1 End User License Agreement
1.1 This End User License Agreement (hereinafter referred to as "EULA") is for games provided by PULSMO,INC. (hereinafter referred to as "PULSMO") on the service "Steam" managed and operated by Valve Corporation. This is an agreement between the customer who uses the game application (hereinafter referred to as "this software") and PULSMO, which defines the terms and conditions regarding the use of this software.
1.2 By installing and using the software you agree to the EULA. If you do not agree to the EULA, you may not use this software.
1.3 If you are a minor or have limited capacity to act, you shall obtain the consent of an appropriate administrator such as a person with parental authority regarding the contents of the EULA before installing this software.
2 License
Pursuant to the EULA, PULSMO may use a single device (limited to devices that can use Steam; hereinafter referred to as the "target device") on which you use this software for non-commercial and private purposes. Only in this case, we license the installation and use of this software on a non-exclusive, non-transferable basis until the customer terminates use of this software.
3 Prohibitions
3.1 Notwithstanding any other provision of this EULA, the following acts are prohibited.
(a) use the Software for any commercial purpose, i.e. to generate any direct or indirect economic benefit, without the prior written consent of PULSMO;
(b) Acts that may infringe on the intellectual property rights of PULSMO, such as duplicating, altering, remodeling, translating, analyzing, reverse engineering, or extracting codes from this software.
(c) circumvent any technical protection measures used in the Software;
(d) remove or alter any trademark, logo, copyright notice or other notice contained in the Software;
(e) Acts that are disadvantageous to PULSMO that are equivalent to or similar to the acts set forth in the preceding items.
3.2 In the event you breaches any of the prohibitions in the preceding paragraph, this EULA shall immediately terminate, and you shall permanently delete the Software (including all copies) by uninstalling the Software from the Applicable Devices or other means.
4 Intellectual Property Rights
4.1 Copyrights and other intellectual property rights to all information related to this software belong to PULSMO or right holders who have licensed PULSMO to use them.
4.2 PULSMO only grants the Customer the right to use the Software based on the EULA, and the EULA does not transfer the intellectual property rights, ownership rights, or other rights of the Software to the Customer. All rights not expressly granted to you by the EULA are reserved by PULSMO.
5 Disclaimer
5.1 The Software is provided on an “As Is” basis. To the extent permitted by applicable law, PULSMO makes no warranties, express or implied, with respect to any matter including the following, (including liability for contractual non-conformity of rights, liability for contractual non-conformity of goods, fitness for particular purpose and guarantee against non-infringement of rights).
(a) That there will be no interruptions and/or errors in the Software.
(b) That the Software is accurate, complete, reliable, current or error free and that it contains no viruses or other harmful elements.
5.2 You may claim for compensation for damages against PULSMO for damages caused by or in connection with use of the Software provided only that such damages can be attributable to PULSMO. To the extent permitted by applicable law, you shall agree to the following unless damages incurred are caused by willful misconduct or gross negligence on the part of PULSMO.
(a) Any damages to be compensated for shall be limited to any actual,direct and ordinary damage that can be attributable to PULSMO.
(b) Cumulative damages paid by PULSMO to you will not exceed the total amount of money paid by your to PULSMO in relation to The Software.
6 Severability
In the event this EULA is determined to be in conflict with any law or regulation or to be unenforceable, such provision shall be deemed void to the extent it is determined to be in conflict with such law or unenforceable, and all other provisions of the EULA shall remain in full force and effect.
7 Entire Agreement
This EULA constitutes the entire agreement between PULSMO and you with respect to its subject matter, and supersedes all prior written or oral agreements.
8 Governing Law and Jurisdiction
This EULA shall be governed by and construed in accordance with the laws of Japan. All disputes between PULSMO and you arising out of or in connection with this EULA will be submitted to the exclusive jurisdiction of the Tokyo District Court in the first instance.
