Brainwit Studios LLC is proud to provide you with You VS Drugs⢠game software. This End User License Agreement (EULA) governs your use of the Game License.
1. The Game contents were designed with educational and preventive intentions only: Any questions on the diagnosis or treatment of disturbances, disorders or illnesses should be directed to qualified medical/health personnel. Neither Brainwit Studios, nor its licensor(s), nor the Project Manager can be responsible or liable for the results derived from the use of the Game.
2. Subject to your agreement to and continued compliance with the terms and conditions of this EULA, Brainwit Studios hereby grants to you a limited, revocable, non-exclusive, nontransferable, personal license to download and/or install the Game onto a personal computer as many times a User needs to, as long as the computer is owned by the User. Any company, institution, association, etc. that wants to install/use the Game on multiple computers has to purchase a license for each computer.
3. The License granted herein confers no title or ownership in the Game (including without limitation the Game Client) and should not be construed as a sale of any rights to the Game. All rights, titles and interests in and to the Game and any and all copies thereof (including without limitation any and all titles, computer code, technology, themes, objects, characters, character names, stories, dialog, catch phrases, locations, concepts, artwork, music, etc.) are owned by Brainwit Studios.
4. The foregoing license does not permit you to do any of the following, and you agree that the violation of any of the following license limitations will constitute an infringement of Brainwit Studios' copyrights:
a. You may not sell, license or transfer the Game, or any reproductions or modifications thereof, to any person or entity;
b. You may not, or allow or authorize others, to copy, translate, derive source code from, modify, disassemble, decompile, reverse-engineer, or create derivative works based on the Game or any portion thereof;
c. You may not exploit the Game, or any portion thereof, for any commercial purpose;
5. Ownership. You agree that, between you and Brainwit Studios, Brainwit Studios owns and shall continue to own all rights, title and interest in and to the Game, all copies thereof, and all content therein. The Game is protected by copyright laws, international treaties and other laws. The Game may contain materials licensed by third parties, and the licensors of those materials are third party beneficiaries of this Agreement with the right to enforce their rights against you if you violate this Agreement.
6. Changes to the Agreement and the Game. Brainwit Studios may update this Agreement in its sole discretion, and you agree to the revised EULA by continuing to play the Game after receiving such revised EULA. This is necessary because, for example, if we manage to obtain resources to include the cooperative mode (co-op), we need to include details of this mode in this agreement. Thus, Brainwit Studios reserves the right to change or modify any aspect of the Game at any time. For us to make such modifications, we need you to agree you have no interest, monetary or otherwise, in any feature or content of the Game.
7. Remedies. The Founder and Project Manager has made many personal and financial efforts over the last 10 years to bring you a novel idea, materialized in the beta version of the video game. Therefore, you acknowledge that the Project Manager and Brainwit Studios may be irreparably harmed if you breach any of the provisions governing license or ownership limitations. You therefore agree that if you breach any of these provisions, in addition to demonstrable damages and reasonable attorneys' fees, Brainwit Studios will have the right to enjoin such breach and seek specific performance of such provisions in any court of competent jurisdiction.
