END USER LICENSE AGREEMENT (EULA) FOR CABIN RUSH
IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT (EULA) CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING CABIN RUSH, THE GAME DEVELOPED BY GAMERLY GAMES. BY DOWNLOADING, INSTALLING, OR USING CABIN RUSH, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, DO NOT DOWNLOAD, INSTALL, OR USE CABIN RUSH.
License Grant
Subject to the terms and conditions of this Agreement, Gamerly Games grants you a limited, non-exclusive, non-transferable, revocable license to use Cabin Rush for your personal, non-commercial use on any device that you own or control.
Ownership
Cabin Rush is the property of Gamerly Games and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Gamerly Games retains all rights, title, and interest in and to Cabin Rush, including all intellectual property rights, and reserves all rights not expressly granted to you under this Agreement.
Restrictions
You may not copy, modify, distribute, sell, transfer, or sublicense Cabin Rush, in whole or in part, except as expressly provided in this Agreement. You may not reverse engineer, decompile, or disassemble Cabin Rush or attempt to discover any source code or other proprietary information related to Cabin Rush. You may not remove or alter any copyright, trademark, or other proprietary notices from Cabin Rush.
Termination
This Agreement is effective until terminated by either party. Your rights under this Agreement will terminate automatically without notice from Gamerly Games if you fail to comply with any term or condition of this Agreement. Upon termination, you must cease all use of Cabin Rush and destroy all copies of Cabin Rush in your possession.
Disclaimer of Warranties
Cabin Rush is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Gamerly Games does not warrant that Cabin Rush will meet your requirements or that the operation of Cabin Rush will be uninterrupted or error-free.
Limitation of Liability
In no event shall Gamerly Games be liable for any indirect, special, incidental, punitive, or consequential damages arising out of or in connection with this Agreement or the use or inability to use Cabin Rush, even if Gamerly Games has been advised of the possibility of such damages.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflicts of law provisions. The parties hereby submit to the exclusive jurisdiction of the courts located in the State of New Mexico.
Entire Agreement
This Agreement constitutes the entire agreement between you and Gamerly Games with respect to the subject matter hereof and supersedes all prior or contemporaneous communications and proposals, whether oral or written, between you and Gamerly Games.
By downloading, installing, or using Cabin Rush, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions. If you do not agree to the terms and conditions of this Agreement, do not download, install, or use Cabin Rush.
