Terms Of Service

GENERAL

- By downloading, installing, opening or otherwise using Trap Attack or any other connected services or products you agree to be bound by these Terms of Service which constitute an agreement with Batzu Games (finnish business code: 3296734-7), Oksatie 50, 87250 Kajaani, Finland.

LICENCE

- Trap Attack is licensed, not sold. The title or ownership in Trap Attack is being transferred or assigned and these Terms of Service shall not be interpreted as a sale of any rights in Trap Attack.
- Batzu Games retains all right, title, and interest to Trap Attack, including but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, source code and its parts, art assets or moral rights.
- Subject to the provisions of these Terms of Service, you are granted a non-exclusive, non-transferable, limited right and license to use the purchased or downloaded copy of Trap Attack for your personal, non-commercial use. Your license rights are subject to your compliance with these Terms of Service.
- The term of your license under these Terms of Service shall commence on the date that you install or otherwise use Trap Attack and ends on the date that you uninstall or otherwise dispose of Trap Attack.

ONLINE STORES AND DISTRIBUTION SERVICES

- If Trap Attack is provided through an authorized external online store or other authorized distribution service, these Terms of Service and such provision of Trap Attack is subject to the additional terms and conditions adopted by a particular online store or distribution service. All such applicable terms and conditions are part of these Terms of Service by this reference and in case of collision with these Terms of Service such applicable terms and conditions shall prevail

USE OF SERVICE

- if you are a valid user of the game, you may use our content for the purpose of creating videos (tutorials, reviews etc.), and may upload them on a video sharing platforms and monetize the videos.
- You are not allowed to extract assets from our content and distribute those separately (e.g sound effects, graphics, music, etc.).
- We reserve the right to revoke this permission if the video is being used in a way we deem it inappropriate and reserve the right to takedown such videos.

INTELLECTUAL PROPERTY RIGHTS AND SHARING

- You may use Trap Attack and other paid content for your own personal use.
- All the content in the game is owned by Batzu Games. This also includes the user provided content that might become part of the game (e.g translations).
- If you distribute or otherwise publish your derivative works or modifications of the source code or / and art assets, you automatically grant to Batzu Games the irrevocable, perpetual, royalty free, sublicensable right and license under all applicable copyrights and intellectual property rights laws to use, reproduce, modify, adapt, perform, display, distribute and otherwise exploit and / or dispose of the modifications and / or derivative works (or any par of them) in any way Batzu Games considers appropriate. You also waive and agree never to assert against Batzu Games or its affiliates, distributors or licensors any moral rights or similar rights, that you may have in respect of such modifications and / or derivative works.
- Trap Attack is not a free software, copy-left, or public domain software. The source code and all art assets created for the game are copyrighted and lisenced to Batzu Games and any use of them is subject to the rules stated in these Terms of Service or, if applicable, an express consent of Batzu Games.
- You are not allowed to copy, transfer or distribute the game, its hacked or otherwise altered versions, any of its parts or any of the paid content.
- Distribution of the original art assets such as models, fonts or textures is not permitted, unless it is necessary to create your own mods in accordance with the previous paragraphs.
- Any commercial use of Trap Attack's source code, art assets or other affiliated assets is subject to express consent of Batzu Games. For this purpose you can contact us on contact@batzugames.com. This does not affect your Video Policy set out above.

FEEDBACK AND BUG REPORTING

- If you provide us with any feedback, suggestions, bug reports or comments regarding Trap Attack, you grant us a non-exclusive, royalty-free, irrevocable, perpertual licence to use such information in our discretion as we see fit and without any obligation to you. If any such rights may not be licensed under applicable law (such as moral and other personal rights), you hereby waive and agree not to assert all such rights.

OTHER TERMS

- Some features of Trap Attack may require an internet connection, which you are responsible for providing at your expense. You are responsible for all costs and fees charged by your internet service provider related to the use of Trap Attack.
-We may at any time assign, transfer, subcontract or delegate any of our rights or obligations under this EULA. You may not assign, transfer, subcontract or delegate any of your rights and obligations under this EULA
- Any kind of abusive or clearly inappropriate behaviour with regard to services we run (forums, mod portal, matching server) is a violation of these Terms of Service.
- The materials appearing in the game or on the Batzu Games website may include technical or typographical errors. We don't warrant that any of the materials are complete, accurate, or up to date.
- Each provision of these Terms of Service operates separately. In the case that any provision of these Terms of Service has been invalid or unenforceable for any reason, this fact does not cause invalidity or ineffectiveness of other parts of the Terms of Service.
- We reserve the right to update these terms at any point in time with immediate effect. Last update was on 2th January 2023.



Data Privacy Policy

Under data protection legislation, we are required to provide you with certain information about who we are, how we process your personal data and for what purposes and your rights in relation to your personal data and how to exercise them.

- We are Batzu Games, a company that develops and publishes games.
- Because we can determine the purposes and means of the processing of your personal data, we are considered to be the controller of personal data under GDPR rules.

SCOPE OF THIS POLICY

This privacy policy relates to your use of our games and related services only. In order for us to provide our online services to you, we use and link the services owned and operated by certain trusted third party:
- Valve Corporation to distribute or game and use the online service.
These third parties may also gather personal information about you in accordance with their own separate privacy policies. For privacy information relating to these other third parties, please consult their privacy policies as appropriate.

COLLECTION AND USE OF YOUR PERSONAL INFORMATION

- When you send a Bug Report to us:
- You may send a screenshot of the current state of the game.
- You may send your system information so we can find out the root of the problem much easier
- During game play the current score, time and in-game actions can send information to Steam which can unlock achievements.
- After each round your in-game information (time, score etc.) and Steam ID is saved to the Steam Leaderboards
FURTHER INFORMATION
- In case we receive a bug report with your (anonymous) hardware information it is saved in one of our systems in case a duplicate issues arise and we can further investigate these issues.
- Your steam information will only be kept for the duration of your game session to be used for achievement and leaderboard purposes.
- Please note that we may process your personal information without your knowledge or consent where this is required or permitted by applicable law.

CHANGES TO THIS POLICY

- This policy was published on 2th January 2023.
- We may change this policy from time to time. Your continued use of our online services shall be deemed acceptance of our latest version of this policy.
