II. End User Licence Agreement (EULA)
§ 1 Scope and Conclusion of Contract
1) This EULA governs the use of games and online services distributed by upjers GmbH (“upjers”) via Steam by the user (“player”).
2) By installing, launching or using an upjers game via Steam, you accept this EULA. In addition, the current Terms and Conditions of upjers (https://de.upjers.com/terms) and the Steam Subscriber Agreement (“SSA”) apply. In case of any conflict, the Steam rules prevail to the extent they are mandatorily applicable.
3) This EULA applies to all current and future Steam games published by upjers.
4) The services are intended exclusively for consumers within the meaning of Section 13 of the German Civil Code (BGB). Minors may participate only with the consent of their legal guardians.
§ 2 Grant of Licence and Usage Rights
1) upjers grants a non-exclusive, non-transferable, revocable licence to use the respective game for the duration of the contractual relationship.
2) The following is prohibited: reverse engineering, decompilation, cheats, bots or other manipulations, as well as trading virtual goods outside the intended game mechanisms.
3) All rights to the software, trademarks and content remain with upjers or its licensors

§ 3 Scope of Services and Availability
1) The games are provided in their current version. There is no entitlement to specific features.
2) Annual availability is at least 92 percent, excluding scheduled maintenance and cases of force majeure, unless paid services are affected whose use constitutes an essential part of the main performance obligation.
3) upjers may modify or discontinue games and, at its reasonable discretion exercised in good faith, offer replacement services (e.g. transfer of premium currency).
§ 4 Virtual Currency and Digital Content
1) Virtual currencies and items have no monetary value and may only be used within the game.
2) Purchases of premium currency made via Steam are processed by Valve Corporation, 10400 NE 4th Street, Bellevue, WA 98004, USA, acting as commission agent in its own name but for the account of upjers GmbH.
3) Payments and refunds are handled exclusively via the Steam platform. In case of payment issues or refund requests, Valve Corporation is the first point of contact. upjers has no access to payment data and cannot directly process refunds. For technical issues with game content or virtual goods, users may contact upjers support.
4) The right of withdrawal expires once you have consented to the immediate provision of the digital content and acknowledged that you thereby lose your right of withdrawal (Section 356 (5) of the German Civil Code (BGB)).
5) Exchange or refund of virtual currencies is excluded unless a statutory right exists.
6) Mandatory consumer rights remain unaffected.
7) upjers shall not be liable for malfunctions of the Steam store or payment infrastructure insofar as these are outside the responsibility of upjers.
§ 5 Duties of the User
1) Each player may use only one account per game at any time. Multiple accounts and automated use are prohibited.
2) Insulting, discriminatory, extremist or illegal content will lead to account suspension.
3) Violations of this EULA may, at upjers’ reasonable discretion exercised in good faith – particularly in cases of repeated or serious breaches – result in sanctions up to and including account termination.
4) Before a permanent suspension or termination, the user will – except in urgent cases – be informed of the intended measure and given the opportunity to comment before implementation.
§ 6 Liability
1) upjers is liable without limitation in cases of intent and gross negligence; in the event of damage arising from injury to life, body or health, upjers is also liable for simple negligence without limitation.
2) In cases of slight negligence, upjers is liable only for the breach of essential contractual obligations (cardinal obligations) and limited to the foreseeable, typically occurring damage.
3) The burden of proof is not reversed to the detriment of the user.
4) The foregoing limitations of liability apply, insofar as legally permissible, also in favour of upjers’ legal representatives and vicarious agents.
§ 7 Data Protection and Reference to Privacy Policy
1) upjers processes personal data exclusively in accordance with its Privacy Policy, available at https://de.upjers.com/privacy.
2) In the event of a conflict, the Privacy Policy prevails over this EULA.
§ 8 Termination and Deletion
1) You may delete your account at any time via the Steam interface or by contacting upjers support.
2) upjers may terminate the contract without notice for good cause (Section 314 of the German Civil Code (BGB)), particularly in cases of cheating, manipulation or abusive behaviour.
3) After termination, data will be deleted or anonymised in accordance with statutory retention periods.
§ 9 Governing Law and Final Provisions
1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers within the EU, the mandatory consumer protection provisions of their country of residence apply.
2) The place of jurisdiction – insofar as legally permissible – is Bamberg, Germany.
3) If any provision of this EULA is or becomes invalid, the validity of the remaining provisions shall not be affected.
4) Amendments to this EULA will only be made if reasonable for the user and do not result in significant disadvantages. Users will be informed of any changes via Steam or within the game. The updated version will be made available in the Steam store and shall be deemed accepted if the user continues to use the game after explicit notice.
5) upjers, as a provider of online services, complies with the information obligations under Articles 14 and 17 of Regulation (EU) 2022/2065 (Digital Services Act).
Effective as of October 2025 – This EULA replaces all previous Steam versions.
