IMPORTANT: BEFORE YOU DOWNLOAD/INSTALL THE SOFTWARE, READ THE LICENSE AGREEMENT CAREFULLY AND THOROUGHLY.


1. LICENSE
This End User License Agreement ("Agreement" or "EULA") is a legally binding contract between you ("You" or "you") and Pawel Zajac, the Developer of J-Jump Arena ("Artbarian Games", "mine", "me", or "Developer"). J-Jump Arena ("Game", "The Game", "J-Jump Arena", "Service", "The Service", or "Software") is a service operated by the Developer.

By installing or using J-Jump Arena, you expressly agree to be bound by the terms and conditions of this Agreement and all applicable intellectual property laws. If you do not agree with any part of this EULA, you may not install or use the J-Jump Arena software.


2. INDEMNIFICATION:
You agree to indemnify, defend, and hold harmless Pawel Zajac, the Developer of J-Jump Arena, from and against any and all claims, damages, liabilities, losses, expenses, and costs (including reasonable attorneys' fees) arising out of or in connection with your use of J-Jump Arena or any violation of this End User License Agreement (EULA). This indemnification obligation shall apply even after the termination of this Agreement.


3. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Pawel Zajac, shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to damages for loss of profits, data, business, goodwill, or other intangible losses, arising out of or in connection with this Agreement, the use or inability to use J-Jump Arena, the cost of procurement of substitute goods or services, unauthorized access to or alteration of your transmissions or data, any unauthorized access to your account, or any other matter relating to J-Jump Arena.

The Developer's total cumulative liability to you or any third party for any and all claims relating to J-Jump Arena, regardless of the form of action, shall not exceed the total amount paid by you, if any, for accessing J-Jump Arena.

The Developer shall not be liable for any delays, interruptions, errors, or omissions in the operation of J-Jump Arena, or any part thereof. The Developer makes no warranties or representations about the accuracy or completeness of the content provided in J-Jump Arena.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such cases, the Developer's liability shall be limited to the fullest extent permitted by applicable law.

This limitation of liability applies to all claims, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not the Developer has been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed its essential purpose.

By using J-Jump Arena, you acknowledge and agree that the limitations and exclusions of liability set forth in this Agreement are fair and reasonable and that you accept these terms as a fundamental basis for using J-Jump Arena.


4. USER AGE AND PARENTAL CONSENT
J-Jump Arena contains content that may not be suitable for all ages, including cartoon violence and depictions of doll mannequin-like characters and nudity without genitals. As such, access to and use of J-Jump Arena is subject to age restrictions based on the applicable laws and regulations of your region.

Please be aware that different countries and regions may have varying age requirements for accessing content with the described features. It is your responsibility to ensure compliance with the local laws governing age restrictions for accessing such content.

If you are under the legally required age to access J-Jump Arena, you must obtain verifiable parental consent before using the game. By using this software, you represent and warrant that you either meet the minimum age requirement or have obtained parental consent as required by the laws of your jurisdiction.

If you are a parent or legal guardian providing consent for your child to use J-Jump Arena, you agree to be bound by the terms of this End User License Agreement (EULA) on behalf of your child. You are solely responsible for monitoring and supervising your child's use of the game.


5. NO MODIFICATION
You shall not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on J-Jump Arena, in whole or in part, except as expressly permitted by applicable law. Any such unauthorized modification or use is strictly prohibited and may result in the termination of your access to J-Jump Arena.


6.UPDATES
Artbarian Games may, from time to time, provide you with patches, updates, or modifications to J-Jump Arena. You understand that certain updates and modifications may be necessary for the continued use of J-Jump Arena. You agree that Artbarian Games may discontinue support for previous versions of J-Jump Arena upon the availability of an updated version. However, please be aware that these updates or modifications are not guaranteed to be error-free or compatible with all devices or operating systems. Artbarian Games shall not be held liable for any damages that may result from the installation or use of these updates or modifications.

Furthermore, the Developer reserves the right to make changes, at any time, to the way achievements, collectibles, items, or other in-game elements are obtained in J-Jump Arena.


7. DATA SHARING, COLLECTION, AND PRIVACY POLICY
By using J-Jump Arena, you acknowledge and agree that the game may collect and share data with other players through multiplayer matches and leaderboards, as well as with the Developer (numerical data used for research, analytics, and other applications). The data shared may include, but is not limited to, your game statistics, your ID, and your player name. Additionally, the Developer stores the match history of all online games.

Upon accepting this Agreement, you grant permission for the data to be shared with other players, the Developer, and with Steam. Steam's Privacy Policy applies to the data collected and shared through their platform.

If you wish to have your data removed from leaderboards or stored data, you can contact the Developer at artbariangames@gmail.com to request removal.

The Developer reserves the right to retain certain data for a period of time for statistical purposes and game improvement. However, such data will not be disclosed to any third party without your explicit consent, except where required by law. The Developer takes reasonable steps to ensure the security and integrity of the data collected and shared, but cannot guarantee that the data will be completely secure from unauthorized access, use, or disclosure. By using J-Jump Arena, you acknowledge and accept the risks associated with the collection and sharing of data as described in this section.


8. ONLINE MULTIPLAYER
While the Developer endeavors to provide reliable access to multiplayer modes in J-Jump Arena, you acknowledge that there may be instances when multiplayer features are unavailable or may be permanently discontinued in the future without prior notice to you. Please be aware that any potential discontinuation of online multiplayer does not entitle you to a refund from the Developer. However, Steam's refund policy applies to purchases made through their platform.
The Developer is committed to maintaining a fair and enjoyable gaming environment and will take appropriate action against players who engage in unfair or harmful behavior. Nevertheless, Artbarian Games is not liable for any damages caused by other players who cheat, disrupt your gameplay experience, or engage in harmful actions. If you encounter any unfair player, we encourage you to report them at artbariangames@gmail.com.


9. WARRANTIES
Except where expressly stated in writing and signed by the Developer, J-Jump Arena is provided "as is" and without any warranties. The Developer expressly excludes all other warranties, whether implied or expressed, including, but not limited to, any implied warranties of merchantable quality or fitness for a particular purpose.


10. GOVERNING LAW
This Agreement shall be governed by the laws of Poland. As a result, you irrevocably submit to the non-exclusive jurisdiction of the courts of Poland. If any provision of this License is found to be unlawful or unenforceable, it shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any other provisions.


11. CHANGES TO THE EULA
By installing and using J-Jump Arena, you acknowledge and agree that this End User License Agreement (EULA) may be subject to changes or updates from time to time. The Developer reserves the right to modify the terms and conditions of this EULA at its discretion.

When significant changes are made to the EULA that materially affect your rights or obligations, a pop-up notification will be displayed to you upon launching the game. By continuing to use J-Jump Arena after such modifications have been presented, you indicate your acceptance of the revised EULA.

It is your responsibility to review the updated EULA each time you launch the game to stay informed of any modifications. If you do not agree with the revised terms, you may choose not to proceed with the use of J-Jump Arena.


12. SEVERABILITY:
If any provision of this End User License Agreement is found to be unlawful, void, or unenforceable, such provision shall be deemed severable from the rest of the Agreement, and it shall not affect the validity and enforceability of any other remaining provisions.


13. TERMINATION AND SANCTIONS
This License is valid unless terminated by Artbarian Games or you. Your online conduct should be guided by common sense and respect for others who access and use J-Jump Arena. Any violation of the Terms or engaging in inappropriate behavior, including but not limited to changing the source code of J-Jump Arena, using cheats, or harassing other players, may result in sanctions or termination of your access to the Online Multiplayer part of J-Jump Arena.

If you believe that the termination or sanctions against you were made mistakenly, please contact support at artbariangames@gmail.com.

Please note that even after the termination, the sections "Termination and Sanctions" and "Data Sharing" of this Agreement will remain in effect.


14. ACCEPTANCE:
By installing, accessing, or using J-Jump Arena, you expressly acknowledge and agree to be bound by the terms and conditions of this End User License Agreement (EULA). If you do not agree with any part of this EULA, you may not install or use J-Jump Arena.
