End-User License Agreement (EULA) of It’s Dark


This End-User License Agreement ("EULA") is a legal agreement between you and Connor Redwine.


This EULA agreement governs your acquisition and use of our It’s Dark game ("Game") directly from Connor Redwine or indirectly through a Connor Redwine authorized reseller or distributor (a "Reseller").


Please read this EULA agreement carefully before completing the installation process and using the It’s Dark game. It provides a license to use the It’s Dark game and contains warranty information and liability disclaimers.


If you are entering into this EULA agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these terms and conditions. If you do not have such authority or if you do not agree with the terms and conditions of this EULA agreement, do not install or use the Software, and you must not accept this EULA agreement.


This EULA agreement shall apply only to the game supplied by Connor Redwine herewith regardless of whether other games are referred to or described herein. The terms also apply to any Connor Redwine updates, supplements, Internet-based services, and support services for the game, unless other terms accompany those items on delivery. If so, those terms apply.

License Grant

1) You are permitted to load the It’s Dark game on any device (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the It’s Dark game.

Intellectual Property Rights

All aspects of the Game, including, without limitation, any works of authorship (e.g., any trailers, images, sounds, etc.), trademarks, features, or functionality, and other intellectual property contained in, comprising, and/or underlying the Game is owned by the developers for “It’s Dark”, or other providers of such material.

Feedback

You may from time to time provide us with informal feedback. The feedback provided to Connor Redwine will be owned by Connor Redwine, and you hereby assign to Connor Redwine and the developers for "It's Dark" your intellectual property rights in each and every piece of Feedback, and Connor Redwine will be free to use, disclose, reproduce, license, distribute, and exploit the Feedback as it sees fit, without obligation or restriction of any kind on account of intellectual property rights. The term "feedback" refers to any suggestions, ideas, or feedback you provide regarding the game.

Limited License to Use the game

These Terms of Use permit you to access and use the game only for your own personal, non-commercial use. As with the Game, the license contemplated by this paragraph gives you a non-exclusive, non-transferable, non-sublicensable, limited right and license to use one copy of the Game for your personal, non-commercial use for gameplay. No part of the game material may be reproduced, distributed, modified, made derivative works of, publicly exhibited, publicly performed, republished, downloaded, stored, or transmitted. You must not access or use for any commercial purposes any part of the game or materials available through them. No right, title, or interest in or to the game or any content thereof is transferred to you, and all rights not expressly granted are reserved by Connor Redwine. Any use of the Game not expressly permitted by these Terms of Use is a breach of these Terms of Use.

Prohibited Uses

You may use the Game only for lawful purposes and in accordance with these Terms of Use. In addition to the above obligations, you agree not to:


(a)    use the Game in any way that violates applicable laws, exploit or harm anyone, send advertising or promotional material, or impersonate or attempt to impersonate Connor Redwine or anyone else;


(b)    use the Game to submit or link to any content which is defamatory, abusive, hateful, threatening, spam or spam-like, likely to offend, contains adult or objectionable content, contains personal information of others, risks copyright infringement, encourages unlawful activity, or otherwise violates any laws;


(c)     use the Game to violate the legal rights of others, including, without limitation, their privacy, publicity, and intellectual property rights such as by collecting or storing any personal information from the game about anyone without their express permission;


(d)   attack the game via a denial-of-service attack or a distributed denial-of-service attack;


(e)    disable, overburden, damage, or impair (or attempt to disable, overburden, damage, or impair) the game or interfere with anyone else’s use of the game;


(f)     engage in any other conduct that affects anyone else’s use or enjoyment of the game or that, as determined by us, may harm Connor Redwine;


(g)    cheat, including, without limitation, by accessing the game in an unauthorized manner;


(h)    use any robot, spider, or other automatic or manual device, process, or means to access the game for any purpose, including monitoring or copying any of the material on the game;


(i)      modify, adapt, translate, or reverse engineer any portion of the game;


(j)      use any device, software, or routine that interferes with the proper working of the game;


(k)    introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful;


(l)      attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the game, including any server on which the game are stored, or any server, computer, or database connected to the game;  


(m)    otherwise attempt to interfere with the proper working of the game; and


(n)    encourage or enable any other person to do any of the foregoing.

Changes to these Terms of Use

We reserve the right to revise and update these Terms of Use at any time. All changes are effective immediately when we post them. If you continue to use our Games, following the posting of revised Terms of Use, you are signifying that you accept and agree to the changes. You are expected to check this page from time to time, so you are aware of any changes.
