interpreted in accordance with the laws of France. Any disputes arising out of this agreement which, despite best efforts, cannot be resolved by settlement, shall be resolved in accordance with the provisions of the Lyon Commercial Court.
13. OTHER PROVISIONS. If any section of this agreement is deemed invalid or unenforceable, it will be deleted and the remaining sections will continue to apply. AZUMI GAMES' failure to act with respect to breaches by you or others does not deprive it of its right to act in the event of subsequent or similar breaches. You may not assign or transfer this agreement or your rights herein, and any attempt to do so will be null and void. This Agreement represents the full understanding and agreement between AZUMI GAMES and you regarding its subject matter.
14. LINK TO OTHER TERMS OF USE. This agreement applies to all online services, content, games and products and may be incorporated into additional terms of use specific to that game. In the event of a conflict between the content of the contract and the content of these terms and conditions, the terms of the contract will prevail (unless the terms of the terms clearly state otherwise).
