END-USER LICENSE AGREEMENT
Agarta™ (“Game”), is a paid computer game developed by FF Production. In this agreement, “Movies and Mooviezz Production” or “FF Production” shall mean a sole proprietorship of FF Production, an Istanbul, Turkey company; The words “you” and “your” shall mean the user of the computer on which the Game will be installed or installed.
Please read this end user license agreement (this “EULA” or “License Agreement”) carefully before clicking "I Agree". By downloading the game and clicking the "I Agree" button or using the game or installing the game client software ("software"), you agree that this license agreement is enforceable in the same way as any written agreement signed by you.
If you do not accept all the terms of this license agreement, close this window and indicate that you do not accept the terms of this license agreement and will not complete the installation of the software.
By signing this license agreement, you represent that you are at least 18 years old (even if you are signing this agreement on behalf of an authorized user under the age of 18) and that you have the legal authority to enter into an agreement in your jurisdiction.
The terms of this agreement may be amended, supplemented or changed at any time at FF Production's sole discretion; FF Productions may update or upgrade its software product upon prior notice as follows.
If any future changes to this Agreement are unacceptable to you or cause you to no longer comply with this Agreement, you may terminate this Agreement in accordance with Section 7 below.
Your installation and use of any update, upgrade or change made by FF Production to the Software, or your continued use of the Software following notification of changes in this Agreement, will clearly indicate your acceptance of such changes.
FF Production may at any time change, modify, suspend or terminate any feature of the Software. FF Production may also impose limits on certain features or restrict your access to some or all of the Software Product without notice or liability. You have no monetary or other interest in any feature or content of the software.
1. LIMITED USE LICENSE
When you accept this License Agreement, you may install the Software on your computer to play the Game by registering and accessing a User Account (“Service”). Subject to your acceptance of this License Agreement and your continued compliance with this Agreement, FF Production (a) may install the Software on one or more computers owned by you or under your legal control, and (b) use the Software solely for your non-commercial entertainment purposes in connection with the Service. grants you a limited, non-exclusive license, and you hereby agree to it.
All use of the Software is subject to your acceptance of this License Agreement and Terms of Use, which you must accept before using your User Account (hereinafter "Account") to play the Game.
2. LICENSE RESTRICTIONS AND LIMITATIONS
The limited, personal use license granted to you in Section 1 is subject to the following restrictions and limitations and all other terms and conditions of this Agreement (collectively, "License Limitations").
You agree that under no circumstances will you:
a. Except as expressly permitted in this Agreement, you will not sell, sublicense, assign, rent, lease, sell or transfer the Software;
b. Except as expressly permitted by applicable law; reverse engineer, decompile, disassemble, or otherwise derive source code or game data from the Software, or reduce the Software to a human-readable form;
c. You will not copy, photocopy or reproduce the software in whole or in part; however, you may make one (1) copy of the Game Software and Game manual for archival purposes only;
d. Modify, translate or create derivative works based on or using the Software, Service or Software experience or any part thereof;
e. Remove or falsify any copyright or other proprietary notices contained in or relating to the Software, Service or Game experience or any portion thereof;
f. You will not use cheats, automation software (bots), hacks, mods or other unauthorized third party software, tools or content designed to modify the Software, Service or Game experience;
g. Except where FF Productions, in its sole discretion, permits the use of certain third-party user interfaces, including any software that reads the RAM areas the Software uses to store information about a character, in-game elements or the Software environment use, but not limited to, any unauthorized third-party software that intercepts, "miners," or otherwise collects information in or through the Software or Service;
h. You will not modify or allow or cause any modification of the files that are part of the Software in any way not expressly permitted in writing by FF Production in any event;
i. You will not create any other software or content that includes the Software or the Service or any part thereof; or
j. You will not sell, warrant, or transfer copies of the Software to other parties, or lease, lease, or license the Software to others in any manner not expressly permitted herein.
3. TELİF HAKLARI, TİCARİ MARKALAR VE MÜLKİYET HAKLARI
a. Agarta™ and certain related names and logos are registered or unregistered trademarks, service marks and/or trade names of FF Production. These and all other trademarks, service marks and trade names (“Marks”) used in or in connection with the Software are the property of FF Productions or its licensors.
b. The Software, Game, Service, Site, Your Account and all content contained therein (including Accounts, computer code, titles, objects, artifacts, characters, character names, locations, location names, stories, plots, dialogue, slogans, artwork, graphics , structural or landscape designs, animations, sounds, musical composition and recordings, audiovisual works, including but not limited to character likenesses and operating methods) are the property of FF Productions or its licensors.
The Software may contain materials licensed by third parties, and the licensors of such materials may exercise their rights in the event of any breach of this Agreement. The Software and Game and all the content they contain are protected by the Republic of Turkey and other international intellectual property laws.
FF Production and its licensors reserve all rights in connection with the Software and Game, including but not limited to the exclusive right to create derivative works from the Software and Game, and you agree that you will not create any authorship based on the Game except as expressly permitted by FF Productions.
You acknowledge and agree that you have no monetary or other interest in any feature or content of the software. In addition, you agree and declare that you will not have any property or other property rights in your Account and that all rights related to the Account belong to FF Production and will forever be in favor of FF Production.
4. PATCHES AND UPDATES
FF Productions may distribute or provide Game patches, updates and modifications that must be installed in order to continue playing the Game. FF Production may remotely update the Game, including but not limited to the Game Client Software on your machine, without your knowledge, and you hereby give your consent to FF Production to distribute and apply such patches, updates and changes.
5. TERMINATION
This License Agreement is valid until terminated. You may terminate the License Agreement at any time by (i) permanently destroying all copies of the Game in your possession or control; (ii) You may terminate the software by uninstalling it from your hard drive. FF Production may terminate this Agreement at any time for any reason or no reason. Upon termination for any reason, all licenses granted herein are immediately terminated and you must immediately and permanently destroy and remove from your hard disk all copies of the Game in your possession or control.
6. WARRANTY DISCLAIMER
To the extent permitted by applicable law, the game and all information, content and services it contains are provided "as is" without warranty of any kind, express or implied. FF Production expressly disclaims any implied warranties of ownership or non-infringement or fitness for a particular purpose, with the exception of warranties which are not subject to the exclusion, limitation or modification under applicable law. Use of the game is entirely at your own responsibility.
FF Production, third party providers of FF Production, and any person or organization involved in the creation, production or distribution of any content or service in the game, or their respective managers, officers, employees or agents, including that the game will be uninterrupted or error-free. makes no warranties of any kind, including but not limited to; it also makes no warranties regarding the results that may be obtained from the use of the game or the accuracy, reliability, quality or content of any information, services or goods provided on the game or through the game, including but not limited to all FF Production communication features.
7. LIMITATION OF LIABILITY
FF Production shall not be liable in any way for any loss or damage resulting from the game or any use of the game, including but not limited to data loss, loss of reputation, business interruption, computer error or malfunction, or any other damage or loss. FF Production will not be liable for service interruptions, including but not limited to ISP outages, software or hardware failures, or other events that may result in data loss or service interruption. Under no circumstances will FF Production be liable to you for any indirect, incidental, special, exemplary or consequential damages.
As some states or jurisdictions do not allow the exclusion or limitation of consequential or incidental damages in those states or jurisdictions, FF Production's liability will be limited to the fullest extent permitted by applicable law.
8. EQUITABLE REMEDIES
You hereby agree that FF Production will be irreparably damaged if the terms of this Agreement are not specifically enforced, and therefore, FF Production will be entitled to no bail or other security or proof of damage in any court of competent jurisdiction for breach of this Agreement. You acknowledge and agree that you have the right to resort to equitable remedies and that such equitable remedies will be in addition to any other remedies FF Production may otherwise have under applicable law. If any action is brought by either party in connection with this Agreement, the winning party shall be entitled to recover from the other party all costs, attorneys' fees and other costs incurred by that winning party during the proceedings.
9. OTHER PROVISIONS
This License Agreement represents the entire agreement between you and FF Production on the subject and supersedes any previous or concurrent agreements between you and FF Production; however, there is a condition that this License Agreement will exist together with the Terms of Use and Privacy Policy and will not replace them. In cases where the provisions of this License Agreement conflict with the Terms of Use, the conflicting provisions of the Terms of Use shall prevail.
The game is operated by FF Production in the Republic of Turkey. Those who choose to access the Game from locations outside the Republic of Turkey do so on their own initiative and are responsible for complying with applicable local laws.
The failure of FF Production to enforce any provision of this License Agreement shall in no way be construed as a waiver of such provision, either now or in the future, and will in no way affect the right of any party to subsequently enforce each and all of these provisions.
FF Production's express waiver of any provision, condition or requirement of this License Agreement shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement. If any provision of this License Agreement is determined to be invalid or unenforceable for any reason, that provision will be revised to the extent necessary to make it enforceable to the maximum extent permitted by the parties' intent, and the remainder of this License Agreement will remain in full force and effect. However, if it is determined that it is not possible to amend this provision, this provision shall be deemed separate from these conditions and shall not affect the validity and applicability of the remaining provisions.
The provisions of Sections 2, 3, 6 and 9 will remain valid even if the termination of this License Agreement.
