END USER LICENSE AGREEMENT

Please read the following End User License Agreement (EULA) before installing the game software whose license you have just acquired (hereinafter, "game software").
The EULA is a legal contract between the user and THE GAME KITCHEN, SL, a company registered in Seville (Spain), with VAT number B91885707, for the use of the video game ALL ON BOARD! ("game software").
By downloading, installing, accessing, or using the game software, the user agrees to be legally bound by the terms of this EULA. IF YOU AGREE TO THE TERMS SET FORTH IN THIS EULA, select "ACCEPT." If you do not agree, do not download, install, or use the game software; IF YOU DO NOT ACCEPT THE TERMS SET FORTH IN THIS EULA, select "CANCEL," and THE GAME KITCHEN will not grant you the license for the game software.
LIMITED USE LICENSE
1. License Grant.The term “game software” includes the software contained in this video game, associated media, any software related to the online mode of the video game (subject to any additional terms of use applicable to such online mode), printed materials, manuals, any online or electronic documentation, and all copies of such software and materials.
2. THE GAME KITCHENgrants the user a limited, non-exclusive, revocable, and non-transferable license to download, install, and use the game software for personal and non-commercial use, in accordance with the terms of this EULA.
3. Restrictions. The user may not:
- Copy, modify, or distribute the game software or any part of it;
- Reverse-engineer, derive source code from, modify, adapt, translate, decompile, or disassemble it, or create derivative works based on it (except as expressly permitted by applicable law, in which case any and all modifications, adaptations, improvements, etc. that are lawful, and all intellectual property rights to them, will be deemed assigned to and shall belong to, be conferred upon, and be the exclusive property of THE GAME KITCHEN and/or its licensors in all cases);
- Remove, disable, bypass, or modify any proprietary notice, label, or security technology included in it;
- Rent, lease, lend, sublicense, sell, or otherwise transfer it;
- Use the game for any commercial purpose, including but not limited to tournaments or competitions for profit;
- Use the game software to create derivative products or content that infringes the intellectual property, publicity, or privacy rights of THE GAME KITCHEN or any third party;
- Use, export, or re-export it in violation of any applicable law or regulation;
- Engage in behaviour detrimental to other users’ enjoyment of the game software or services as intended by THE GAME KITCHEN, at THE GAME KITCHEN’s sole discretion, including but not limited to cheating, harassment, use of offensive or intimidating language, quitting the game, sabotaging gameplay, sending spam or junk messages, social engineering, or scams.
4. Updates THE GAME KITCHEN may provide updates, patches, or modifications to the game software. These updates may be automatic or require the user’s authorization. All updates will be subject to the terms of this EULA.
<INTELLECTUAL PROPERTY
1. Ownership. The user acknowledges and agrees that all ownership, title, and intellectual property rights in and to the game software and any copies thereof (including its features, derivative works, titles, computer code, themes, objects, characters, character names, stories, dialogues, slogans, locations, concepts, artwork, graphics, animations, sounds, musical compositions, audiovisual effects, text, screen displays, operational methods, moral rights, downloadable content, graphics, music, and any other part of the game software) are owned by THE GAME KITCHEN or its licensees and licensors. This EULA does not grant the user any rights to the intellectual property of the game software, except for the limited usage rights granted under this agreement.
2. Trademarks.The user may not use, modify, or remove any trademarks, logos, trade names, or other proprietary notices of THE GAME KITCHEN without prior written consent.
PRIVACY
Use of the game software may require you to provide personal information. THE GAME KITCHEN will collect and use such information in accordance with its Privacy Policy, which can be reviewed at the following link: https://thegamekitchen.com/privacy-policy/. By accepting this EULA, the user also agrees to the terms of the Privacy Policy.
LIMITED WARRANTY
If the software is properly installed and used under normal conditions, it will provide the functionalities specified in the documentation accompanying the software, though it may contain normal errors. Therefore, the software is provided “as is” and with the understanding that patches and updates will be provided periodically. This warranty is valid only for the original purchaser of the software. If the game software is defective, the user may request a replacement from THE GAME KITCHEN or the platform where the game software was purchased, free of charge. The user must keep the original or a photocopy of the dated purchase receipt to determine the date of purchase and receive replacement software covered by the warranty.
This Limited Warranty does not apply if the defects are caused by the user’s negligence, accident, misuse, modification, alteration, or any other causes unrelated to defective materials or workmanship, and THE GAME KITCHEN and its licensors shall not be liable for any damage, injury, or loss resulting from such causes.
LIMITATION OF LIABILITY
Neither THE GAME KITCHEN nor its licensors and/or licensees will be liable for any damages arising from the possession, use, or failure of the game software (including but not limited to loss or damages related to or consisting of lost profits, property damage, lost or damaged data or files, loss of goodwill, console, PC, or handheld device failures, errors, and loss of business or other information as a result of the possession, use, or failure of the game, or personal injury), even if THE GAME KITCHEN has been advised of the possibility of such losses or damages.
THE GAME KITCHEN’s total liability in all cases will not exceed the actual price paid for the game software.
MODIFICATIONS TO THE EULA
THE GAME KITCHEN reserves the right to modify the EULA at any time. Modifications will be posted at https://thegamekitchen.com/ or notified to the user via the game. Continued use of the software following such modifications will be considered acceptance of the new terms and conditions.
TERM
Notwithstanding any other rights of THE GAME KITCHEN, the license will remain in effect as long as the user uses, operates, or runs the game software. The license will automatically terminate if the user fails to comply with the terms and conditions. The user may also terminate the license at any time by destroying the game software and uninstalling it from the device.
COMPENSATION
The user agrees to indemnify, defend, and hold harmless THE GAME KITCHEN, its partners, affiliates, contractors, licensees, and licensors, as well as their officers, directors, employees, and representatives from any claims, damages, costs, and expenses arising directly or indirectly from their acts or omissions related to the use of the game software or any breach by the user of the terms of this EULA.
GOVERNING LAW AND JURISDICTION
The EULA will be governed by and construed in accordance with Spanish law. Specifically, the game software is protected by Spanish intellectual property laws (RDL 1/1996, Intellectual Property Law), Spanish trademark laws (Law 17/2001 on Trademarks), international intellectual property and trademark treaties, and other laws. All rights are reserved worldwide. The game software contains certain third-party materials licensed by THE GAME KITCHEN, and THE GAME KITCHEN and its licensors may enforce their rights in the event of any violation of this EULA.
Any disputes related to this EULA will be resolved in the competent courts of Seville, Spain.
MISCELLANEOUS
This EULA constitutes the entire agreement between the user and THE GAME KITCHEN regarding the license and the user’s rights to use the game software, and it supersedes all prior agreements, representations, warranties, or understandings between the user and THE GAME KITCHEN (whether negligently or innocently made, but excluding those made fraudulently) regarding the same subject matter. If any provision of this EULA is deemed unenforceable for any reason, such provision shall be modified to the extent necessary to make it enforceable, and the remaining provisions of this EULA shall remain in full force and effect.
