A design is a board, piece, image, or anything else created in ChessCraft. Any designs that you choose to share are released to the public domain so that everyone can enjoy them for free.

ChessCraft is meant to be fun and safe for all ages. Only share designs you created that are good for the community. For images, if you upload “Teen” images or above and do not label them as such, you may be suspended or blocked. ChessCraft may remove or change designs at any time. You can report inappropriate designs in-app and on the website.

As much as is possible, ChessCraft is not liable for any loss or damage that occurs as a result of using the Service.

Welcome to the Frame of Mind Terms of Use agreement. By using our Service or App, you agree to all of these terms. If you don't agree, don't use the Service!

Vocabulary

For the purposes of this agreement:
• "Company" refers to Frame of Mind, the company that created ChessCraft.
• "Service" refers to the Company's games, apps, and website which can be accessed at www.chesscraft.ca.
• The terms "we", "us" and "our" refer to the Company. "You" refers to you, as a user of our Services.
• "Design" refers to chess variant designs like boards, pieces, images, or other user generated content created while using the Service.
• "User Content" includes Designs and other user generated content while using the Service.

About the Service

The Service allows you to share your Designs online. Sharing a Design may create a unique web page that is publicly available, and can be used by the App so that others can play your Design.

Intellectual Property

Any Designs you create with the Service are released to the public domain. You hereby waive and agree never to assert any moral rights of paternity, publication, reputation, or attribution with respect to the Company and other players’ use and enjoyment of such assets in connection with the Software and related goods and services under applicable law. This license grant to the Company, and terms above regarding any applicable moral rights, will survive any termination of this Agreement.

Use Restrictions

Your permission to use the Service has conditions. You must not:
• Use the Service to promote a business, third party services, URLs, or obfuscated URLs.
• Use the Service for any unlawful purpose or to promote illegal activities.
• Post any content that is abusive, threatening, obscene, defamatory, libellous.
• Post any hate speech or extreme content as defined, but not limited to, the Canadian Charter of Rights and Freedoms and the Canadian Criminal Code.
• Post any Teen, Mature, or Adult content (using ESRB guidelines) without labelling it with at least that content rating.
• Attempt to, or harass, abuse or harm another person or group.
• Submit any content to the Service that is copyrighted or subject to third party proprietary rights, including privacy, publicity, trade secret, or others, unless you are the owner of such rights or have the permission from their rightful owner.
• Impersonate someone without permission.
• Interfere with the proper functioning of the Service.
• Make any automated use of the Service or related systems without written permission. (We grant permission to free public search engines)
• Bypass robot exclusion headers or other measures to restrict access to the Service.
• Circumvent or disable security features of the Service.
• Publish or link to malicious content of any sort.

Violating any of these restrictions may result in User Content deletion, modification, or blocking anyone from using the Service.

Liability

The Company is not liable for any loss or damage that occurs as a result of using the Service. The Service is not responsible for the storage, integrity, or public display of your User Content. The Company is not responsible for any public display or misuse of your User Content.

The Company does not, and cannot, pre-screen or monitor all User Content. However reasonable best efforts will be employed so that the Service is child friendly.

Provide Notice

Communications made through the Service will not constitute legal notice to the Site, Service, or Company. Instead, contact us by email: legal@chesscraft.ca

Changes to this Document

We may update this document from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new document on this page. These changes are effective immediately after they are posted on this page.

Choice of Law

Any legal disputes or processes will use the laws of the province of Quebec, Canada.
