End-User License Agreement (EULA) for Duelists of Eden
This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Ristaccia LLC ("Company"), regarding the use of the video game "Duelists of Eden" ("Game").
BY INSTALLING, COPYING, OR OTHERWISE USING THE GAME, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT INSTALL OR USE THE GAME.
License Grant. The Company grants the User a limited, non-exclusive, non-transferable license to use the Game for personal, non-commercial purposes.
Collection of Data. The User acknowledges and agrees that the Company may collect data related to the User's use of the Game, including but not limited to, gameplay data, device information, and usage statistics. The data collected will be used for the purpose of improving the Game, providing technical support, and preventing fraud or misuse of the Game. The User further acknowledges and agrees that the Company will not sell or otherwise transfer the data collected to any third party.
GDPR Compliance. The Company complies with the General Data Protection Regulation (GDPR) and is committed to protecting the privacy and data rights of its users. The User has the right to access, rectify, or delete their personal data, as well as the right to object to data processing or withdraw consent. Online Multiplayer and Chat. The User acknowledges and agrees that the Game may include online multiplayer and chat features, and that any communication or interaction with other players is subject to the Company's terms of service and code of conduct. The Company reserves the right to monitor and moderate all user-generated content and communications, and to take appropriate action, including but not limited to, suspending or terminating the User's account, in the event of any violation of the terms of service or code of conduct.
Ownership. The Game and all intellectual property rights therein are and shall remain the exclusive property of the Company. The User shall not sell, license, or transfer the Game or any portion thereof.
Disclaimer of Warranty. The Game is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The Company does not warrant that the Game will meet the User's requirements or that the operation of the Game will be uninterrupted or error-free.
Limitation of Liability. In no event shall the Company be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Game, even if the Company has been advised of the possibility of such damages.
Termination. This Agreement shall remain in effect until terminated by either party. The User may terminate this Agreement at any time by uninstalling the Game. The Company may terminate this Agreement at any time without notice if the User breaches any of the terms or conditions of this Agreement.
Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without giving effect to any principles of conflicts of law.
Entire Agreement. This Agreement constitutes the entire agreement between the User and the Company regarding the use of the Game and supersedes all prior agreements and understandings, whether written or oral.
