END USER LICENSE AGREEMENT
PLEASE READ THE FOLLOWING END USER LICENSE AGREEMENT (THE “AGREEMENT”) BEFORE INSTALLING THE GAME SOFTWARE YOU HAVE JUST PURCHASED (THE “GAME SOFTWARE”). BY INSTALLING, COPYING AND / OR OTHERWISE USING THE GAME SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT AS ESTABLISHED BY PROMVI GAMES SL, WITH HEADQUARTERS AT SANT JORDI, 24 VILADECAVALLS (BARCELONA) SPAIN, AND ITS AFFILIATED COMPANY (COLLECTIVELY DENOMINATED, "PROMVI GAMES SL"). IF YOU AGREE TO THE TERMS SET FORTH HEREIN, select “I AGREE” to install the Game Software. By installing or using the Game Software, you fully accept the terms and conditions of this Agreement and agree to be bound by them.
IF YOU DO NOT ACCEPT THE TERMS SET FORTH HEREIN, select “CANCEL”, and Promvi Games SL will not grant you the License (defined below) for the Game Software.
LIMITED USE LICENSE
The term "Game Software" includes the software included in this video game, the associated media, any software associated with the online mode of the video game (subject to any additional terms of use applicable to such online mode), printed materials, manuals, any online or electronic documentation, and all copies of such software and materials. Promvi Games SL grants you the non-exclusive, non-transferable and limited license and right to install and use one (1) copy of the Game Software on one (1) computer hard drive at any given time exclusively for your personal use (the "License"). Promvi Games SL and, if applicable, its licensors, hereby reserve all rights not specifically granted under this License. The Game Software is licensed to you, not sold to you. This License does not grant you any ownership or ownership rights in the Game Software, and should not be construed as a sale or transfer of any intellectual property or other rights in the Game Software.
OWNERSHIP
You accept and acknowledge that all ownership, property and intellectual property rights related to the Game Software and any and all copies of it (including but not limited to derivative works, titles, computer codes, themes, objects, characters, character names, stories, dialogues, slogans, places, concepts, works of art, graphics, animations, sounds, musical compositions, audiovisual effects, text, on-screen displays, methods of operation, moral rights, embedded applets the Game Software and any related documentation) are the property of Promvi Games SL or its licensors.
The Game Software is protected by the intellectual property laws of Spain, by international treaties and conventions on intellectual property, by the trademark laws of Spain and the common law system, and by other laws. All rights are reserved worldwide. The Game Software contains certain third party materials licensed by Promvi Games SL, and Promvi Games SL and the licensees of Promvi Games SL may protect their rights in the event of violation of this Agreement.
CONDITIONS AND RESTRICTIONS OF THE LICENSE
You agree to use the Game Software or any part of it, only in a way that conforms to what is specified in this License and you MUST NOT:
(a) use, advertise or commercially exploit the Software in any way of the Game or any of its parts without the written authorization of Promvi Games SL, which includes but is not limited to use in an internet café, computer game center or any other site based in a local;
(b) use the Game Software or allow the Game Software to be used on more than one computer, game console, handheld device or PDA (personal digital assistant) at the same time, without a separate additional license from Promvi Games SL ;
(c) use the Game Software, or allow the Game Software to be used on a network, multi-user plan or remote access plan, including any online use, unless expressly permitted in writing by Promvi Games SL;
(d) make copies of the Game Software or any part of it, except that you may make one (1) copy of the Game Software for backup or archival purposes, or make copies of the materials. accompanying the Game Software as a backup copy for non-commercial and reference purposes only;
(e) sell, rent, lease, license, distribute, upload to any Internet server or website, or transfer in any other way a part of this Game Software or copies without the express prior written consent of Promvi Games SL A Notwithstanding the foregoing, you may permanently transfer all of your rights and obligations under the License to another person for non-commercial use by physically transferring the original media of the Game Software (for example, the CD-ROM or DVD you purchased), the original packaging, and all manuals or other documentation distributed with the Game Software, provided that you permanently delete all copies and installations of the Game Software that are in your possession or control, and that the recipient accepts the terms of this Agreement. You will be solely responsible for the taxes, fees, duties, withholdings, charges and appraisals that may correspond in relation to said transfer;
(f) reverse engineer, derive source code, modify, decompile, disassemble or create derivative works of the Game Software, in whole or in part (except as expressly permitted by applicable law, in which case any and all modifications, adaptations, improvements, etc. that are legitimate and all intellectual and moral property rights over them will be considered assigned and will belong, will be conferred and will be the exclusive property of Promvi Games SL and / or its licensors on the creation, in all cases );
(g) remove, disable or bypass security protections or technical measures that control access to the Game Software;
(h) remove, modify, deface or circumvent patent notices or labels contained on or within the Game Software;
(i) export or re-export the Game Software or a copy or adaptation in violation of applicable laws or regulations; or
(j) create data or executable programs that mimic data or functionality of the Game Software.
In addition, you agree to comply with the safety information, maintenance instructions or other relevant notices contained in the manual that is included with the Game Software.
GAME SOFTWARE UPDATES AND PATCHES
Promvi Games SL may offer updates, patches and other modifications to the Game Software that must be installed for the game to work. Promvi Games SL may install updates, patches or modifications to the Game Software remotely and access the Game Software on your computer for this purpose, and you hereby grant Promvi Games SL the right to install and apply such patches, updates and modifications. All provisions of this Agreement that refer to "Game Software" also include such patches, updates and modifications in their entirety.
LIMITED WARRANTY
You acknowledge and agree that use of the Game Software and the media on which it is recorded is at your sole risk. This Limited Warranty will not be valid in the event that the defects have been caused by your negligence, an accident, improper use, modification, alteration or any other reasons not related to defective materials or workmanship problems, and Promvi Games SL and its Licensees will not be liable for any damage, injury or loss caused by any of these reasons.
UNLESS EXPRESSLY STATED TO THE CONTRARY IN THIS AGREEMENT, THE GAME SOFTWARE IS DELIVERED “AS IS”, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING NON-TAXABLE WARRANTIES WHATSOEVER. OF CONDITION, UNINTERRUPTED USE, FITNESS FOR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR ABSENCE OF VIOLATION OF RIGHTS. NO VERBAL OR WRITTEN INFORMATION OR ADVICE PROVIDED BY PROMVI GAMES SL OR ANY OF ITS AUTHORIZED REPRESENTATIVES SHALL CONSTITUTE A WARRANTY OR EXTEND IN ANY WAY THE SCOPE OF THIS LIMITED WARRANTY.
Some states and jurisdictions do not allow the exclusion or limitation of limited or implied warranties, and in such states and jurisdictions, the liability of Promvi Games SL and its licensors will be limited to the maximum extent permitted by law. You may have other rights that vary by state or jurisdiction. No implied warranty required by law will exceed the 90-day term of the above Limited Warranty under any circumstances.
LIMITATIONS ON DAMAGES
NEITHER PROMVI GAMES SL NOR ITS LICENSORS WILL BE LIABLE IN ANY EVENT FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM THE POSSESSION, USE, OR FAILURES IN THE GAME SOFTWARE, INCLUDING IN ANY NON-TAXATIVE, DAMAGING, OR DAMAGING WAY. TERM AND TERMINATION
Without prejudice to any other rights of Promvi Games SL, the License will remain in force as long as you use, operate or execute the Game Software. The License will automatically terminate in the event that you fail to comply with its terms and conditions. In that event, you must uninstall and destroy all copies of the Game Software. You may also terminate the License at any time by destroying the Game Software and uninstalling it from your computer (s) or other applicable hardware. JUDICIAL

INDEMNIFICATION
You agree to indemnify, defend and hold harmless Promvi Games SL, its partners, affiliates, contractors, licensees, executives, directors, employees and representatives against all claims, damages, costs and expenses (including reasonable legal fees) that arise, directly or indirectly, from your acts or omissions in connection with the use of the Game Software or from any breach by you of the terms of this Agreement.
CHOICE OF APPLICABLE LAW AND JURISDICTION
THIS AGREEMENT, AND THE RIGHTS AND OBLIGATIONS OF PROMVI GAMES SL AND YOU WITH REGARD TO THE GAME SOFTWARE, WILL BE INTERPRETED AND ENFORCED UNDER THE LEGISLATION OF SPAIN, WITHOUT TAKING INTO ACCOUNT THE PRINCIPLES OF THE CONFLICT OF LAWS OF SPAIN. TO THE EXTENT THAT A CLAIM MUST BE GOVERNED BY SPANISH LAW, THE APPLICATION OF SAID LAW WILL ALSO BE CORRESPONDING. PROMVI GAMES SL AND YOU ACCEPT THE EXCLUSIVE PERSONAL JURISDICTION OF THE STATE COURTS OF BARCELONA, SPAIN, IN RELATION TO ANY CLAIM OR CONTROVERSY RELATING TO THIS AGREEMENT OR THE GAME SOFTWARE, AND PROMVI GAMES SL AND YOU RENUNCISE AT ALL RENEWAL OF THE BASIS. OR THE INCONVENIENCE OF SUCH FORUM. IN THE EVENT THAT YOU RESIDE OUTSIDE OF SPAIN, THE APPLICATION OF THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS IS EXPRESSLY EXCLUDED.
AMENDMENTS
Promvi Games SL reserves the right to amend this Agreement at any time, in its sole discretion, but will post such changes on the Promvi Games SL website and / or communicate such changes through the Steam service. If any such future amendments to this Agreement are not acceptable to you or result in your failure to comply with this Agreement, you may terminate the Agreement in accordance with the termination provisions above. If you install and use any updates or modifications to the Game Software or if you continue to use the Game Software after being notified of the amendments made to this Agreement, it will be construed that you have accepted any and all amendments to the terms of this Agreement.
MISCELLANEOUS PROVISIONS
This Agreement expresses the full agreement between you and Promvi Games SL regarding the License and your rights to use the Game Software, and supersedes all prior agreements and representations, warranties or understandings between you and Promvi Games SL (either that were done negligently or in good faith, but not including those done fraudulently) with respect to the same subject. In the event that any provision of this Agreement is deemed unenforceable for any reason, such provision shall be modified only to the extent necessary to make it applicable, and the remaining provisions of this Agreement will remain in full force and remain unaffected.

PROMVI GAMES SL AND YOU ACCEPT THE EXCLUSIVE PERSONAL JURISDICTION OF THE STATE COURTS OF BARCELONA, SPAIN, IN RELATION TO ANY CLAIM OR CONTROVERSY RELATING TO THIS AGREEMENT OR THE GAME SOFTWARE, AND PROMVI GAMES SL AND YOU RENUNCISE AT ALL RENEWAL OF THE BASIS. OR THE INCONVENIENCE OF SUCH FORUM. IN THE EVENT THAT YOU RESIDE OUTSIDE OF SPAIN, THE APPLICATION OF THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS IS EXPRESSLY EXCLUDED.
AMENDMENTS
Promvi Games SL reserves the right to amend this Agreement at any time, in its sole discretion, but will post such changes on the Promvi Games SL website and / or communicate such changes through the Steam service. If any such future amendments to this Agreement are not acceptable to you or result in your failure to comply with this Agreement, you may terminate the Agreement in accordance with the termination provisions above. If you install and use any updates or modifications to the Game Software or if you continue to use the Game Software after being notified of the amendments made to this Agreement, it will be construed that you have accepted any and all amendments to the terms of this Agreement.
MISCELLANEOUS PROVISIONS
This Agreement expresses the full agreement between you and Promvi Games SL regarding the License and your rights to use the Game Software, and supersedes all prior agreements and representations, warranties or understandings between you and Promvi Games SL (either that were done negligently or in good faith, but not including those done fraudulently) with respect to the same subject. In the event that any provision of this Agreement is deemed unenforceable for any reason, such provision shall be modified only to the extent necessary to make it applicable, and the remaining provisions of this Agreement will remain in full force and remain unaffected.
