END USER LICENSE AGREEMENT
PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING THIS SOFTWARE. BY INSTALLING, COPYING, OR OTHERWISE USING THIS SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT INSTALL OR USE THE SOFTWARE.
1. DEFINITIONS
"Software" refers to the game application, including all associated files, libraries, and documentation.
"Developer" or "We" refers to the creator and publisher of the Software.
"User" or "You" refers to the individual installing or using the Software.
"User-Generated Content" or "UGC" refers to any content created by users and made available through the Software, including but not limited to downloadable question packs, custom content, and community-created materials.
"AI Features" refers to any artificial intelligence-powered functionality within the Software, including but not limited to AI-generated questions, AI-assisted gameplay, and AI chat or interaction features.
"Services" refers to online features, multiplayer functionality, and any server-based components of the Software.
2. LICENSE GRANT
Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software for your personal, non-commercial purposes strictly in accordance with this Agreement and any applicable terms of service of the distribution platform (e.g., Steam).
3. DATA COLLECTION AND PRIVACY
3.1 AI Request Data Collection
By using the AI Features of the Software, you acknowledge and agree that:
(a) The Developer may collect, store, and analyze the content of your interactions with AI-powered features, including but not limited to prompts, queries, requests, and any text or data you submit to AI systems within the Software.
(b) This data may be used for the purposes of improving AI functionality, enhancing user experience, developing new features, ensuring service quality, and conducting research and development.
(c) AI interaction data may be reviewed by the Developer or authorized personnel for quality assurance, safety monitoring, and service improvement purposes.
(d) You shall not submit any sensitive personal information, confidential data, or information belonging to third parties through AI Features.
3.2 Region Detection for Server Connection
By using the online features of the Software, you acknowledge and agree that:
(a) The Software may automatically detect your approximate geographic region for the sole purpose of connecting you to the optimal game server to ensure the best possible performance and lowest latency.
(b) No location data is stored, retained, or transmitted to any third party. Region detection is performed in real-time and is used exclusively for server routing purposes.
(c) This detection may utilize your IP address or similar network information temporarily during the connection process.
(d) You may, where available, manually select a different server region through the Software's settings.
3.3 Gameplay Response Data
By playing the Software, you acknowledge and agree that:
(a) The Developer may collect and store data regarding your gameplay responses, including both correct and incorrect answers provided during gameplay.
(b) This data is used for purposes including but not limited to: analyzing question difficulty and balance, improving game content, identifying technical issues, enhancing educational value, and developing new features.
(c) Response data may be aggregated with data from other users for statistical analysis and game improvement purposes.
(d) The Developer maintains appropriate security measures to protect this data from unauthorized access.
3.4 Gameplay Analytics and Statistics
By using the Software, you acknowledge and agree that:
(a) The Developer may collect statistics and analytics regarding your playstyle, including but not limited to: session duration and frequency, feature usage patterns, game mode preferences, progression data, performance metrics, user interface interactions, and general gameplay behavior.
(b) This data is collected for the purposes of: improving game design and user experience, identifying and fixing bugs and technical issues, balancing gameplay mechanics, developing new content and features, and understanding user engagement.
(c) Analytics data may be processed using third-party analytics services, which are bound by their own privacy policies and data protection obligations.
(d) Where possible, analytics data is collected in anonymized or pseudonymized form.
4. USER-GENERATED CONTENT
4.1 Third-Party Content Disclaimer
By downloading, accessing, or using User-Generated Content (including but not limited to community question packs, custom content, and any materials created by users), you acknowledge and agree that:
(a) User-Generated Content is created entirely by third-party users and community members, NOT by the Developer. The Developer does not author, endorse, verify, or assume any responsibility for the accuracy, quality, legality, or appropriateness of any User-Generated Content.
(b) The Developer makes no representations or warranties regarding User-Generated Content, including but not limited to its accuracy, completeness, reliability, suitability, or compliance with any laws or regulations.
(c) The Developer expressly disclaims any and all liability arising from or related to User-Generated Content. You access and use such content entirely at your own risk.
(d) User-Generated Content may contain errors, inaccuracies, offensive material, or content that violates intellectual property rights of third parties. The Developer is not responsible for screening, monitoring, or verifying User-Generated Content.
(e) Any views, opinions, or statements expressed in User-Generated Content are solely those of the content creators and do not reflect the views, opinions, or positions of the Developer.
4.2 User Responsibility
You agree that:
(a) You will evaluate and bear all risks associated with the use of any User-Generated Content.
(b) You will not rely on User-Generated Content for any purpose requiring accuracy or professional advice.
(c) If you create and distribute User-Generated Content, you are solely responsible for ensuring such content does not violate any laws, infringe upon third-party rights, or contain harmful, offensive, or inappropriate material.
4.3 Content Reporting
The Developer may, but is not obligated to, provide mechanisms for reporting inappropriate User-Generated Content. The Developer reserves the right to remove or disable access to any User-Generated Content at its sole discretion, without notice or liability.
5. USER CONDUCT
You agree not to:
(a) Use the Software for any unlawful purpose or in violation of any applicable laws or regulations.
(b) Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software.
(c) Modify, adapt, translate, or create derivative works based on the Software without prior written consent.
(d) Remove, alter, or obscure any proprietary notices, labels, or marks on the Software.
(e) Use the Software in any manner that could damage, disable, overburden, or impair the Services.
(f) Attempt to gain unauthorized access to any systems, accounts, or data.
(g) Use AI Features to generate harmful, illegal, offensive, or inappropriate content.
(h) Upload or distribute User-Generated Content that infringes on intellectual property rights, contains malware, or violates any applicable laws.
6. INTELLECTUAL PROPERTY
6.1 Developer's Rights
The Software, including all code, graphics, user interface, audio, video, text, and other content created by the Developer (excluding User-Generated Content), is owned by the Developer and is protected by copyright, trademark, and other intellectual property laws.
6.2 User-Generated Content Rights
Users retain ownership of the User-Generated Content they create, subject to any license granted to the Developer and other users through the Software's content sharing features.
7. DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
THE DEVELOPER DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
USER-GENERATED CONTENT IS PROVIDED WITHOUT ANY WARRANTY WHATSOEVER, AND THE DEVELOPER EXPRESSLY DISCLAIMS ALL LIABILITY RELATED TO SUCH CONTENT.
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, USER-GENERATED CONTENT, OR ANY CONDUCT OR CONTENT OF ANY THIRD PARTY.
THE DEVELOPER'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Developer and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from: (a) your use of the Software; (b) your violation of this Agreement; (c) your violation of any third-party rights; or (d) any User-Generated Content you create or distribute.
10. TERMINATION
This Agreement is effective until terminated. The Developer may terminate this Agreement at any time without notice if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the Software and destroy all copies in your possession.
11. CHANGES TO THIS AGREEMENT
The Developer reserves the right to modify this Agreement at any time. Changes will be effective upon posting of the revised Agreement. Your continued use of the Software after any changes constitutes your acceptance of the revised Agreement.

13. ACKNOWLEDGMENT

YOU FURTHER AGREE THAT THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND THE DEVELOPER, SUPERSEDING ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
