End User Licence Agreement for White Phantom Games

You may not use, host or redistribute White Phantom Games software unless you agree to this end user
licence agreement and all of the terms and conditionsincluded. Any form of use of White Phantom Games
software signifies acceptance of these terms.

1. Introduction - This End User Licence Agreement (“EULA”) is a legal agreement between you, (“A”) an
individual or a commercial entity, and (“B”) White Phantom Games, that governs your use of any software
created by White Phantom Games, not limited to, but specifically in this instance, Defending Lydia Collier.
By clicking “I Accept”, or by taking any attempts to install, host or use the software product you
declare that you 1) represent that you are the age of majority in your country of residence, and if
applicable, that you are authorised by your employer to enter into this contract and 2) that you agree
to be bound by the terms and conditions of this EULA.If you do not accept these terms, do not use
this software product.

2. Licence Grant - White Phantom Games grants you a revocable, non-transferable, non-exclusive limited right
to use the software in accordance with the terms and conditions of this licence, which are detailed further on
in this agreement. The licence provided by White Phantom Games for use of its software is strictly a licence
for use only, and you do not own the software, nor is the software sold to you as part of this licence. Any
rights that are not expressly granted by this licence are reserved by White Phantom Games and should not be
presumed to have been granted by their absence.

3. Restrictions on Use - You shall use the software exclusively within the restrictions granted by this licence,
and any deviation from this licence or any use that would breach these terms shall be considered a breach of
the agreement in full. Prohibited use: a) you may not decompile, reverse engineer, disassemble or attempt to
alter the source code of the software for any purpose other than those listed under ‘Exceptions on
Restrictions’. b) violate any applicable laws or regulations in connection with your use or access to this
software. c) you are not permitted to make use of this software in any way, shape or form if you are under the
age of eighteen, or the age permitted to view adult material in your own jurisdiction as not to violate term c.
d) you may not use this software for any purpose to generate revenue, or for any commercial purposes
whatsoever including but not limited to advertising revenue and direct sales, unless it is in such a way that is
allowed in the ‘Exceptions on Restrictions’ section. e) you may not use or distribute this software in any way
shape or form if the latest version of the software is not marked as ‘Public’ or ‘Free’ release on White Phantom
Games Official Website (www.whitephantomgames.co.uk). Any use of this software that would violate term e
is prohibited regardless if the use is cleared in the ‘Exceptions on Restrictions’ section. f) you may not use the
software in any way that would result in unsolicited communications or automated queries to any third party
of White Phantom Games themselves. g) use any proprietary information, likeness or interfaces of White
Phantom Games, or any other intellectual property of White Phantom Games in the design, development,
manufacture, licensing or distribution of any applications, devices or software without the express written
consent of White Phantom Games. Any such endeavour should be considered without consent and in
violation of this licence agreement unless specific, explicit consent is gained on the contrary. Such consent can
only be granted through the means in the ‘Contact’ section of this agreement.

4. Exceptions on Restrictions - White Phantom Games permits the following exceptions on restrictions of
this agreement, provided that clause 3e of this agreement would not be violated. In the event clause 3e and
these exceptions would contradict, then clause 3e will always apply.a) Rights to Redistribution. White
Phantom Games permits the redistribution of software, even for commercial purposes, as long as the
following criteria is met. 1. Any redistributed software must be hosted in such a way that it is free for a player
to access the game. Whilst revenue may be generated through advertising or donations towards a website, for
example, a donation for running costs, the software created by White Phantom Games must not be
“paywalled” or hidden in a section of the website that requires a payment to be made in order for it to be
accessed. This includes, but is not limited to, direct sales of the game, donations directly being enabled for
providing/hosting White Phantom Games itself (such as an optional donation on a page listing White
Phantom Games software, any donations must be for the entire website only). In an instance where a
download link is provided alongside a “premium” link, and the speed of the download for the free version is
slower or restricted in any way, this shall also be considered as charging for the content and in violation of
these terms. Any donations received for websites hosting the full game must not under any circumstances
exist on platforms where White Phantom Games also operates, namely at this time, Patreon and
SubscribeStar. Any mention of White Phantom Games software on Patreon and SubscribeStar is strictly
prohibited unless the content in question is a walkthrough of the game or a fan made modification only. In
these instances it is acceptable to use White Phantom Games or the name of the software to describe the
modification or walkthrough, however the full game must not be hosted alongside them. 2. It is permitted to
host this software in a format whereby it is encoded in html5 and can be played directly in the browser,
provided this is accessible to the player for free and there is no “paywalling” of the content or hiding behind a
log-in or data collection form. If advertisements are hosted alongside the game, they must be non-invasive and
any attempt to host advertisements that use the player’s computer to crypto-mine or initiate a download of
any form on the player’s computer, then this shall be considered a violation of these terms. White Phantom
Games considers this the responsibility of the web-hosting provider to ensure these forms of advertisements
are not used alongside its software, and even if the advertisements are shown by a third party, it will be a
violation of these terms by the individual/corporation hosting White Phantom Games software if these types
of advertisement appear. 3. You are permitted to produce videos or streams of gameplay or video
walkthroughs of ‘Defending Lydia Collier’ or any other White Phantom Games’ software as part of this
licence, however if any form of download link is provided then it must follow the other terms of this
agreement, as set out in the agreement, the video or stream must not be hidden behind a login or ‘paywall’ of
any kind. If you have any questions, please contact us using the details provided in Section 12. 4. NO
REMOVALS OF ORIGINAL CONTENT IS PERMITTED UNDER ANY CIRCUMSTANCES when
hosting or redistributing the game. Any removal of official content, including but not limited to, removing or
redirecting links in the main menu, changing the game’s about section, or removing in-game links is strictly
prohibited and in breach of these terms. 5. An exception to Term 4.4 is permitted in the instance the changes
affect in game dialogue only, such as renaming character’s, their relationships, or what they say. However any
dialogue under the “Narrator” or “White Phantom” characters may not be removed or altered under any
circumstances, unless it is to provide an exact ‘as is’ replication in a foreign language for the purposes of a
translation mod. 6. Any alteration of the game for “mods” or in-game walkthroughs must be additional
content only. The Mod/Walkthrough must not violate Term 4.4, unless allowed under Term 4.5, and must
be provided ‘in addition to’ the official content only. You are permitted to change this content for the
purposes of translation only, and the translated content must exactly replicate its English equivalent as
provided initially by White Phantom Games. You may not charge a fee for a translated version of the game, it
must follow the guidelines and restrictions on hosting as set out throughout this agreement. A translation
should be treated as a ‘mod’ or ‘modification’ and follow the same terms where mentioned, with the
additional exceptions granted in this Section. 7. In the event that you are contacted by White Phantom
Games with a request to desist in your actions, then you must do so, regardless of any exceptions granted in
this agreement and a failure to do so will result in the termination of this agreement and the termination
procedure laid down in Section 5 must be followed.

5. Termination of Agreement- This agreement is effective upon you accepting the agreement, or upon your
downloading, installing, accessing, hosting or any other form of use of any software created or distributed by
White Phantom Games, even if you have not expressly accepted this agreement. This agreement will continue
to be effective until the issue of a new or updated EULA by White Phantom Games, in which a new
acceptance will be required or be accepted by continued use of the software, or until the agreement is
terminated. Without prejudice to any other rights, this agreement will automatically be terminated without
warning, or notice of termination if you fail to comply with the terms of this agreement, or breach any of the
conditions contained within this agreement. You may also terminate this agreement yourself at any time by
removing all White Phantom Games software from your devices, including if applicable any web or cloud
based platforms you may have stored the software upon. In the result of a termination of this agreement, you
must remove all traces of White Phantom Games software from any device or remote location, including but
not limited to, website or cloud storage facility, where you have stored the software.

6. Limitation of Liability- Under no circumstances will White Phantom Games, or its affiliates, partners,
suppliers, licensors, employees or any individual with a working relation to White Phantom Games be liable
for any indirect, consequential, special or exemplary damages arising out of or in connection with your use or
access or inability to use or access the applicable software and/or any third party content and services, whether
or not the damages were foreseeable and whether or not company White Phantom Games or the user were
advised of the possibility of such damages. Without limiting the generality of foregoing White Phantom
Games’ aggregate liability to you (whether under contract, tort, statute or otherwise) shall not exceed the
amount of twenty-five dollars ($25.00). The foregoing limitations will apply even if the above stated remedy
fails its essential purpose.

7. Limited Warranty - White Phantom Games does not provide a warranty beyond that granted under the
case of the 2015 Consumer Rights Act. In the event that you encounter an error that prevents the software
supplied from being of satisfactory quality, fit for purpose and as described, you must contact White
Phantom Games immediately, and a resolution will be provided within 30 days. This will either be 1. An
updated file that resolves the issue, or 2. A refund on the purchase price. Please note that this will only apply if
the game was directly purchased, all payments made through Patreon, SubscribeStar, itch.io and
www.whitephantomgames.co.uk are donations only, and do not constitute a purchase of any software.

8. Warranty Disclaimer - Except for the the sole limited warranty provided by Section 7 of this agreement,
White Phantom Games disclaims any and all other warranties, whether express, implied, or statutory
including without limitation any implied warranties of merchantability, satisfactory quality, fitness for a
particular purpose, accuracy, timeliness, title, or non-infringement of third-party rights, to the fullest extent
authorised by law.

9. Jurisdiction - White Phantom Games is based in the United Kingdom, and therefore as part of this
agreement you agree to be bound by English Law and international treaties that the United Kingdom of
Great Britain and Northern Ireland are part of in relation to copyright regarding this software. In the event of
any legal challenges arising from any software or sales relating to White Phantom Games or any affiliates, you
agree as part of this agreement to resolve these disputes using the laws and legal system of England and Wales.

10. Copyright - White Phantom Games does not hold the copyright to all the software provided as part
‘Defending Lydia Collier’. The audio and non-rendered images or videos are used under licence held by
White Phantom Games, and if there is any dispute of this it can be resolved by contacting White Phantom
Games on the contact details provided at the end of this agreement. Notwithstanding the above mentioned
content, Any and all rendered images, logos or service marks that White Phantom Games uses in connection
with the Software or with services rendered by White Phantom Games are owned by White Phantom Games.
This Agreement does not grant you any right, license, or interest in such marks, and you shall not assert any
right, license, or interest in such marks or any words or designs that are confusingly similar to such marks. All
content not mentioned at the beginning of this section is therefore the intellectual property of White
Phantom Games, and any use or redistribution of White Phantom Games intellectual property will be
considered a breach of not only this agreement but also the 1988 Copyright Designs and Patent Act, the
European Union Communications Directives and in all jurisdictions governed by the World Intellectual
Property Organisation then this will also be protected by the Digital Millennium Copyright Act 2000.

11. Miscellaneous - This agreement may not be modified or altered in any way, other than by authorised
representatives of White Phantom Games, and any acceptance of the agreement constitutes an agreement in
full. Any acceptance of part of this agreement only, or a rejection of individual terms or sections only, shall
constitute a rejection of the agreement and subsequently the termination procedure detailed under Section 5.
Any communications with White Phantom Games must be made at the address detailed under Section 12. As
White Phantom Games is a digital only company, you accept under this agreement that email shall be the
primary means of contact, and any rejection of this or wish to use printed or telephone correspondence shall
constitute a rejection of this agreement. All communications with White Phantom Games must be made
using the English language solely, and any communications sent in a language other than English shall be
ignored. Any communication with White Phantom Games must be made in plain text, and links or
embedded content shall not constitute contact and shall be ignored. Any ignored content will not be deemed
admissible in any legal dispute, and relying on contact not made in English or plain text to make any attempt
of legal or warranty claim shall constitute a violation of this agreement and the termination process under
Section 5 must be followed.
