End User License Agreement ("EULA")
IMPORTANT: Please read this end user license agreement ("EULA") carefully before installing or using Treasure Hunter VR (the "game"). By installing or using the game, you agree to be bound by the terms and conditions of this EULA. If you do not agree to the terms and conditions of this EULA, do not install or use the game.
• License
Subject to the terms and conditions of this EULA, LAZY-DAYS LLC ("Licensor") grants you a limited, non-exclusive, non-transferable, and non-sub licensable license to install and use the Game for your personal, non-commercial use on a single virtual reality device. The license is effective until terminated by you or Licensor in accordance with this EULA.
• Restrictions
You may not copy, distribute, sell, rent, lease, or sublicense the Game or any part of it. You may not reverse engineer, decompile, or disassemble the Game, except to the extent that such activity is expressly permitted by applicable law. You may not modify, adapt, translate, or create derivative works based on the Game.
• Ownership
The Game and all intellectual property rights therein are and shall remain the exclusive property of Licensor. Licensor reserves all rights not expressly granted to you in this EULA. The Game is protected by copyright and other intellectual property laws and treaties. You acknowledge that you have no right to have access to the Game in source code form.
• Warranty Disclaimer
The game is provided "as is," without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with the game, including without limitation the software licensed to you and the results obtained through the game. Specifically, we disclaim any and all warranties, including without limitation: 1) any warranties concerning the availability, accuracy, usefulness, or content of information, products or services, and 2) any warranties of title, warranty of non-infringement, warranties of merchantability or fitness for a particular purpose.
• Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall licensor be liable for any indirect, incidental, special, exemplary, or consequential damages (including, without limitation, loss of use, data, profits, or business interruption) arising out of or in connection with the game, regardless of whether licensor has been advised of the possibility of such damages. In no event shall licensor's aggregate liability to you arising out of or in connection with this EULA or the use or inability to use the game exceed the amount paid by you for the game.
• Termination
This EULA shall terminate automatically upon your breach of any of the terms and conditions of this EULA. Upon termination, you shall immediately cease all use of the Game and destroy all copies of the Game in your possession.
• Governing Law
This EULA shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflicts of law provisions.
• Entire Agreement
This EULA constitutes the entire agreement between you and Licensor with respect to the Game and supersedes all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of this EULA will be binding unless in writing and signed by Licensor.
