END USER LICENSE AGREEMENT (EULA)
IMPORTANT - READ CAREFULLY: This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and Pigs Fly Games LLC ("Company") for the software product, which includes computer software and may include associated media, printed materials, and online or electronic documentation (the "Software") accompanying this EULA.
BY DOWNLOADING, INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT, DOWNLOAD, INSTALL, COPY OR USE THE SOFTWARE.
GRANT OF LICENSE: The Company grants you a non-exclusive, non-transferable, limited license to use the Software in accordance with the terms and conditions of this EULA.
OWNERSHIP: The Software and any associated documentation are the exclusive property of the Company and its licensors, and are protected by copyright and other intellectual property laws. The Software is licensed, not sold, to you.
RESTRICTIONS: You may not copy, modify, distribute, sell, transfer, or reverse engineer the Software, or any portion thereof, without the express written permission of the Company. You may not use the Software for any illegal or unauthorized purpose.
WARRANTY DISCLAIMER: The Software is provided "AS IS" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The Company does not warrant that the Software will meet your requirements, or that the operation of the Software will be uninterrupted or error-free.
LIMITATION OF LIABILITY: In no event shall the Company be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Software, even if the Company has been advised of the possibility of such damages.
TERMINATION: This EULA will terminate automatically if you fail to comply with any of its terms and conditions. Upon termination, you must immediately cease all use of the Software and destroy all copies of the Software and associated materials.
GENERAL: This EULA represents the entire agreement between you and the Company concerning the Software and supersedes all prior or contemporaneous representations or agreements, whether oral or written. This EULA may only be modified in writing signed by an authorized representative of the Company. If any provision of this EULA is held to be unenforceable, the remaining provisions shall continue in full force and effect.
GOVERNING LAW: This EULA and any disputes arising out of or relating to this EULA shall be governed by and construed in accordance with the laws of the New Jersey, U.S.A, without regard to its conflict of law principles.
PRIVACY POLICY: The Company respects your privacy and is committed to protecting your personal information. By using the Software, you consent to the Company's collection, use, and disclosure of personal information in accordance with the Company's privacy policy, which can be found on the Company's website.
ONLINE LEADERBOARDS: The Software may include online leaderboards where your scores and other gameplay data may be shared with other players. By participating in online leaderboards, you agree to allow the Company to use your gameplay data for the purpose of displaying rankings and statistics on the leaderboard, including your name or username. You also acknowledge that your gameplay data may be publicly visible to other players, and that the Company is not responsible for any third-party use of your gameplay data that may result from participation in online leaderboards.
PLAYER INFORMATION: The Company may collect and use information about your gameplay, including but not limited to your scores, achievements, and progress in the game. This information may be used by the Company to improve the Software, provide support, and develop new features.
