PatchWorld Terms of Use

1. Who We Are
PatchXR AG, Chriesbaumstrasse 6, 8604 Volketswil, Switzerland, CHE-316.817.994 (“PatchXR”, “we”, “us”) operates PatchWorld, including the PatchWorld application, backend services, web portal (https://portal.patchxr.io), and related tools (the “Service”).
2. Eligibility and Accounts
PatchWorld is available on multiple platforms, including desktop versions for macOS and Windows (via Xsolla) and VR platforms such as Meta Quest, SteamVR, HTC Vive, and Pico.
Accessing PatchWorld on a platform may create a platform-specific user account. By default, accounts created on different platforms are separate.
Users may optionally create or log in with a PatchXR account to access the Service across platforms. Only when the same PatchXR account is used are eligible projects, Content, Vibz, and assets shared across supported platforms.
Platform provider accounts (e.g. Meta) cannot be used to log in to other platform versions (e.g. Steam). Content, Vibz, and assets associated with one account are not available on another unless explicitly supported or linked by PatchXR.
Users are responsible for how accounts are created and used. PatchXR is not responsible for loss of access to Content, Vibz, or assets resulting from separate or unlinked accounts.
3. The Service
PatchWorld is a creative platform for exploring, creating, performing, sharing, and experiencing virtual worlds and audio-visual content, including user-generated content (“UGC”) and optional AI-assisted creation tools.
We may modify, update, limit, or discontinue parts of the Service at any time.
You acknowledge that you have no right to continued availability of the Service, any specific feature, tool, Content, storage, or version. PatchXR is not obligated to maintain or support older versions of the Service.
To the maximum extent permitted by law, PatchXR is not liable for any loss, deletion, corruption, or unavailability of Content, projects, recordings, assets, Vibz, or other data, whether due to Service changes, maintenance, technical failure, moderation actions, or account termination. Users are responsible for maintaining their own backups of any Content they wish to retain.
We may update these Terms from time to time. Where changes are material, we will make reasonable efforts to notify registered users (for example, in-app or via email).
Continued use of the Service after such notice constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
4. License to Use PatchWorld
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

“Content” includes all media, assets, worlds and virtual devices (.patch), audio, images, videos, text, 3D files (.glb), recordings, AI outputs, and other materials created, uploaded, generated, modified, shared, or exported through the Service.
You may upload and download Content via the PatchWorld web portal (https://portal.patchxr.io).
For clarity, content uploaded through the PatchWorld web portal is also considered Content uploaded through the Service, and you represent and warrant that you own or have all necessary rights to such Content.
You are solely responsible for:

7. Ownership and License to PatchXR
You retain ownership of your Content to the extent you have it.
By uploading or publishing Content, you grant PatchXR a non-exclusive, worldwide, royalty-free, irrevocable (to the extent permitted by law), sublicensable license to host, store, process, modify (for technical purposes), display, distribute, and promote the Content solely to operate, secure, moderate, and improve the Service.
“Modify” includes technical transformations such as compression, transcoding, formatting, previews, thumbnails, and compatibility adjustments.
8. Rights Granted to Other Users
If you publish Content, other users may access and use it inside PatchWorld according to your chosen visibility and technical settings.
If Content is offered in exchange for Vibz, the recipient receives a limited, in-app license only.
No ownership or off-platform rights are transferred unless explicitly stated.
Users retain ownership of Content they create, including Content recorded or exported from the Service, to the extent they hold such rights.
When Content is exported, published, or used outside PatchWorld, the user is solely responsible for ensuring that such use complies with applicable laws and third-party rights. PatchXR is not responsible for claims, takedowns, or disputes arising from off-platform use of exported Content.
9. AI-Assisted Creation
PatchWorld includes optional AI tools that generate Content using third-party AI services via API.
You acknowledge:

We process personal data in accordance with our Privacy Policy.
We do not sell user data. Users may request correction or deletion as described in the Privacy Policy.
14. Third-Party Platforms
If you access PatchWorld via third-party platforms (e.g. Steam, Meta), you must comply with their rules. Where conflicts exist, the more restrictive rule may apply.
15. Disclaimers
The Service is provided “as is” and “as available.” PatchXR does not guarantee uninterrupted operation or endorse user Content.
16. Limitation of Liability
To the maximum extent permitted by law, PatchXR is not liable for indirect, incidental, or consequential damages.
17. Indemnification
You agree to indemnify and hold PatchXR harmless from claims arising from your Content, violations of law, or these Terms.
18. Termination
PatchXR may suspend or terminate access at any time. Vibz and access to Content may be forfeited as permitted by law.
19. Governing Law
Swiss law applies. Exclusive jurisdiction: courts at PatchXR’s registered seat.

4. License to Use PatchWorld

- reverse engineer or attempt to extract source code (except as permitted by law),
- bypass security or enforcement mechanisms,
- use the Service to build or operate a competing platform,
- access, scrape, crawl, or download Content or Service data using automated tools (bots, spiders, crawlers), unless permitted by PatchXR.
5. Virtual Currency (Vibz)
- Vibz are virtual, in-app points usable only within PatchWorld.
- Vibz are not redeemable and cannot be converted to real money.
- Vibz may be purchased, earned through in-app transfers (e.g. tips), or earned through publishing assets.
- Vibz are non-transferable except where explicitly allowed inside the Service.
- We may modify, revoke, or adjust Vibz balances in cases of fraud, chargebacks, or policy violations.
- Refunds are governed by applicable law and, where applicable, third-party store policies (e.g. Steam, Meta).
- Creators are responsible for handling complaints about content they charge for.
- No gambling or cash-out is permitted.
6. User-Generated Content and Uploads
“Content” includes all media, assets, worlds and virtual devices (.patch), audio, images, videos, text, 3D files (.glb), recordings, AI outputs, and other materials created, uploaded, generated, modified, shared, or exported through the Service.
You may upload and download Content via the PatchWorld web portal (https://portal.patchxr.io).
For clarity, content uploaded through the PatchWorld web portal is also considered Content uploaded through the Service, and you represent and warrant that you own or have all necessary rights to such Content.
You are solely responsible for:
- owning or having sufficient rights to all Content you upload, generate, publish, or export,
- ensuring Content does not infringe copyright, trademark, likeness, publicity, or privacy rights,
- paying any royalties or fees required for your Content (including collection societies).
PatchXR does not pre-screen Content but may moderate it.
7. Ownership and License to PatchXR
You retain ownership of your Content to the extent you have it.
By uploading or publishing Content, you grant PatchXR a non-exclusive, worldwide, royalty-free, irrevocable (to the extent permitted by law), sublicensable license to host, store, process, modify (for technical purposes), display, distribute, and promote the Content solely to operate, secure, moderate, and improve the Service.

9. AI-Assisted Creation
PatchWorld includes optional AI tools that generate Content using third-party AI services via API.
You acknowledge:
- PatchXR does not train AI models on user content.
- AI outputs may not be original or non-infringing.
- You are responsible for prompts, inputs, and publishing AI outputs.
- PatchXR does not provide tools intended to generate specific real-person likenesses or voices.
We may restrict prompts, limit generation, remove AI outputs, or suspend access to comply with law and platform rules.
10. Prohibited Content and Conduct
You may not create, upload, publish, or share Content that:
- is pornographic or sexually exploitative (especially involving minors),
- depicts or glorifies extreme violence, torture, rape, or animal abuse,
- promotes suicide, self-harm, or eating disorders,
- is hateful, harassing, threatening, or discriminatory,
- supports terrorism, organized hate, or organized violence,
- is fraudulent, deceptive, or used for scams,
- facilitates sale of regulated goods (drugs, firearms, explosives),
- makes medical or health treatment claims or presents the Service as a medical device,
- exploits sensitive real-world tragedies or crises,
- infringes intellectual property or likeness rights,
- contains malware or malicious code,
- ban evasion or re-registering after account termination,
- cheating or exploits affecting other users or the Service,
- attempts to overload or disrupt the Service.
11. Reporting, Takedown, and Repeat Violators
- Users may report Content or users in-app, via email, or through official community channels.
- PatchXR may remove or restrict Content during investigation.
- We maintain a repeat infringer / repeat violator policy and may permanently terminate accounts for repeated violations.
- PatchXR may disclose user information where required by law or to protect users or the Service.
- Deleting Content may not immediately remove all copies (e.g. backups or logs).
12. Moderation and Enforcement
PatchXR may remove Content, restrict visibility, disable features, or suspend or terminate accounts with or without prior notice where necessary.
13. Privacy and Data

We do not sell user data. Users may request correction or deletion as described in the Privacy Policy.
