End-User License Agreement (EULA) for Cyber Skirmish
1. Introduction
This End-User License Agreement ("Agreement") is a legal document between you ("User") and WePanMi Interactive ("Company") regarding the use of the game "Cyber Skirmish" ("Game"). By installing or using the Game, you agree to comply with the terms outlined in this Agreement. If you do not agree, do not install or use the Game.
2. License Grant
The Company grants you a non-exclusive, non-transferable, revocable license to install and use the Game for personal, non-commercial purposes on compatible devices owned or controlled by you, subject to the terms of this Agreement.
3. Ownership and Intellectual Property
All rights, titles, and interests in and to the Game, including but not limited to content, graphics, virtual items, and code, are owned by the Company or its licensors. This Agreement does not grant you any ownership rights; all rights are reserved by the Company.
4. User Conduct
You agree not to:
Use cheats, automation software (bots), hacks, mods, or any unauthorized third-party software designed to modify or interfere with the Game.
Exploit the Game or any of its parts for commercial purposes without the Company's consent.
Engage in disruptive behavior, including harassment, abusive language, spamming, or any actions that negatively affect other users' experiences.
Attempt to gain unauthorized access to the Game's systems, accounts, or networks.
Reverse engineer, decompile, disassemble, or modify the Game.
5. User-Generated Content
The Game may allow you to create or submit content ("User-Generated Content" or "UGC"). By submitting UGC, you grant the Company a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, distribute, and display such content within the Game and related marketing materials. You represent that you have the necessary rights to grant this license and that your UGC does not infringe upon third-party rights.
6. Virtual Items and Purchases
The Game may include virtual items or currencies available for purchase or earned through gameplay. These items are licensed to you and remain the property of the Company. Virtual items have no real-world value and cannot be exchanged for real currency or other items outside the Game. All purchases are final and non-refundable, except as required by applicable law.
7. Updates and Modifications
The Company may provide updates, patches, or modifications to the Game, which may be necessary for continued use. These updates may modify or delete certain features, and you agree that the Company has no obligation to maintain or provide specific features of the Game.
8. Termination
This Agreement is effective until terminated. The Company may terminate your access to the Game at any time, with or without cause, including if you violate this Agreement. Upon termination, you must cease all use of the Game and delete all copies from your devices.
9. Disclaimer of Warranties
The Game is provided "as is" without warranties of any kind, either express or implied. The Company does not warrant that the Game will be uninterrupted, error-free, or free from harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of or inability to use the Game.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Poland, Greater Poland, without regard to its conflict of law principles.
12. Changes to the Agreement
The Company reserves the right to modify this Agreement at any time. Changes will be effective upon posting the updated Agreement within the Game or on the official website. Continued use of the Game after such changes constitutes your acceptance of the new terms.
