END USER LICENSE AGREEMENT ("EULA")
PLEASE READ THIS EULA CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THE SOFTWARE. BY DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS EULA.
1. Grant of License. Subject to your compliance with the terms and conditions of this EULA, the Licensor grants to you a non-exclusive, non-transferable, limited right to install and use one (1) copy of the software on a single computer or game console, solely for your personal, non-commercial use.
2. Ownership. The software and any accompanying materials, including but not limited to, any images, photographs, animations, video, audio, music, text, and "applets" incorporated into the software, are owned by the Licensor or its licensors and are protected by copyright laws and international treaty provisions.
3. Restrictions. You may not, and may not allow others to:
* Modify, translate, reverse engineer, decompile, disassemble or create derivative works based on the software;
* Copy the software, except as expressly permitted by this EULA;
* Rent, lease, sublicense, or assign the software;
* Export the software in violation of U.S. or other applicable export laws or regulations; or
* Use the software for any commercial purpose.
4. Termination. This EULA will terminate automatically if you fail to comply with any of the terms and conditions of this EULA. Upon termination, you must immediately destroy all copies of the software and any accompanying materials.
5. Warranty Disclaimer. The software is provided "AS IS" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The Licensor does not warrant that the software will meet your requirements or that its operation will be uninterrupted or error-free.
6. Limitation of Liability. In no event shall the Licensor be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the software, even if the Licensor has been advised of the possibility of such damages.
7. Governing Law. This EULA shall be governed by and construed in accordance with the laws of the United States.
8. Entire Agreement. This EULA constitutes the entire agreement between you and the Licensor with respect to the software and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and the Licensor.
By installing or using the software, you acknowledge that you have read this EULA, understand it, and agree to be bound by its terms and conditions.
