You may not use, install or access White Phantom Games software unless you agree to this End User Licence Agreement and all of the terms and conditions contained herein. Any form of use of White Phantom Games software signifies acceptance of these terms.


This End User Licence Agreement ("EULA") is a legal agreement between you (whether an individual or a commercial entity) ("the User") and White Phantom Games ("WPG") that governs your use of any software created by White Phantom Games. This EULA applies to all software published by WPG, including but not limited to Defending Lydia Collier and Shadows over Manston: The Manifest.

By clicking "I Accept", or by taking any steps to install, access, or use the software, you declare that:

• (a) you are at least eighteen (18) years of age, or the higher of the age of majority in your jurisdiction and the legal age required to access adult material in your jurisdiction, whichever is greatest;
  
• (b) if applicable, you are authorised by your employer to enter into this agreement; and
  
• (c) you agree to be bound by the terms and conditions of this EULA.

If you do not accept these terms, do not use this software.


WPG grants you a revocable, non-transferable, non-exclusive, limited right to use the software in accordance with the terms of this EULA. This licence is a licence for personal use only. You do not own the software, nor is the software sold to you as part of this licence. Any rights not expressly granted by this EULA are reserved by WPG.

2.1 Subscription-Acquired Content. Where the software is obtained through a subscription-based platform (including Patreon and SubscribeStar), the licence granted under this Section applies to any version of the software lawfully downloaded by the User during an active subscription period. The User's right to continue using such downloaded versions shall not be revoked upon the termination, expiration, or cancellation of the User's subscription, and shall continue to be governed by this EULA subject only to the termination provisions in Section 5. For the avoidance of doubt, cancellation of a subscription does not entitle the User to access, download, or receive new versions, updates, patches, or additional content released after the cancellation date, except where re-subscription occurs or such content is obtained through another official distribution channel.


You shall use the software exclusively within the restrictions granted by this licence. Any deviation from or breach of these terms shall be considered a breach of the agreement in full. The following uses are prohibited:

• (a) You may not decompile, reverse engineer, disassemble, or attempt to derive or alter the source code of the software, except as expressly permitted under Section 4.
  
• (b) You may not use the software in violation of any applicable laws or regulations.
  
• (c) You may not use this software if you are under eighteen (18) years of age, the age of majority in your jurisdiction, or the legal age required to access adult material in your jurisdiction, whichever is greatest.
  
• (d) You may not use this software for any commercial purpose whatsoever, including but not limited to generating advertising revenue, direct sales, or any form of monetisation, except as expressly permitted under Section 4.
  
• (e) You may not redistribute, host, re-upload, or make available for download any WPG software or any part thereof. All distribution of WPG software is conducted exclusively through official distribution channels, namely Steam, itch.io, Patreon, and SubscribeStar. The WPG website (www.whitephantomgames.co.uk) serves as the official information and promotional channel only; no software is distributed directly through the website. Any unauthorised distribution is strictly prohibited.
  
• (f) You may not use the software in any way that would result in unsolicited communications or automated queries to any third party or to WPG.
  
• (g) You may not use any proprietary information, likeness, or interfaces of WPG, or any other intellectual property of WPG, in the design, development, manufacture, licensing, or distribution of any applications, devices, or software without the express written consent of WPG. Any such use shall be considered unauthorised and in violation of this EULA unless specific, explicit consent has been obtained via the contact details in Section 14.
  
• (h) You may not use the software, its assets, source code, scripts, dialogue, character designs, rendered images, audio, music, or any other content contained within or extracted from the software, for the purpose of training, fine-tuning, evaluating, benchmarking, or otherwise developing any machine learning model, artificial intelligence system, generative AI system, or similar automated system. You may not use the outputs of the software to produce, derive, or generate AI-generated works. This restriction applies regardless of whether the model or system is intended for personal, academic, non-commercial, or commercial use, and applies in addition to the intellectual property protections set out in Section 12.

WPG permits the following exceptions to the restrictions set out in Section 3:

4.1 Content Creation. You are permitted to produce videos, livestreams, and video walkthroughs of WPG software as part of this licence. Such content may be monetised through standard platform mechanisms (e.g. YouTube ad revenue, Twitch subscriptions). Content must not be hidden behind a paywall or login requirement, and must not include download links to any WPG software.

4.2 Modifications and Translations. You are permitted to create and distribute modifications ("mods") for WPG software, subject to the following conditions:

• (i) Mods must be distributed as additional content only and must not replace, remove, or alter any official game content, including but not limited to main menu links, the game's about section, in-game links, or any content attributed to the "Narrator" or "White Phantom" characters.
  
• (ii) An exception to clause 4.2(i) is permitted where changes affect in-game dialogue only, such as renaming characters, altering relationships, or modifying what characters say, provided this does not affect content attributed to the "Narrator" or "White Phantom" characters.
  
• (iii) Translation mods must be faithful, accurate replications of the original English content. Translated content must not deliberately misrepresent, materially add to, or materially remove from the meaning of the English source material.
  
• (iv) You may not charge a fee for any mod or translation. Mods and translations must be made freely available.
  
• (v) Mods may not depict, imply, or represent any character as being under the age of eighteen (18), nor may they alter, reinterpret, or present any character in a manner that suggests the character is a minor. Any mod found to be in violation of this clause will be considered a serious breach of this agreement, and WPG reserves the right to pursue all available remedies, including but not limited to issuing takedown requests and reporting the violation to the relevant platform or authorities.
  
• (vi) Mods and translations must not include or bundle any WPG software. They must be distributed separately and require the user to have obtained the game through an official distribution channel.
  
• (vii) Mods and translations must not violate clause 3(h). Mods produced using generative AI systems trained on WPG software, or which incorporate AI-generated content derived from WPG assets, are prohibited.

4.3 Cease and Desist. In the event that you are contacted by WPG with a request to cease any activity permitted under this Section, you must comply immediately, regardless of any exception granted herein. Failure to comply will result in the termination of this agreement under Section 5.


This agreement is effective upon your acceptance, or upon your downloading, installing, accessing, or otherwise using any WPG software, even if you have not expressly accepted this agreement. This agreement will remain in effect until it is terminated or superseded by an updated EULA issued by WPG.

Without prejudice to any other rights, this agreement will automatically terminate without notice if you fail to comply with any of its terms. You may also terminate this agreement at any time by permanently removing all WPG software from your devices and any associated platforms.

Upon termination, you must remove all WPG software from any device, cloud storage, or remote location where it is stored.

5.1 Updates to this Agreement. WPG reserves the right to issue updated versions of this EULA from time to time. Notice of any updated EULA will be provided through the official distribution channels, the official Discord server, in-game notification, or by publication on www.whitephantomgames.co.uk. Your continued use of the software following such notice shall constitute acceptance of the updated EULA. If you do not accept the updated terms, your sole remedy is to terminate this agreement by removing all WPG software in accordance with this Section.

5.2 Survival. Notwithstanding termination of this agreement for any reason, Sections 3(g), 3(h), 7 (Limitation of Liability), 8 (Indemnification by the User), 10 (Warranty Disclaimer), 11 (Governing Law and Jurisdiction), 12 (Copyright and Intellectual Property), 13 (Communications), and 15 (Severability), together with any other provisions which by their nature should survive termination, shall continue in full force and effect.


6.1 Game Software. WPG software is entirely offline and does not collect, transmit, or store any personal data. No analytics, telemetry, crash reports, or usage data of any kind are gathered by the software.

6.2 Discord Rich Presence. WPG software may include an optional, opt-in Discord Rich Presence feature. When enabled by the User, this feature displays the User's current gameplay status on their Discord profile. This feature is disabled by default and requires the User to explicitly enable it. No data is collected or stored by WPG through this feature; it operates solely through Discord's own API and is subject to Discord's privacy policy.

6.3 Voluntary Bug Reports. Users may voluntarily submit bug reports or feedback via the official WPG Discord server. Any information submitted in this manner is provided at the User's own discretion. WPG will only use such information for the purpose of identifying and resolving software issues, on the lawful basis of legitimate interests under UK GDPR.

6.4 Website. The WPG website (www.whitephantomgames.co.uk) uses cookies as described in its cookie notice. The website's use of cookies is separate from and independent of the game software.


To the fullest extent permitted by law, WPG, its affiliates, partners, suppliers, licensors, and employees shall not be liable for any indirect, consequential, special, incidental, or exemplary damages arising out of or in connection with your use of, or inability to use, the software and/or any third-party content or services, whether or not the damages were foreseeable and whether or not WPG was advised of the possibility of such damages.

Without limiting the generality of the foregoing, WPG's aggregate liability to you (whether under contract, tort, statute, or otherwise) shall not exceed twenty-five pounds sterling (£25.00).

Nothing in this Section shall limit or exclude WPG's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the laws of England and Wales.


You agree to indemnify, defend, and hold harmless WPG, its sole proprietor, affiliates, partners, suppliers, licensors, and employees (each an "Indemnified Party") from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, fines, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• (a) your breach of this EULA, including but not limited to any breach of Section 3 (Restrictions on Use) or Section 4 (Exceptions on Restrictions);
  
• (b) your violation of any applicable law or regulation in connection with your use of the software, including but not limited to laws relating to the protection of minors, intellectual property, data protection, and online safety;
  
• (c) your infringement of any third-party right, including without limitation intellectual property rights, privacy rights, or rights of publicity, in connection with your use of, or activities permitted under, this EULA; and
  
• (d) any mod, translation, content, communication, or other material you create, distribute, upload, or otherwise make available in connection with WPG software.

WPG reserves the right, at its own expense, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate fully with WPG in asserting any available defences. You shall not settle any claim subject to this Section without the prior written consent of WPG.

Nothing in this Section shall require you to indemnify any Indemnified Party in respect of that party's own fraud, gross negligence, or wilful misconduct, or in respect of any liability that cannot lawfully be the subject of an indemnity under the laws of England and Wales.


WPG does not provide a warranty beyond that which is required under the Consumer Rights Act 2015. In the event that you encounter a defect that prevents the software from being of satisfactory quality, fit for purpose, or as described, you must contact WPG promptly. WPG will endeavour to provide a resolution within thirty (30) days, which may take the form of an updated file that resolves the issue, or a refund of the purchase price where applicable.

This warranty applies only where the software was obtained through an official distribution channel (including Steam, itch.io, Patreon, or SubscribeStar). WPG's obligations under this warranty are limited to the remedies stated above.

9.1 Steam Refunds. Where the software is purchased through Steam, refunds are subject to Steam's refund policy and must be requested through Steam. Nothing in this agreement is intended to interfere with or restrict Steam's refund processes.


Except for the sole limited warranty provided by Section 9, WPG disclaims any and all other warranties, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, timeliness, title, or non-infringement of third-party rights, to the fullest extent authorised by law.


WPG is registered and operates in the United Kingdom. This agreement shall be governed by and construed in accordance with the laws of England and Wales. You agree that any dispute arising from or in connection with this agreement or any WPG software shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Nothing in this agreement shall affect any statutory rights that cannot be waived or limited by contract under applicable consumer protection law.


Certain audio and non-rendered visual assets included in WPG software are used under licence held by WPG. Any dispute regarding such assets may be resolved by contacting WPG using the details provided in Section 14.

Notwithstanding the above, all rendered images, logos, service marks, game scripts, storylines, character designs, and all other original content created by WPG are the exclusive intellectual property of White Phantom Games. This agreement does not grant you any right, licence, or interest in such intellectual property, and you shall not assert any right, licence, or interest in such property or any works that are confusingly similar thereto.

For the avoidance of doubt, and without limiting clause 3(h), no right is granted to use any WPG intellectual property as input to, or training data for, any machine learning or artificial intelligence system.

Any unauthorised use or redistribution of WPG intellectual property constitutes a breach of this agreement and may also constitute an infringement under the Copyright, Designs and Patents Act 1988, the UK retained law derived from applicable EU directives, and in all applicable jurisdictions, the Digital Millennium Copyright Act of 1998 and the WIPO Copyright Treaty.


This agreement may not be modified or altered in any way other than by authorised representatives of WPG. Acceptance of this agreement constitutes acceptance of the agreement in full. Any purported acceptance of only part of this agreement, or rejection of individual terms, shall constitute a rejection of the agreement in its entirety, and the termination procedure under Section 5 shall apply.

All official communications with WPG must be made in the English language. WPG is a sole-proprietor operation based exclusively in the United Kingdom and does not have the resources to process communications in any other language. Communications sent in any language other than English will not be processed and will not be deemed to have been received.

As WPG operates as a digital-only company, email shall be the primary means of official contact. All communications must be made in plain text. Messages containing links, embedded content, or attachments (other than plain text documents) will not be processed, except that screenshots, save files, and log files may be attached to bug reports submitted via the official Discord server.

No rights under this agreement, including warranty or legal claims, shall be deemed to have been exercised unless communicated in accordance with this Section.

If any provision of this agreement is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from this agreement and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.


This is the end of the agreement.
