In purchasing, downloading or using ‘Where is Earth?’ (“the Software”) you acknowledge that you have read and accept this entire agreement, and agree to be bound by the terms therein. If you do not agree to this agreement, then you must not buy, download, or use the Software.

In purchasing the Software, you purchase a perpetual license to install it for your own personal use. The author of the Software (“the Author”) retains ownership of the Software.

You may not distribute the Software. Many resources in the Software (sounds, music and graphics) are copyright protected. You are, however, allowed -within reason- to take screenshots, or make videos demonstrating use of the Software and distribute them.

The Author might make updates to the Software available from time to time, but is under no obligation to do so. The Author also isn't obligated to provide any ongoing support or maintenance for the Software.

The Software is provided “as is”. While the Author made every effort to deliver a high-quality product, the Author does not guarantee that the Software is free from defects and does not warrant that the Software will meet your requirements or desires. You bear the full risk as to its quality and performance. The Author expressly disclaims all other warranties, express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

You are aware and agree that you use the Software at your own risk. In rare instances, some users may experience seizures when exposed to certain light patterns or flashing lights. Exposure to certain light patterns or backgrounds may induce an epileptic seizure, or motion sickness even in persons who have no history of prior seizures or epilepsy.

Recent scientific studies found that the majority of gamers do not play in a way that is harmful or causes negative long-term consequences. A small minority, though, can become truly addicted to video games and as a result can suffer mentally, socially and behaviourally. The Author endorses responsible gaming through maintaining a balanced lifestyle and incorporated this in the game design. The Author can take no further responsibility; you are ultimately responsible for your own lifestyle.

You hold the Author blameless for any harm that may arise from your use of the Software or from actions or inactions of the Author in connection with the Software. Some jurisdictions do not allow for the limitation or exclusion of liability for incidental or consequential damages, so the above limitation of exclusion may not apply to you.

The Author reserves the right to modify the terms of this EULA from time to time and will post notice of material changes in the same manner you received this EULA.

Your local law may give you rights that this EULA cannot change. If so, this EULA applies as far as the law allows.

This agreement shall be governed by the laws of the jurisdiction of the Author. Any lawsuit relating to this agreement must be filed in the jurisdiction of the Author.

The Author can terminate this EULA if you breach any of the terms. You can terminate this EULA at any time by simply uninstalling the Software everywhere you installed it.

If the EULA is terminated, you no longer have any of the rights to the Software given in this license. Even if this EULA is terminated, provisions in it relating to jurisdiction and dispute resolution remain in effect.
